GIRI, J.\n-----------------------------------------------\n      Criminal Appeal No. 1884 OF 2007 (A)\n-----------------------------------------------\n     Dated this the 28th day of August, 2008\n\n                  J U D G M E N T\n<\/pre>\n<p>         The complainant in C.C.316\/2004 on the files<\/p>\n<p>of  the  Additional Chief   Judicial Magistrate   Court<\/p>\n<p>(Economic Offences), Ernakulam is the appellant herein.<\/p>\n<p>The calender case arises on account of the complaint<\/p>\n<p>alleging that the accused issued a cheque for an amount<\/p>\n<p>of Rs.3,91,200\/-. But the cheque was dishonoured for<\/p>\n<p>want of sufficient funds on presentation. Apparently,<\/p>\n<p>the accused failed to appear in spite of summons and<\/p>\n<p>non-bailable warrant had been issued. When the case was<\/p>\n<p>called on 23-4-2007 the complainant&#8217;s counsel could not<\/p>\n<p>reach the court in time. There was no representation on<\/p>\n<p>behalf of the complainant and the accused was acquitted<\/p>\n<p>under Section 256(1) of Cr.P.C.\n<\/p>\n<\/p>\n<p>2.  I heard the learned counsel for the appellant.<\/p>\n<p>There is no appearance on behalf of the accused.<\/p>\n<p>Crl.Appeal No.1884\/2007\n<\/p>\n<p>                               &#8211; 2 &#8211;\n<\/p>\n<p>\nApparently, it seems to be clear that the complainant<\/p>\n<p>was prosecuting the complaint diligently.<\/p>\n<p>             In the result, the appeal is allowed and order<\/p>\n<p>of acquittal is set aside. The complaint is restored to<\/p>\n<p>file     and      the   court below   shall  proceed   with<\/p>\n<p>C.C.316\/2004, in accordance with law. The complainant<\/p>\n<p>shall appear before the court below on 17-11-2008.<\/p>\n<p>                                           V.
