               This order will dispose of a bunch of 426 cases. R.F.A. Nos. 1990,
\n2131, 2174 to 2181, 2193 to 2200, 2283 to 2289, 2292 to 2302, 2325, 2750 to
\n2761, 3163 to 3192, 3286, 3287, 3461, 3464, 3465, 3466, 3965, 3966 of 2002,
\n2060 to 2094, 2225, 2674, 2675, 2676, 3123 to 3153, 3155, 3213 to 3216, 3230 to
\n3239, 3251 to 3253, 3255, 3256, 3312, 3313, 3391, 3392, 3418, 3564, 3567, 3811,
\n4342, 4344, 4441, 4488, 4514 of 2003, 55, 203, 212, 213, 408, 2301 to 2308 of
\n2004     have been filed by the land owners for enhancement of compensation,
\nwhereas R.F.A. Nos. 3651, 3653 to 3742, 3744 to 3769 of 2002, 1780 to 1832,
\n3031, 3033 and 3034 to 3084 of 2003 have been filed by the State challenging the
\naward of the learned Court below with the prayer that the compensation awarded
\nby the learned Court below deserves to be reduced.\n<\/p>\n
               The facts in the present case have been noticed from R.F.A. No.
\n2179 of 2002.\n<\/p>\n
               Briefly, the facts are that acquisition in the present case is land
\npertaining to over four villages, namely, Lehra Saundha, Lehra Mohabbat, Lehra
\nDhulkot and Patti Karam. The acquisition is for the purpose of setting up of Guru
\nNanak Thermal Plant Stage III, Bhatinda.\n<\/p>\n
               As far as land pertaining to village Lehra Saundha is concerned,
\nnotification under Section 4 of the Land Acquisition Act, 1894 (for short, `the
\nAct’) was issued on 23.7.1992 for acquisition of 3865 kanals 14 marlas of land.
\nThe same was followed by notification dated 28.1.1993 issued under Section 6 of
\nthe Act. The award was given by the Land Acquisition Collector (for short, `the
\nCollector’) on 19.11.1994 determining the value of the land as under:\n<\/p>\n
       (i)     Nehri              Rs. 48,015\/- per acre<\/p>\n
       (ii)    Chahi              Rs. 60,645\/- per acre\n<\/p><\/blockquote>\n
       (iii)   Barani             Rs. 24,352\/- per acre\n<\/p><\/blockquote>\n
       (iv)    Gair mumkin        Rs. 95,070\/- per acre
\n       The learned Court below, on reference under Section 18 of the Act, vide
\n R.F.A. No. 2292 of 2002                                    [ 47]<\/p>\n
award dated 18.1.2002, determined the value of the land as under:\n<\/p><\/blockquote>\n
       (i)     Nehri              Rs. 70,000\/- per acre\n<\/p><\/blockquote>\n
       (ii)    Chahi              Rs. 80,000\/- per acre\n<\/p><\/blockquote>\n
       (iii)   Barani             Rs. 40,000\/- per acre\n<\/p><\/blockquote>\n
       (iv)    Gair mumkin        Rs.1,10,000\/- per acre
\n               As far as land pertaining to Lehra Mohabbat is concerned,
\nnotification under Section 4 of the Act was issued on 16.7.1992 for acquisition of
\nland measuring       1704 kanals. The same was followed by notification dated
\n28.1.1993 issued under Section 6 of the Act.       The award was given by the
\nCollector on 22.8.1995 determining the value of the land as under:<\/p><\/blockquote>\n
       (i)     Nehri              Rs. 45,282\/- per acre\n<\/p><\/blockquote>\n
       (ii)    Chahi              Rs. 52,621\/- per acre\n<\/p><\/blockquote>\n
       (iii)   Barani             Rs. 33,835\/- per acre\n<\/p><\/blockquote>\n
       (iv)    Gair mumkin        Rs. 67,538\/- per acre
\n       The learned Court below, on reference under Section 18 of the Act, vide
\naward dated 21.11.2002, determined the value of the land as under:\n<\/p><\/blockquote>\n
       (i)     Nehri              Rs. 85,000\/- per acre\n<\/p><\/blockquote>\n
       (ii)    Chahi              Rs. 95,000\/- per acre\n<\/p><\/blockquote>\n
       (iii)   Barani             Rs. 65,000\/- per acre\n<\/p><\/blockquote>\n
       (iv)    Gair mumkin        Rs.1,10,000\/- per acre
\n               Regarding land pertaining to village Lehra Dhulkot, notification
\nunder Section 4 of the Act was issued on 16.7.1992 for acquisition of land
\nmeasuring 605 kanals 16 marlas. The same was followed by notification dated
\n28.1.1993 issued under Section 6 of the Act.       The award was given by the
\nCollector on 22.9.1994 determining the value of the land as under:<\/p><\/blockquote>\n
       (i)     Nehri              Rs. 50,504\/- per acre\n<\/p><\/blockquote>\n
       (ii)    Chahi              Rs. 50,504\/- per acre\n<\/p><\/blockquote>\n
