JUSTICE AJAI LAMBA.\n<\/p>\n<p>\nPresent:- Mr. Ajay Pal Singh,Advocate for the petitioner.<\/p>\n<p>AJAI LAMBA, J<\/p>\n<p>             Learned counsel for the petitioner states that after<\/p>\n<p>completion of training by the petitioner, the petitioner was<\/p>\n<p>admitted in Command Hospital (Southern Command) Pune on<\/p>\n<p>27.6.2007.      After medical examination, the petitioner was<\/p>\n<p>discharged on 16.10.2007.       The petitioner claimed disability<\/p>\n<p>pension, which was denied vide order dated 7.2.2008 Annexure P-<\/p>\n<p>2. The reason assigned is that the cause of disability i.e. &#8216;Non-<\/p>\n<p>Organic Psychotic Disorder (F-28)&#8217; was neither attributable to nor<\/p>\n<p>aggravated by Military service. Learned counsel has further<\/p>\n<p>pointed out that in Annexure P-2 itself it has been provided that in<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 3740 of 2009                            -2-<\/span><\/p>\n<p>case the petitioner is not satisfied, he may prefer an appeal.<\/p>\n<p>Learned counsel has drawn the attention of Court towards<\/p>\n<p>Annexure P-3 i.e. an appeal filed by the petitioner.      Learned<\/p>\n<p>counsel states that the appeal has not been decided till date<\/p>\n<p>although the same was filed on 15.7.2008.\n<\/p>\n<p>           Issue notice of motion.\n<\/p>\n<p>           Ms. Anjali Kukkar, Advocate, accepts notice on behalf<\/p>\n<p>of respondents, on the asking of Court.\n<\/p>\n<p>           Considering the above, the respondents are directed to<\/p>\n<p>deal with the appeal and take decision thereon within 4 months<\/p>\n<p>from the receipt of certified copy of the order.<\/p>\n<p>           Disposed of in the above terms.<\/p>\n<pre>\n\n\n9th March, 2009.
