No. 438 of 2009\n             -------------------------------------------------\n          Dated this the 29th day of January, 2009\n\n                                ORDER\n<\/pre>\n<p>     The petitioner faces indictment in a prosecution for<\/p>\n<p>offences punishable, inter alia, under Sec.353 read with<\/p>\n<p>Sec.149 IPC. The petitioner was granted bail as per the order<\/p>\n<p>of the learned Sessions Judge. The learned Sessions Judge has<\/p>\n<p>imposed a condition that the petitioner must surrender his<\/p>\n<p>passport.     Accordingly, the passport has been surrendered<\/p>\n<p>before the learned Magistrate.         The petitioner now wants the<\/p>\n<p>passport to be released to him to enable him to go abroad.<\/p>\n<p>The petitioner has not moved the learned Sessions Judge.<\/p>\n<p>Instead, it is alleged that he had moved the learned Magistrate.<\/p>\n<p>The learned Magistrate has not passed any orders.              It is with<\/p>\n<p>that grievance the petitioner has come before this Court.<\/p>\n<p>     2. The condition was imposed by the learned Sessions<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 438 of 2009 -: 2 :-<\/span><\/p>\n<p>Judge and in fairness and in the fitness of things, the application<\/p>\n<p>to delete that condition must have been filed before the learned<\/p>\n<p>Sessions Judge.     It is submitted that the post of the Principal<\/p>\n<p>Sessions Judge, Kozhikode, is vacant and it is hence that the<\/p>\n<p>petitioner had to file a petition for release of the passport before<\/p>\n<p>the learned Magistrate first and this petition later before this<\/p>\n<p>Court. It is for the petitioner to file an appropriate application to<\/p>\n<p>delete the condition imposed by the learned Sessions Judge<\/p>\n<p>before the Sessions Court.          Needless to say, whichsoever<\/p>\n<p>Court\/Judge is holding charge of the Principal Sessions Judge<\/p>\n<p>such Judge will have to pass appropriate orders on merits, in<\/p>\n<p>accordance with law and expeditiously on such application.          I<\/p>\n<p>am not satisfied that any other direction need be issued in this<\/p>\n<p>Crl.M.C.\n<\/p>\n<p>      3. This Crl.M.C. is accordingly dismissed with the above<\/p>\n<p>specific observation.\n<\/p>\n<p>      5. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner for production before the Sessions Court when an<\/p>\n<p>application is filed for deletion of the condition.<\/p>\n<p>                                                   Sd\/-<\/p>\n<pre>\n\n                                          (R.
