Balakrishnan.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>J  U  D\t G  M  E  N  T<br \/>\nRAJENDRA BABU,\t J. :\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<br \/>\n    The\t petitioner  before us has been charged that  on  or<br \/>\nabout 27.07.1998 at Kilapokhari of Balasore Town abetted the<br \/>\ncommission  of\tthe offence by (i) Azad Parvez, (ii) Batu  @<br \/>\nJahid  Parvej  and (iii) Allauddin Saha @ Sk.  Allauddin  or<br \/>\nwas  party  with them to a criminal conspiracy to commit  an<br \/>\noffence\t of  possessing\t and\/or\t  sale\tcannabis  ganja\t and<br \/>\nmanufactured  drugs  punishable\t under\tChapter\t IV  of\t the<br \/>\nNarcotic  Drugs\t and  Psychotropic   Substances\t Act,\t1985<br \/>\n[hereinafter referred to as the Act] and thereby committed<br \/>\nan  offence  punishable under Section 20(b) and\t Section  21<br \/>\nread with Section 29 of the Act within the cognizance of the<br \/>\nSpecial Judge at Balasore.\n<\/p>\n<p>    The\t gist of the case is that a Special Case No..  63 of<br \/>\n1998  was  filed in which one Md.  Diwan was apprehended  by<br \/>\nSubrat\tKumar Behera, SI of Police and from his\t possession,<br \/>\nas  is alleged, 500 gms of ganja was seized for which this<br \/>\nSpecial\t Case  No.  63 of 1998 was instituted and the  trial<br \/>\ntherein\t was  going  on\t in  the  Court\t of  Special  Judge,<br \/>\nBalasore.   It\tis alleged that Md.  Diwan disclosed  before<br \/>\nthe  arresting\tauthority that he works for Azad Parvez\t who<br \/>\ndoes  the  business of contraband articles and he knows\t the<br \/>\nplace  where  Azad  Parvez  had\t  kept\tall  the  contraband<br \/>\narticles.  On the basis of this report, house of Azad Parvez<br \/>\nwas  searched and the contraband articles were also  seized.<br \/>\nA  separate FIR having been lodged on 27.7.1998 another case<br \/>\nwas  registered\t pursuant to which Special Case No.   64  of<br \/>\n1998  was lodged before the Special Judge, Balasore.  Subrat<br \/>\nKumar  Behera, SI of Police recorded a statement four months<br \/>\nafter  the  institution of Special Case No.  63 of  1998  on<br \/>\n23.11.1998  that  Md.  Diwan stated that the  petitioner  in<br \/>\nthis  case  is also working for Azad Parvez.   On  recording<br \/>\nsuch  statement\t the petitioner was also implicated  in\t the<br \/>\ncase  and  was arrested and is facing the trial,  as  stated<br \/>\nearlier.  There are 10 accused persons in the case, but only<br \/>\n6  accused  persons  are  arrested and 4 are  stated  to  be<br \/>\nabsconding.   In  these\t circumstances, the  Special  Judge,<br \/>\nBalasore,  pursuant to an order made on 24.3.1999,  splitted<br \/>\nthe  case into two cases as Special Case No.  64 of 1998 and<br \/>\n64A  of 1998.  On 30.3.1999 charges were framed against\t the<br \/>\nsix  accused  persons, including the petitioner\t for  having<br \/>\ncommitted  offence  under Section 20(b) and Section 21\tread<br \/>\nwith  Section  29 of the Act and, since four  other  accused<br \/>\npersons\t were  absconding, the charges could not  be  framed<br \/>\nagainst\t them.\tBail application filed by the petitioner  on<br \/>\nseveral\t grounds stood rejected by orders dated 8.9.1999 and<br \/>\n15.1.2000.   The Orissa High Court suo motu took  cognizance<br \/>\nof  the\t case on the basis of a news report and by an  order<br \/>\nmade  on 30.7.1999 set aside the order of the Special Judge,<br \/>\nBalasore  made\ton  24.3.1999 splitting the  case  into\t two<br \/>\ncases.\t It is also brought to the notice of the court\tthat<br \/>\nAzad Parvez is facing trial in TR 8 of 1998 before the IIIrd<br \/>\nAdditional  District  Judge,  Howrah and was lodged  in\t the<br \/>\nHowrah\tjail.\tThe  Special Judge, Balasore  requested\t the<br \/>\nIIIrd  Additional  District Judge, Howrah to make  available<br \/>\nthe accused Azad Parvez to Balasore for purposes of trial in<br \/>\nthe  present  case.  