JHARKHANDI UPADHYAY, A.P.P.\n<\/p>\n<p>                               **********<\/p>\n<p>2    24\/06\/2011            Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                  appearing on behalf of the State.\n<\/p>\n<p>                           This application has been filed challenging the<\/p>\n<p>                  order dated 23.05.2008 passed in Hathauri Police Station<\/p>\n<p>                  Case No. 116 of 2007 (Trial no. 2810 of 2008) by which<\/p>\n<p>                  the Chief Judicial Magistrate, Muzaffarpur has taken<\/p>\n<p>                  cognizance    for   the   offences   alleged   to   have   been<\/p>\n<p>                  committed under Section 302 and 201 of the Indian<\/p>\n<p>                  Penal Code.\n<\/p>\n<p>                           Learned Counsel for the petitioner pointed out<\/p>\n<p>                  that the petitioner who is the mother-in-law of the<\/p>\n<p>                  deceased lady had instituted a U.D. Case when she found<\/p>\n<p>                  that her daughter-in-law was burnt to death. It is said<\/p>\n<p>                  that this petitioner had gone to attend a wedding<\/p>\n<p>                  ceremony in the neighbourhood when the occurrence is<\/p>\n<p>                  said to have taken place. Later on, post mortem was<\/p>\n<p>                  conducted, which indicates that the lady had died due to<\/p>\n<p>                  strangulation. 4 years after the preparation of the post<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>mortem report, the case was instituted under Section 302<\/p>\n<p>of the Indian Penal Code against the petitioner and all the<\/p>\n<p>other   in-laws   of   the   deceased      lady   including   the<\/p>\n<p>husband. It is submitted that during investigation, it<\/p>\n<p>transpired that the other family members of the deceased<\/p>\n<p>lady including her husband lived at Delhi and as such,<\/p>\n<p>the case under Section 302 of the Indian Penal Code was<\/p>\n<p>found to be &#8216;not true&#8217; against them. The petitioner was<\/p>\n<p>the only person who was accused in this case.<\/p>\n<p>          Counsel for the petitioner submits that on<\/p>\n<p>perusal of the case diary, there is no material to indicate<\/p>\n<p>that the petitioner was present when the occurrence is<\/p>\n<p>said to have occurred. It has been reported that she was<\/p>\n<p>away from her house and was attending a marriage<\/p>\n<p>ceremony in the neighbourhood. It is also submitted that<\/p>\n<p>the mother and other family members of the deceased<\/p>\n<p>lady had filed no complaint against the mother-in-law,<\/p>\n<p>which indicates that they did not raise any suspicion<\/p>\n<p>regarding the manner of death of the deceased lady. In<\/p>\n<p>these circumstances, Counsel for the petitioner submits<\/p>\n<p>that there are insufficient materials against the petitioner<\/p>\n<p>to send her up for the trial.\n<\/p>\n<p>          These    aspects      of   the   matter    should   be<\/p>\n<p>considered by the Court below who will pass a reasoned<\/p>\n<p>order discussing all the circumstances surrounding the<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>        occurrence and the materials in the case diary which<\/p>\n<p>        would indicate the involvement of this petitioner in the<\/p>\n<p>        alleged crime.\n<\/p>\n<p>                  This application is disposed of with liberty to<\/p>\n<p>        the petitioner to raise these issues at the time of framing<\/p>\n<p>        of the charges, if not already framed.\n<\/p>\n<\/p>\n<pre>Anand                                        ( Sheema Ali Khan, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Malti Devi vs State Of Bihar on 24 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