       (iii)   Barani             Rs. 20,000\/- per acre\n<\/p><\/blockquote>\n
       (iv)    Gair mumkin        Rs. 40,000\/- per acre
\n       The learned Court below, on reference under Section 18 of the Act, vide
\naward dated 28.2.2002, determined the value of the land as under:\n<\/p><\/blockquote>\n
       (i)     Nehri              Rs. 70,000\/- per acre\n<\/p><\/blockquote>\n
       (ii)    Chahi              Rs. 80,000\/- per acre\n<\/p><\/blockquote>\n

\n               As far as land pertaining to village Patti Karam is concerned,
\nnotification under Section 4 of the Act was issued on 4.8.1992 for acquisition of

                       With regard to the evidence pertaining to village Lehra Dhulkot, the
\nlearned court below relied on the award pertaining to village Lehra Mohabbat.<\/p><\/blockquote>\n
                       It is not disputed that there is no site plan on record showing the
\n R.F.A. No. 2292 of 2002                                   [ 52]<\/p>\n
location of the land forming part of the above referred sale deeds, either referred to
\nby the land owners or by the State.\n<\/p>\n
               Learned counsel appearing for the land owners submitted that
\nacquisition of land in the present case, forming part of revenue estates of four
\nvillages is for the same purpose, namely, for Stage III of Guru Nanak Dev Thermal
\nPlant, Bhatinda. It is a fact that for the acquisition of land for the same purpose
\npertaining to village Patti Karam notified almost at the same time, even the learned
\ncourt below awarded much more compensation as compared to the compensation
\nawarded in the present case. The location of the acquired land is quite strategic.
\nThe same is situated quite close to Mandi Rampura Phul, which is 6-7 kilometers
\nfrom the acquired land. The acquired land abuts the main Bhatinda-Barnala
\nHighway. The Collector as well as the learned court below had gone wrong in not
\ngranting special treatment to the land even abutting the main Highway which
\ncertainly will have additional value as compared to the land situated off the main
\nroad. Reference has been made to various sale deeds produced on record pertaining
\nto the same village, where different areas of land had been sold for different value.\n<\/p>\n
               Referring to the material on record, learned senior counsel appearing
\nfor the land owners submitted that the primary evidence which is required to be
\nconsidered for fair determination of the value of the acquired land in the present
\ncase is Ex. A.6, a sale transaction entered into on 3.6.92 before the issuance of
\nnotification under Section 4 of the Act in the present case on 23.7.92. The land in
\nquestion in the sale deed forms part of the acquired land. In fact, this is the best
\npiece of evidence for the purpose of determination of fair value of the acquired
\nland. Reference has been made to The Dollar Company, Madras v. Collector of
\nMadras, AIR<\/a> 1975 SC 1670.          Further reference has been made to award (Ex.
\nA.36) determining the value of the acquired land for construction of a canal in
\nMehraj Patti Karam Chand. The notification thereof was issued on 8.4.1988 and
\nthe value was determined at Rs. 1,26,000\/- per acre. Referring to award (Ex. A.37)
\nwhere the acquisition was for construction of bye-pass at Rampura Phul, the
\nsubmission is that for the notification issued on 25.9.87, the value was determined
\nat Rs. 1,35,000\/- per acre and in the present case, these two instances have totally
\nbeen ignored. The land owners in the present case could very well be given 10 to
\n12% annual increase over and above the value determined for acquisition carried
\nout vide above referred two notifications. He further submitted that the learned
\nCourt below had gone wrong in rejecting the sale deeds registered more than one
\nyear before the date of acquisition as the same is not in conformity with law. There
\nis no provision as such under the Act which debars consideration of a sale deed

more than one year prior to the date of acquisition. Reference has been made to
\nJaswant Singh and others v. The State of Punjab and another, 1989 LACC 200.\n<\/p>\n
               Referring to judgment (Ex. A.38) passed by this Court in L.P.A. No.