However, the IIIrd Additional  District<br \/>\nJudge,\tHowrah declined to do so on account of difficulty in<br \/>\nsecuring  him  back in his court.  The said Azad  Parvez  is<br \/>\nalso facing another trial in the Special Court at Alipore in<br \/>\nSpecial\t Case  No.   4\/NCB\/Cal\/99 and in  Special  Court  at<br \/>\nBerhampore, Murshidabad in GR Case No.\t485 dated 16.6.1989.<br \/>\nOut  of 10 accused persons only nine accused persons are  in<br \/>\ncustody\t and,  one  accused person Rokia  Sultana  is  still<br \/>\nabsconding.   Nine witnesses have been examined in this case<br \/>\nand it is claimed that none of the witnesses have implicated<br \/>\nthe  petitioner as an accomplice of Azad Parvez and all that<br \/>\nPW 5 said is that he had seen Azad Parvez visiting the house<br \/>\nof  the\t petitioner and it is claimed that no other  witness<br \/>\nhas so far implicated the present petitioner in any manner.\n<\/p>\n<p>    In view of Section 37((1)(b) of the Act unless there are<br \/>\nreasonable  grounds  for believing that the accused  is\t not<br \/>\nguilty\tof such offence and that he is not likely to  commit<br \/>\nany  offence while on bail alone will entitle him to a bail.<br \/>\nIn the present case, the petitioner attempted to secure bail<br \/>\non  various grounds but failed.\t But those reasons would  be<br \/>\ninsignificant  if  we  bear  in mind the  scope\t of  Section<br \/>\n37(1)(b)  of  the Act.\tAt this stage of the case  all\tthat<br \/>\ncould  be  seen is whether the statements made on behalf  of<br \/>\nthe  prosecution  witnesses, if believable, would result  in<br \/>\nconviction  of the petitioner or not.  At this juncture,  we<br \/>\ncannot\tsay that the accused is not guilty of the offence if<br \/>\nthe allegations made in the charge are established.  Nor can<br \/>\nwe  say that the evidence having not been completely adduced<br \/>\nbefore\tthe Court that there are no grounds to hold that  he<br \/>\nis not guilty of such offence.\tThe other aspect to be borne<br \/>\nin  mind  is  that the liberty of a citizen has\t got  to  be<br \/>\nbalanced  with the interest of the society.  In cases  where<br \/>\nnarcotic drugs and psychotropic substances are involved, the<br \/>\naccused\t would indulge in activities which are lethal to the<br \/>\nsociety.   Therefore, it would certainly be in the  interest<br \/>\nof  the society to keep such persons behind bars during\t the<br \/>\npendency  of  the  proceedings\tbefore the  Court,  and\t the<br \/>\nvalidity  of Section 37(1)(b) having been upheld, we  cannot<br \/>\ntake any other view.\n<\/p>\n<p>    However,   attempts\t  should  be   made  by\t the   State<br \/>\nGovernments  of Orissa and West Bengal to see that the trial<br \/>\nin  the cases pending before them are facilitated by  making<br \/>\nappropriate  arrangement to have all the accused persons  in<br \/>\none place for purposes of trial and details should be worked<br \/>\nout  and  shall be examined by the High Court of Orissa\t and<br \/>\nthe  High  Court of Calcutta on the administrative side\t and<br \/>\nappropriate  directions\t be given in that regard  to  enable<br \/>\nexpeditious  disposal  of  the case.  In this case,  it\t is,<br \/>\ntherefore, not proper for us to enter upon the merits of the<br \/>\ncase so far as the splitting of the charges are concerned or<br \/>\nrefusal\t of  the IIIrd Additional District Judge, Howrah  in<br \/>\nnot  releasing the main accused to enable the trial to go on<br \/>\nat  Balasore.\tCopies\tof this order shall be sent  to\t the<br \/>\nChief  Secretary  to  the Government of West  Bengal,  Chief<br \/>\nSecretary to the Government of Orissa, Registrar of the High<br \/>\nCourt  of Calcutta and Registrar of the High Court of Orissa<br \/>\nfor compliance with directions.\n<\/p>\n<p>    Subject  to\t the observations made above, this  petition<br \/>\nstands dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Babua @ Tazmul Hossain vs The State Of Orissa on 30 January, 2001 Author: R Babu Bench: S.
