S.J. MUKHOPADHAYA)<\/p>\n<p>\tAppellant-Shree<br \/>\nMaroli Vibhag Khand Udyog Sahakari Mandali Limited [hereinafter<br \/>\nreferred to as,  the Cooperative Society ] which<br \/>\nproduces and sell sugar in the open market, filed a writ<br \/>\npetition, which was admitted on 27th April 2010. An ad<br \/>\ninterim order was passed permitting the appellant-Cooperative<br \/>\nSociety to sell sugar in the open market on certain conditions. The<br \/>\ncase was later on taken up for confirmation\/vacating the said ad<br \/>\ninterim order. The learned Single Judge, after hearing the<br \/>\nparties and considering the fact that the other sugar producing<br \/>\ncooperative societies outside the State are subjected to the same<br \/>\nrestrictions; as also, except the writ petitioner, even other<br \/>\ncooperative societies in the State are also subjected to the similar<br \/>\nrestrictions, in that view of the matter, as all other cooperative<br \/>\nsocieties   whether outside the State or within the State are<br \/>\ntreated at par, to ensure that no exception is made, the<br \/>\nlearned Single Judge vacated the interim relief.  We are not<br \/>\ninclined to interfere with the Order dated 20th December<br \/>\n2010, whereby, the learned Single Judge vacated the ad interim<br \/>\n relief, earlier granted. Appeal and Civil Application stand disposed<br \/>\nof.
