Following question has been raised<br \/>\nfor our consideration :-\n<\/p>\n<p>&#8220;Whether<br \/>\nin the facts and circumstances of the case, the Tribunal has<br \/>\ncommitted substantial error of law in holding that the appeal of the<br \/>\nrevenue cannot be entertained in absence of liberty reserved by the<br \/>\nTribunal in its earlier order dated 04.06.2010 passed in Appeal no.<br \/>\nST\/391, 394, 403 &amp; 404\/2009, decided between the same parties,<br \/>\nagainst the said order in appeal and dismissed on the ground of<br \/>\nprocedural irregularity committed by the revenue in filing appeal<br \/>\nunder wrong format ?&#8221;\n<\/p>\n<p>\t Brief facts are<br \/>\nthat previously, the Department had file appeal before the Tribunal<br \/>\nagainst the present respondent-manufacturer calling in question the<br \/>\ndecision of the Commissioner [Appeals] dated 27th July<br \/>\n2009. Such appeal came to be dismissed by the Tribunal on the ground<br \/>\nthat the appeal was not properly instituted inas much as the<br \/>\ncommittee authorizing filing of the appeal had not taken decision to<br \/>\nfile the appeal and further that the appeal was not filed in a proper<br \/>\nformat.\n<\/p>\n<p>\tThe said decision<br \/>\nof the Tribunal came to be challenged before us in Tax Appeal No.<br \/>\n2598 of 2010. In some other appeals, under similar circumstances, we<br \/>\nhad remanded the proceedings to the Tribunal finding that the<br \/>\nTribunal ought not to have dismissed the appeals on technical ground<br \/>\nand allowed the Department to pursue the issue on merits. However, in<br \/>\nthe present case, we find that the issue on merits itself was covered<br \/>\nagainst the Department. We, therefore, found no reason to keep the<br \/>\nissue live and only for cosmetic purpose, remanded the proceedings<br \/>\nbefore the Tribunal only on this ground on 18th August<br \/>\n2011.\n<\/p>\n<p>\tIt appears that<br \/>\nsince the first appeal filed by the Department failed on technical<br \/>\ngrounds, the Department preferred fresh appeal against the same<br \/>\nrespondent on the same ground, challenging the same order of the<br \/>\nCommissioner. In this Appeal, the Tribunal by its impugned<br \/>\norder dated 1st October 2010, dismissed the appeal on the<br \/>\nground that once the Tribunal has dismissed the previous appeal,<br \/>\nwithout giving liberty to file fresh appeal, the Revenue cannot<br \/>\nmaintain the appeal on the same set of facts. Though, we have prima<br \/>\nfacie some doubt about this view of the Tribunal, since the issue<br \/>\non merits itself has been held against the Department, in some other<br \/>\ncases, we see no reason to entertain this Appeal.