\n1251 of 1987 with regard to the acquisition of a large chunk of land for Bhatinda
\nCantonment vide notification dated 10.5.1979, it was submitted that the fair value
\nof the land therein was assessed at the rate of Rs. 90,000\/- per acre up to 500
\nmeters from the Highway and Rs. 50,000\/- per acre behind that by a Division
\nBench of this Court which was affirmed by Hon’ble the Supreme Court in Union
\nof India and another v. Zora Singh and others, (1992) 1 SCC 673. Even on this
\nvaluation, annual increase can be considered for determining the fair value of the
\nacquired land. Finally, it is submitted that as has been done by this Court in
\nacquisition for Bhatinda Cantonment and as upheld by Hon’ble the Supreme Court,
\nthe entire land acquired for Stage III Guru Nanak Dev Thermal Plant should be
\nvalued at the same rate. However, the land abutting the main Highway should be
\ngiven some extra advantage.\n<\/p>\n
                Additional Arguments
\n               R.F.A. No. 3164 of 2002
\n               Learned counsel for the appellant referred to paragraphs 24, 60 and
\n62 of the award of the learned Court below to submit that the evidence regarding
\nsuper structure in the present case was led in the case of the appellant-Jangir Singh,
\nwhereas at the time of awarding claim, the name of Jagsir Singh was mentioned. In
\nfact, the appellant is entitled to compensation for acquisition of super structure and
\nnot Jagsir Singh as directed by the Court below. He further submitted that in the
\ncase of the appellant, he had led evidence in the form of Ex. A.13 to claim
\ncompensation of Rs. 34,414\/- on account of acquisition of super structure in the
\nform of well, kotha, tank and mechanical material for the tubewell. However, a
\nsum of Rs. 10,000\/- was awarded.\n<\/p>\n
               In response to the arguments, learned counsel for the respondents
\nfairly stated that in case there is an error, the same can be corrected and the State
\ndoes not have any objection for payment of compensation to the right person.\n<\/p>\n
               R.F.A. No. 3177 of 2002
\n               The claim in the present case, in addition to the cost of well, kotha
\ntank and mechanical material for the tubewell, is for construction of another super
\nstructure in the form of a room and bio-gas plant for which, according to the
\nlearned counsel for the appellant, merely a sum of Rs. 6,000\/- had been awarded.<\/p>\n

               The additional argument in the present appeal is for compensation
\non account of acquisition of house. As per report ( Ex.A.9) on record, the house
\nwas valued at Rs. 1,97,963.15. It is proved on record that the house was situated
\non the acquired land. No evidence was led by the State to rebut the evidence led by
\nthe land owner in this regard. The only dispute sought to be raised by learned
\ncounsel for the appellant is that deduction of 15% as depreciation is to be made on
\nthe value of the super structure as assessed in Ex.A.9, whereas the expert stated
\nthat it should be at the rate of 3%.\n<\/p>\n
               Learned counsel appearing for the State and PSEB submitted that
\nthere is no plan on the record to show the exact location of the plots\/land, the sale
\ndeeds pertaining to which have been relied upon by the land owners. In the
\nabsence thereof, it will not be safe to place reliance thereon. He further submitted
\nthat for the large chunk of land, as has been acquired vide notifications referred to
\nabove, the reliance on the sale deeds for very small plots would not be just and fair.
\nA person purchasing a small plot may pay higher price thereof keeping in view his
\nspecific requirement which may not be there in case large chunk of land dealt
\nwith. There is no site plan on the record to show the location of the plots\/land,
\nmentioned in various sale deeds, may be out of the acquired land or which has not
\nbeen acquired. As the entire land of the villages, as mentioned above, has not been
\nacquired, no reliance should be placed on these sale deeds. He further submitted
\nthat the location of the land in question is far off from the city of Bhatinda which is
\nabout 25 kilometers. The land was not fit for agriculture. This is the primary reason
\nfor acquisition thereof for the purpose of Thermal Plant. These were, in fact, sand
\ndomes. There was no expansion of abadi or industrial activities towards this land
\nas immediately after Bhatinda city on this road up to 7-8 kilometers was the
\nCantonment and with that link with the city was practically cut off. Even if certain
\nactivities or construction have been shown by the land owners, the same were after
\nthe acquisition of the land in question which had, in fact, jacked             up the
\ndevelopment in the area and therefore, the same as such cannot be relied upon for
\nthe purpose of determination of fair value of the land on the date of acquisition.
