Justice J.B.KOSHY\n\n Dated :30\/07\/2007\n\n O R D E R\n                        J.B.KOSHY, J.\n                  -------------------------\n                   Crl.R.P.No.1055 OF 2000\n                  -------------------------\n                    Dated 30th July, 2007\n\n                            ORDER\n<\/pre>\n<p>         This revision petition is filed by the accused who<\/p>\n<p>was convicted and sentenced under Section 324 of the Indian<\/p>\n<p>Penal Code.  The accused and PW1 were friends.  On March 22,<\/p>\n<p>1995 at about 7.15 p.m. the accused came to the house of PW1<\/p>\n<p>and called him out.  When they reached near the  house of one<\/p>\n<p>George, the accused took out a knife from his hip and stabbed<\/p>\n<p>PW1 on his stomach causing grievous injury.   Hearing the cry<\/p>\n<p>of  PW1, when PW2, PW3 and others came there, the accused ran<\/p>\n<p>away.  PW1 told PW2 that he was stabbed by the accused and he<\/p>\n<p>fell into the hands of PW2.     PW2 took PW1 to the Medical<\/p>\n<p>Trust Hospital, Ernakulam.   The weapon used for committing<\/p>\n<p>the offence was found out on the basis of recovery under<\/p>\n<p>Section 27 of the Evidence Act.   PW9, the doctor who issued<\/p>\n<p>Ext.P7 wound certificate deposed that there was incised wound<\/p>\n<p>over right side of the abdomen.  The Magistrate found that it<\/p>\n<p>was not a grievous injury.    Therefore, even though he was<\/p>\n<p>charge sheeted for an offence    committed under Section 326<\/p>\n<p>IPC, he has committed only an offence under Section 324 IPC.<\/p>\n<p>PW7 Investigating Officer also has filed a report altering<\/p>\n<p>the charges to Section 324 IPC.  The petitioner was convicted<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.1055\/2000               2<\/span><\/p>\n<p>and sentenced to undergo rigorous imprisonment for one year<\/p>\n<p>for the offence under Section 324 IPC.      The Sessions Court<\/p>\n<p>confirmed the conviction and sentence.        On going through<\/p>\n<p>the evidence,      I  see  no  ground  to  interfere  with the<\/p>\n<p>conviction passed on the revision petitioner.      Evidence of<\/p>\n<p>injured witness was corroborated by other oral evidence as<\/p>\n<p>well as recovery of the knife.     There is no reason to alter<\/p>\n<p>the conviction in a revision petition.         It is submitted<\/p>\n<p>that the incident occurred in 1995.     The accused as well as<\/p>\n<p>the injured were very young at that time and classmates.<\/p>\n<p>Taking into account these aspects, I alter the sentence of<\/p>\n<p>rigorous imprisonment for one year to a fine of Rs.10,000\/=<\/p>\n<p>with a default sentence of simple imprisonment for three<\/p>\n<p>months.
