3. The brief facts of the case are zw<\/p>\n
Claimant No.1 is the wife, claimants 2, 3 and 4\u00bb are<\/p>\n

the minor children % claimants 5 and 6 are the<\/p>\n

parents of the deceased. They filed claim petition under
\nSection 166 of the M.V. Act claiming compensation on<\/p>\n
account of the death of late Sri.K.Ashok contending<\/p>\n
that, on 9.2.2003 at about 3.30 p.m. when  _<\/p>\n
was proceeding from Murudeshwara towa’1’*dvs ‘:Banga1orel ‘\u00bb it<\/p>\n
on NH. 17 in a Maruthi omni car’\u00bb.bearing <\/p>\n
MB 1233, due to the rash”aI:d_ negligent drivir1g,, vofl the <\/p>\n
said car by its driver,  ‘Nlaravanthgvl? village,
\nKundapura Taluk, it  on coming lorry<\/p>\n
bearing Reg.No._KA–2O588’3 the said impact,<\/p>\n
the d,_ecease’cl7.”–sustained’ -grievous injuries and<\/p>\n
succumbed’ to the the spot. It is the further<\/p>\n
 case5;oil”v the claiinan_ts.that the deceased was aged about<\/p>\n
 ‘3Iear,s,’~a’.contractor taking contract works from BSNL<\/p>\n
andothlerl-‘V-Celntral Govt. organizations, getting income of<\/p>\n
more t;han.%4,00,000\/- p.a. after paying income tax and<\/p>\n
A [fspending towards other incidental expenses. He was the<\/p>\n
 sole bread winner in the family. Due to his untimely<\/p>\n
 death, the claimants have suffered socially and<\/p>\n
economically severely. The first claimant, being the<\/p>\n
wife, has lost her h  at the young age. claimants<\/p>\n

for having made investments from out of his total<\/p>\n
income. Further, the Tribunal has also not aVVaI'(i.\u20acVtj_:jL1_VSt<\/p>\n
and reasonable compensation towards the  _<\/p>\n
heads and therefore, he submits that  V <\/p>\n
award is liable to be modified 3 <\/p>\n
compensation.\n<\/p>\n

  judgment and award of the Tribunal, the point that<\/p>\n
l  -arise for our consideration in this appeal is,<\/p>\n
“Whether the quantum of Compensation awarded<\/p>\n
by the Tribunal is just and reasonable?”<\/p>\n
8. The occurrence of the accident and the<\/p>\n
resultant death of the deceased are not in <\/p>\n
Further, the age and occupation of the  .<\/p>\n

\nkumar, 'Who has  this aspect. However, the<\/p>\n
Tribunal has erred' in"-deducting $60,000\/–, which is the<\/p>\n

investm.er1ts,lfafrom out of the average income of<\/p>\n
  and thereby arrived at the income of<\/p>\n
 p.a. and further deducted one-third<\/p>\n
 alolwards his personal expenses and adopted the<\/p>\n
multiplier of 13 and calculated the compensation<\/p>\n
 towards loss of dependency at ?26,00.000\/–_. which is<\/p>\n