\nThe land under acquisition is situated 7-8 kilometers away from Bhatinda
\nCantonment towards Rampura Phul. The large chunk of land is off the Highway
\nand it is only a very small portion thereof which abuts the main road. He further
\nsubmitted that reliance on the earlier awards pertaining to the land of village Patti
\nKaram Chand, Rampura Phul bye-pass and Cantonment is totally misplaced
\nkeeping in view their location vis-a-vis the acquired land.\n<\/p>\n
               Heard learned counsel for the parties and perused the relevant
\n R.F.A. No. 2292 of 2002                                   [ 55]<\/p>\n
referred record.\n<\/p>\n
               As is evident from the facts narrated above, the acquisition in the
\npresent case is of a big chunk of land measuring 7929 kanals 6 marlas pertaining
\nto four villages detailed as under:-\n<\/p>\n

               The notifications were issued within the time gap of less than a
\nmonth. The land of different villages is located in contiguity. It is only the land of
\nVillage Lehra Mohabbat which is partly located on the main G. T. Road otherwise
\nother entire chunk of land is located behind that, though there may be some link
\nroads connecting the villages. In my opinion, it would be appropriate to assess the
\nvalue of the entire land by averaging sale price of sale-deeds of land pertaining to
\nall villages as nothing could be pointed out on record to show that there is any
\nsubstantial difference in the value of the land in the four villages. The sale-deeds
\nproduced on record show the value of the land pertaining to four villages is in
\nsimilar range. Otherwise also, for determination of fair value of the acquired land
\nin such type of cases, some times thumb rule is also applied. Earlier also while
\ndetermining the value of acquired land for setting up Cantonment at Bathinda the
\nsame principle was followed in Zora Singh vs Union of India and another 1987
\nLACC 541. In the said case, this Court, where the acquisition for setting up of
\nBhatinda Cantonment had opined that where the acquired land forms one compact
\nblock though falling in the revenue estates of different villages and had been
\nacquired at the same time, it is reasonable to fix the market value of the land at the
\nsame rate. Considering that principle, in my opinion, it would be appropriate to
\nmake assessment of the entire acquired land which is a compact block of four
\nvillages at the same rate.<\/p><\/blockquote>\n
               A perusal of all the four impugned awards shows that the landowners
\nhave produced in evidence various sale-deeds which not only pertained to the land
\nof the concerned village but also of the other villages, such as while leading the
\nevidence in the case pertaining to Village Patti Karam, various sale-deeds
\npertaining to villages Lehra Mohabbat, Lehra Saundha and Lehra Dhulkot had
\nbeen referred to and relied upon in the evidence. As the acquisition in the present
\ncase was at the same time and the land is also situated in contiguity, the relevant
\n R.F.A. No. 2292 of 2002                                               [ 56]<\/p>\n
sale-deeds which are near to the date of acquisition have been taken into
\nconsideration even if they had not been produced in the evidence led pertaining to
\nthe references of that particular village, such as two sale-deeds produced in
\nevidence led for reference pertaining to land of Village Patti Karam, namely, Ex.
