Justice V.RAMKUMAR\n\n Dated :17\/01\/2011\n\n O R D E R\n                          V.RAMKUMAR, J.\n            -----------------------------------------------------\n                Bail Application No.188 of 2011\n           ------------------------------------------------------\n            Dated this the 17th day of January, 2011\n\n                                 ORDER\n<\/pre>\n<p>      Petitioner, who is the accused in Crime No.538 of 2010 of<\/p>\n<p>Santhanpara Police Station for offences punishable under<\/p>\n<p>Sections 427, 452, 294(b) &amp; 324 I.P.C., seeks anticipatory bail.<\/p>\n<p>      2.    The    learned      Public      Prosecutor      opposed the<\/p>\n<p>application.\n<\/p>\n<p>      3.    After evaluating the factors and parameters which are<\/p>\n<p>to be taken into consideration in the light of paragraph 122 of<\/p>\n<p>the verdict dated 2-12-2010 of the Apex Court in <a href=\"\/doc\/1108032\/\">Siddharam<\/p>\n<p>Satlingappa Mhetre v. State of Maharashtra and Others<\/a><\/p>\n<p>(2010 (4) KLT 930), I am of the view that anticipatory bail<\/p>\n<p>cannot be granted in a case of this nature, since the<\/p>\n<p>investigating officer has not had the advantage of interrogating<\/p>\n<p>the petitioner. But at the same time, I am inclined to permit the<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for bail<\/p>\n<p>allowed    by the Magistrate or the Court having jurisdiction.<\/p>\n<p>Bail.Appln.No.188\/2011<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>Accordingly,      the  petitioner   shall  surrender    before   the<\/p>\n<p>investigating officer on 28\/01\/2011 or on 29\/01\/2011 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating material,<\/p>\n<p>if any. In case the investigating officer is of the view that having<\/p>\n<p>regard to the facts of the case arrest of the petitioner is<\/p>\n<p>imperative he shall record his reasons for the arrest in the case<\/p>\n<p>diary as insisted in paragraph 129 of Siddharam Satlingappa<\/p>\n<p>Mhetre&#8217;s case (supra). The petitioner shall thereafter be<\/p>\n<p>produced before the Magistrate or the Court concerned and<\/p>\n<p>permitted to file an application for regular bail. In case the<\/p>\n<p>interrogation of the petitioner is     without arresting him, the<\/p>\n<p>petitioner shall thereafter appear before the Magistrate or the<\/p>\n<p>Court concerned and apply for regular bail. The Magistrate or<\/p>\n<p>the Court on being satisfied that the petitioner has been<\/p>\n<p>interrogated by the police shall, after hearing the prosecution as<\/p>\n<p>well, release the petitioner on bail.\n<\/p>\n<p>      4.   In case the accused       while surrendering before the<\/p>\n<p>Investigating Officer has deprived the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>Bail.Appln.No.188\/2011<br \/>\n<span class=\"hidden_text\">                                    -:3:-<\/span><\/p>\n<p>and submit a report to that effect to the Magistrate or the Court<\/p>\n<p>concerned. Likewise, the Magistrate or the Court also will not<\/p>\n<p>be bound by the time limit fixed as above if sufficient time was<\/p>\n<p>not available after the production or appearance of the accused.<\/p>\n<p>      5.     The release of the          petitioner shall be on the<\/p>\n<p>petitioner executing a bond for `15,000\/- (Rupees fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Court concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>      1.     The petitioner shall report before the Investigating<\/p>\n<p>             Officer between 9 a.m. and 11 a.m. on all Wednesdays.<\/p>\n<\/blockquote>\n<blockquote><p>      2.      The petitioner shall make himself available for<\/p>\n<p>             interrogation including custodial interrogation as and<\/p>\n<p>             when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>      3.     The petitioner shall not influence or intimidate the<\/p>\n<p>             prosecution witnesses nor shall he attempt to tamper<\/p>\n<p>             with the evidence for the prosecution.\n<\/p><\/blockquote>\n<p>Bail.Appln.No.188\/2011<br \/>\n<span class=\"hidden_text\">                                   -:4:-<\/span><\/p>\n<p>      4.     The petitioner shall not commit any offence while on<\/p>\n<p>             bail.\n<\/p>\n<\/p>\n<p>       5.
