In this context, if the\n\" '\u00e9vidgncg prp'w_:'1-and other 3 witnesses i,c., Pw.2, 5 and 5 is\n\n  it is the speci\ufb01c version of an these witnesses\n~  No.2 caused the assault with the spade,\n accused No.3 assaulted with the club and accused\n\n No.4 assaulted with the machhu. The doctor has opined\n\nM\n\n\n\n12\n\nthat these injuries can be caused by the weapons stated\n\nabove.\n\n11, So, the perusal of the witnesses of the  \n\ncorroborates the version of the ev1d' ence of~PW$.   \n\n6. So far as the Part Played by accused   i\"t--A\n\nconcerned, the evidence of all these  Vis.co'n,siSte'nt,. \n\nand cogent. There is no material   fa'-I'\ufb02as_t?I1e\npart piayed by accused Nos.  ,4  Though,\nan effort has been made in   nothing\nrelevant has   V'  discard the\n\nevidence of these w\u00e9t11e.939\u00a2&amp;. K '  \n\n12.  is concerned, though\nPW.1 states. that   accused Nos. 2 to 4 to cause\nth\u00e9Jt.assantt' on  \"\"  ev\ufb02 enee has not been\n\ncong,:3gm;\u00a2a, hy.:,:&amp;tit1eAV,.ei{\u00a7:dence of ms. 2, 5 and 6. PW.1\n\n 'E-,3;.1tes   1 instigated the other accused to\n\n asseuit, whereas PW2, 5 and 6 does not say\n\n  eeqegaxtls the instigation and the mere fact that\n\n  was present there is itself not su\ufb02icient to\n\n the accused N01 has shared the common\n\n ioten\ufb01on with the other accused. The trial Court, so far as\n\naccused No.1 is concerned, has relied upon the evidence of\n\n \n\n\n\nI3\n\nPW.1 about the instigation to cause the assault. But, as his\n\nevidence is inconsistent with the evidence of Pws 2, 5 and 6, H\n\nI think it would be just and proper to extend the bene\ufb01t sf'\n\ndoubt to the first accused. Complete re1:an' cc o1':I,;A. -5 \n\nevidence of pvm by the trial Court view\"\"af.::j'\ufb011\u00e9':::'~\n\ninconsistency is improper.\n\n13. So far as the spot ?f2  \n\nthough the pmosecution has   3\nand 4, they have net supppxied   of the\nprosecution and in   =  fact that\nthese all attesting is itsekt' not\nsu\ufb01cient to    tiaeiheres\ufb01gating o\ufb01ccr,\nwho states   ;.g,aa.hazar, Ex.P.4 in the\npresence of the \n\n  \"e  established principle of law that\n\n   \ufb02ees not  an innocent and\n\n_ 'c19es.1;ot lee:ve V1'a.;peI\"son who rea\ufb01y caused the harm. In that\n\nC me\ufb02er, the evidence of PW .1 which has been\n\n by the evidence of PW2, 5 and 6 strengthens\n\n  V .  of the prosecution as regards the part played by\n\n Nos. 2, 3 and 4. It is also wen established pnncx' \"pk:\n\nof law that whenever there are more than one accused\n\n94\n\n \n\n\n\n:\"\"-widence  is diluted. Generally, whenever an\n 'goes to the hospital for the purpose of the\n  severe injuxies, he may not give all the details\n\n' V\"  itaciclent and even may not mention the names of a\ufb01\n'V   But, the fact that the complaint, Ex.P.1 refers\n\n  the name of accused N02 and his end' woe is\n\n14\n\narrayed in a case, the Court has to be cautious and make an\n\n \n\neffort to remove the grain from the cha\ufb01. So far as \n\nNos 2 to 4 are concerned, them is consistent, cogent and'\nacceptable version but, as regards accused N11 1, the   j\" \nof doubt has to be extended, as the evidencecf   .\nbeen corroborated by P'Ws.'2, 5 and 6.