\nA-14 and A-15 pertain to Village Lehra Saundha and Lehra Mohabbat have been
\nconsidered. The set of sale-deeds pertaining to different villages as are found to be
\nrelevant are extracted below:-\n<\/p>\n

                 It is also made clear in the aforesaid table of sale deeds as have been
\nconsidered for determination of fair value of the acquired land that for the sale-
\ndeeds which were registered before issuance of notification under Section 4 of the
\nAct, a reasonable increase of 10% per annum has been granted which is depicted
\nin the aforesaid table to bring the value thereof close to the date of notification
\nunder Section 4 of the Act.\n<\/p>\n
 R.F.A. No. 2292 of 2002                                  [ 57]<\/p>\n
               The average price of the aforesaid sale-deeds taking collectively
\ncomes out to Rs. 1,60,000\/- per acre. If a reasonable cut of 30% is applied thereon
\nconsidering the fact that sale-deeds produced are of small pieces of land and the
\nacquisition is for big chunk of land measuring 7929 kanals 6 marlas, the same
\ncomes out to Rs. 96,200\/- per acre. Accordingly, in my considered opinion, the
\naverage value of the acquired land which is of chahi and nehri kinds in nature
\nshould be determined at Rs. 95,000\/- per acre as has been done by the learned
\nReference Court in the cases of land pertaining to village Lehra Mohabbat,
\nwhereas for land pertaining to other villages also, the value is assessed at the same
\nrate. Further, I do not find any good reason even to differentiate in the value of
\nchahi and nehri kind of land as both are irrigated though from different source.\n<\/p>\n
               As far as barani kind of land is concerned, in my opinion, the value
\nas assessed by the learned court below in the cases pertaining to land of Village
\nLehra Mohabbat is quite reasonable as compared to value of chahi and nehri kinds
\nof land assessed. Accordingly, considering the fact that barani kind of land is
\ninferior to chahi kind of land and value thereof is almost 30% less than the value
\nof nehri and chahi land assessed. The same, in my opinion, does not call for any
\ninterference as far as land of village Lehra Mohabbat is concerned. However, for
\nthe land of other three villages also, the same is assessed at Rs. 65,000\/- by
\nincreasing the same from Rs. 40,000\/- per acre for the land pertaining to Villages
\nLehra Saundha and Lehra Dhulkot and by reducing the same from Rs. 90,000\/- per
\nacre for the land pertaining to Village Patti Karam Chand.\n<\/p>\n
               As far as gair mumkin kind of land is concerned, the learned court
\nbelow assessed the value thereof at Rs. 1,10,000\/- per acre for the land pertaining
\nto villages Lehra Mohabbat, Lehra Saundha, and Lehra Dhulkot, whereas the same
\nwas assessed at Rs. 1,50,000\/- per acre for the land pertaining to village Patti
\nKaram. No arguments were addressed by either of the parties with regard to this
\nkind of land. Even otherwise, a perusal of award of Land Acquisition Collector
\npertaining to four villages shows that this quality of land is quite small as
\ncompared to the land acquired. As far as village Patti Karam, the same is merely
\n19 kanals, in village Lehra Sodha it is 99 kanals 8 marlas. It is 17 kanals 18 marlas
\nin village Lehra Dhulkot and in village Lehra Mohabbat it is 37 kanals 16 marlas.
\nAccordingly, I do not find any reason to interfere in the value assessed for gair
\nmumkin kind of land.\n<\/p>\n
               The other sale-deeds produced by the landowners have not been
\nconsidered for the reasons as either they were quite old or were registered after the
\ndate of issuance of notification under Section 4 of the Act.\n<\/p>\n
 R.F.A. No. 2292 of 2002                                    [ 58]<\/p>\n
               As far as award of the learned court below pertaining to the land of
\nVillage Patti Karam Chand is concerned, as the compensation assessed therefor is
\nbeing reduced, special reasons are required. A perusal of the impugned award
\npertaining to this village shows that the reasons recorded by the learned court
\nbelow are quite sketchy and in fact, can be termed as no reason. Merely after
\nreferring to the evidence whether relevant or irrelevant, an estimate of the price of
\nthe land per acre was made. The mutations which cannot be considered for the
\npurpose of determination of fair value of the acquired land were also referred to.
