The petitioner is the father-in-<\/p>\n<p>law of the defacto complainant.   The defacto complainant had raised<\/p>\n<p>allegations   against   her   husband   and   relatives   in   a   complaint   filed<\/p>\n<p>before   the   police.     Crime   has   been   registered   under   Sections   498A<\/p>\n<p>and   354   read   with   34   I.P.C.     Investigation   is   in   progress.     The<\/p>\n<p>petitioner, the second accused, apprehends arrest at any moment.<\/p>\n<p>       2.     The   allegations   raised   against   the   father-in-law   &#8211;   the<\/p>\n<p>petitioner herein, are indeed vague.  If true, the allegation show great<\/p>\n<p>depravity   of   the   mind.     However,   the   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   a   court   may   not   lightly   swallow   all   the<\/p>\n<p>allegations raised by a strained wife who is too keen to invent reasons<\/p>\n<p>to   justify   her   separate   residence   from   her   husband   and   matrimonial<\/p>\n<p>home.     At   any   rate,   the   allegations   raised   are   such   which   can   be<\/p>\n<p>raised  by   anyone  with  vexatious  intent.     The  learned  counsel  for  the<\/p>\n<p>petitioner further submits that, at any rate, it is not necessary at all to<\/p>\n<p>insist   on   arrest   and   incarceration   of   the   petitioner   for   a   proper<\/p>\n<p>investigation   of   the   crime,   considering   the   nature   of   the   allegations<\/p>\n<p>raised.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3928\/07                                 2<\/span><\/p>\n<p>       3.      The   learned   Public   Prosecutor   opposes   the   application.<\/p>\n<p>The   learned   Public   Prosecutor   reiterates   that   the   allegations   are<\/p>\n<p>grave and a serious view is liable to be taken against such allegations.<\/p>\n<p>       4.      Having   rendered   my   anxious   consideration   to   all   the<\/p>\n<p>relevant   inputs,   I   am   certainly   of   the   opinion   that   this   is   a   fit   case<\/p>\n<p>where directions under Section 438 Cr.P.C can be issued in favour of<\/p>\n<p>the   petitioner.     In   coming   to   this   conclusion,   I   take   note   of   the<\/p>\n<p>strained   relationship   of   the   spouses   and   the   fact   that   the   defacto<\/p>\n<p>complainant   is   certainly   in   need   of   an   explanation   for   her   refusal   to<\/p>\n<p>stay   at   the   matrimonial   home.     I   also   take   note   of   the   relevant<\/p>\n<p>submission made by the learned counsel for the  petitioner that  for a<\/p>\n<p>proper investigation into the allegations, considering the nature of the<\/p>\n<p>allegations, arrest and incarceration of the petitioner is not necessary.<\/p>\n<p>       5.      In the result, this petition is allowed.  Following directions<\/p>\n<p>are issued under Section 438 Cr.P.C:\n<\/p>\n<\/p>\n<p>       i)      Petitioner   shall   surrender   before   the   learned   Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 07\/07\/2007.\n<\/p>\n<\/p>\n<p>       ii)     He  shall   be  released  on  regular   bail  on  condition that  he<\/p>\n<p>executes   bond   for   Rs.50,000\/-(Rupees   fifty   thousand   only)   with   two<\/p>\n<p>solvent sureties each for the like sum to the satisfaction of the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3928\/07                              3<\/span><\/p>\n<p>       iii)    The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation  before  the investigating   officer    between  10  a.m  and   4<\/p>\n<p>p.m   on   08\/07\/2007,   09\/07\/2007   and   10\/07\/07   and   thereafter   on   all<\/p>\n<p>Mondays   and   Fridays   between   10   a.m   and   12   noon   for   a   period   of<\/p>\n<p>three   months   and   thereafter   as   and   when   directed   by   the<\/p>\n<p>investigating officer  in writing to do so.\n<\/p>\n<\/p>\n<p>       (iv)    If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above   shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to   arrest<\/p>\n<p>the petitioner and deal with them in accordance with law, as if these<\/p>\n<p>directions were not issued at all.\n<\/p>\n<\/p>\n<p>       (v)     If   he   was   arrested   prior   to   07\/07\/2007,   he   shall   be<\/p>\n<p>released on bail on his executing a bond for Rs.50,000\/- (Rupees fifty<\/p>\n<p>thousand only) without any sureties, undertaking to appear before the<\/p>\n<p>learned Magistrate on 07\/07\/2007.<\/p>\n<pre>\n\n\n\n\n\n                                                              (R.BASANT, JUDGE)\n\njsr\n\n\n                                     \/\/ True Copy\/\/          PA to Judge\n\n\n<span class=\"hidden_text\">B.A.No.3928\/07    4<\/span>\n\n\n<span class=\"hidden_text\">B.A.No.3928\/07    5<\/span>\n\n\n       R.BASANT, J.\n\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n\n            ORDER\n\n\n\n\n\n21ST DAY OF MAY2007\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saidalvi vs Sub Inspector Of Police on 29 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3928 of 2007() 1.