\nThe land pertaining to awards (Ex. A1 and Ex. A2) were not pointed out on any
\nsite plan, as regards their location to consider their comparability vis-a-vis the
\nacquired land. As is evident from award (Ex. A1), the acquisition of land therein
\nwas for a canal minor, the location of which has not been shown vis-a-vis the
\nacquired land and award (Ex. A2), the land pertaining thereto is situated near
\nRampura Phul Town as the acquisition was for construction of bye-pass which is
\nfar off from the acquired land and is situated near Rampura Phul Town. Such an
\naward could not possibly be relied upon for the purpose of determination of fair
\nvalue of the acquired land.\n<\/p>\n
R. F. A. No. 3164 of 2002
\n               In the set of references pertaining to Village Lehra Saundha,
\nadditional argument is sought to be raised with regard to the fact that as against the
\nname of original landowner Jangsir Singh son of Sher Singh in para 62 and 65 of
\nthe impugned award, it has been mentioned as Jagsir Singh son of Pritam Singh. A
\nperusal of document Ex. A-13 as is referred to in para 24 of the impugned award,
\nland pertaining to Jangir Singh. However, a perusal of the memo of parties in the
\nimpugned award shows that there is landowner in the name of Jagsir Singh son of
\nPritam Singh as well on whose behalf references no. 10 and 11 of 12.2.1996 had
\nbeen filed. In these circumstances, it will not be proper for this court to record final
\nopinion as to whether the name as is suggested is incorrectly mentioned. However,
\nthe landowner-appellant in R. F. A. No. 3164 of 2002 is given liberty to move
\nappropriate application before the learned Reference Court seeking correction of
\nerror as suggested.\n<\/p>\n
R. F. A. No. 3287 of 2002.\n<\/p>\n
               In R. F. A. No. 3287 of 2002 pertaining to the land of Village Lehra
\nDhulkot, reference was made to document Ex. AW14\/1 showing the survey with
\nregard to the trees standing on the acquired land. Learned counsel for the
\nappellants therein had submitted that the value as even depicted in the survey
\nreport and the assessment made therein has not been given to the landowners. It
\n R.F.A. No. 2292 of 2002                                   [ 59]<\/p>\n
has not come on record as to on whose instructions and under whose authority the
\nsurvey was conducted . As against this, a perusal of the award of the Collector
\nshows that estimation of fruit bearing trees and the other trees had been made on
\nthe survey conducted by the Horticulture Department, Bathinda. The landowners
\nhave not been able to point out any defect in that report. Accordingly, I do not find
\nany reason to interferer in the award pertaining to fruit bearing and other trees.\n<\/p>\n
               As far as compensation assessed by the learned court below on
\naccount of acquisition of tube-wells\/ superstructure on the acquired land is
\nconcerned, it is always that some rough estimate is made by applying a thumb
\nrule. The assessment in such cases cannot be made with mathematical precision.
\nThe fact cannot be lost sight of that the land owners make exhorbitant claims
\nwhereas the State estimates the value thereof at its lowest price. Accordingly, in
\nmy opinion, it would be appropriate to grant increase of 25% on the value as
\nassessed by the Collector for tubewell and superstructure. In case the value as
\nassessed by the learned reference court is less than that, the land owners shall be
\nentitled to the difference thereof. It is, however, made clear that in case where the
\nvalue as assessed by the learned court below is more than 25% of the value as
\nassessed by the Collector, keeping in view the peculiar facts of that case, the same
\nis not interfered with and is upheld.\n<\/p>\n
               As far as additional argument in R.F.A. No. 3177 of 2002 is
\nconcerned, as is evident from the impugned award, regarding the claim for a room
\nand bio-gas plant, even the claimant himself had not appeared before the Court to
\nprove the report (Ex. A.10) to show that the same were existing on the acquired
\nland. Even in the report, location thereof with reference to khasra number is not
\nmentioned. It was on that account that the claim was not accepted.\n<\/p>\n
               For the reasons mentioned above, the value of chahi and nehri kinds
\nof acquired land is assessed at the uniform rate of Rs. 95,000\/- per acre. The value
\nof barani kind of land is assessed at Rs. 65,000\/- per acre. As far as gair mumkin
\nkind of land is concerned, the award of the learned Reference Court is upheld.\n<\/p>\n
               The land owners shall also be entitled to all statutory benefits
\navailable under the Act.\n<\/p>\n
               In R.F.A. No. 3164 of 2002, the land owner is given liberty to move
\nappropriate application before the learned court below seeking correction of error.\n<\/p>\n
               As regards claim for enhancement of value of super structure and
\ntubewell etc. is concerned, the land owners are awarded 25% increase on the value
\nas assessed by the Collector. In case less amount has been granted, the land
\nowners shall be entitled to the difference therein. In case, it is more than 25%, the
\n R.F.A. No. 2292 of 2002                                  [ 60]<\/p>\n
same is upheld.\n<\/p>\n
               The appeals are disposed of in the manner indicated above.\n<\/p>\n
