Father  of PW2 gave some amount, which  resulted<br \/>\ninto  close relationship between two families.\t Thereafter,<br \/>\ndeceased  Naran Puna had gone to Bombay for further  studies<br \/>\nin the year 1974 and stayed with the family of accused No.1.<br \/>\nIt is alleged that accused No.1 was having five to six wives<br \/>\nand  Narmada  was one of them with whom\t deceased  developed<br \/>\nsome  relations;  Hence deceased was thrashed by the accused<br \/>\nand  thereafter at the request of PW2 he was permitted to go<br \/>\nto   Una.   Subsequently,  accused   No.1  (father  of\t the<br \/>\nappellant) and appellant (accused no.2) hatched a conspiracy<br \/>\nat  Bombay that the deceased Naran Puna, younger brother  of<br \/>\nPW2   be  done\tto  death  on  account\tof   misconduct\t  or<br \/>\nmisbehaviour  of deceased with the wife of accused No.1.  In<br \/>\nthe  present  appeal,  we are not required to  consider\t the<br \/>\nevidence  relating  to the said part of the incident as\t the<br \/>\nincident in question had taken place after ten year, on 17th<br \/>\nJuly, 1984 between 3.00 to 4.00 p.m.  on Una &#8211; Veraval road.<br \/>\nIt  is\tthe prosecution version that accused No.2  inflicted<br \/>\nseveral\t knife\tblows on deceased, Naran Puna on account  of<br \/>\nenmity\tand ill-will of accused no.1 with the deceased.\t PW2<br \/>\nBhana  Puna,  brother  of  the deceased on  receipt  of\t the<br \/>\ninformation at about 3.30 p.m.\tthat his brother was done to<br \/>\ndeath  near  the  farm of Jaigurudev, rushed to\t that  place<br \/>\nwhere  he  found several persons among whom PW7 Babu  Govind<br \/>\nand  PW11 Bhagwan Jana were present.  On inquiry, he  learnt<br \/>\nthat  Laxman  Channa  (appellant) had  committed  murder  of<br \/>\ndeceased  Naran.  He thereafter lodged FIR at 5.00 p.m.\t  at<br \/>\nUna  Police  Station.  After completing\t the  investigation,<br \/>\nappellant  was\tcharged\t with the offence  punishable  under<br \/>\nsection\t 302 IPC and original accused no.1 was charged\twith<br \/>\nthe  offence punishable under section 302 read with  section<br \/>\n109  IPC and both of them were also charged with the offence<br \/>\npunishable  under  section  120-B IPC.\t The  learned  Addl.<br \/>\nSessions  Judge after recording the evidence of\t prosecution<br \/>\nwitnesses  and\ton appraisal and assessment thereof came  to<br \/>\nthe conclusion that the prosecution case was not established<br \/>\nbeyond\treasonable doubt, hence he acquitted the accused  by<br \/>\ngiving\tbenefit\t of doubt.  Against that judgment and  order<br \/>\nthe  appeal filed by the State Government was partly allowed<br \/>\nand  appellant was convicted as stated above.  That order is<br \/>\nchallenged in this appeal.\n<\/p>\n<p>      At the time of hearing of this appeal, learned counsel<br \/>\nfor  the  appellant  submitted that Addl.   Sessions  Judge,<br \/>\nJunagadh  has rightly given benefit of doubt to the  accused<br \/>\nas  the\t so-called  eyewitnesses   have\t not  supported\t the<br \/>\nprosecution  version.\tHe has also submitted that the\tHigh<br \/>\nCourt  erroneously  relied  upon the evidence of  PW7,\tBabu<br \/>\nGovind, who had been treated hostile by the prosecution, for<br \/>\narriving  at  the conclusion that appellant was seen by\t him<br \/>\ngiving\tthe knife blows to the deceased.  He also  contended<br \/>\nthat  the incriminating evidence which is relied upon by the<br \/>\nprosecution  for recovery of blood stained knife and clothes<br \/>\nof the accused, could not be relied upon because the panchas<br \/>\nhave  not  supported  the said recovery.  As  against  this,<br \/>\nlearned\t counsel for the respondent submitted that the\tHigh<br \/>\nCourt  has scanned the entire evidence in proper perspective<br \/>\nand,  therefore,  the judgment and order passed by the\tHigh<br \/>\nCourt does not call for any interference.\n<\/p>\n<p>      The  High Court, in our view, has rightly relied\tupon<br \/>\nsome  part of the evidence of a hostile witness.  P.W.7\t has<br \/>\nnot supported the prosecution story in its entirety.  He has<br \/>\nstated before the Court that two persons were quarrelling at<br \/>\nthe  scene of incident and one of them was accused no.2, who<br \/>\nwas having a knife with him at the time of incident;  In his<br \/>\ndeposition,  he had identified the appellant as the  persons<br \/>\ngiving\tknife blow on the deceased.  He has also stated that<br \/>\nthe  person  who was causing injury with knife\twas  accused<br \/>\nno.2.\tHis  evidence also establishes the prosecution\tcase<br \/>\nwith  regard to the time, place and weapon of offence  being<br \/>\nknife  and  also that person having knife was accused  no.2.<br \/>\nSome part of his evidence is corroborated by P.Ws 11 and 12.<br \/>\nIt has come on record that PW7 had immediately informed PW11<br \/>\nBhagwan Jina and PW12 Nanu Bhima about the incident that two<br \/>\npersons\t were  fighting\t near the Jaigurudev  Farm  and\t one<br \/>\nperson\twas having knife in his hand and that he has already<br \/>\ninflicted  one blow.  PW12 has also further stated that\t PW7<br \/>\nBabu  Govind  had informed that Laxman Chana  had  inflicted<br \/>\nknife  blow.  This witness was cross-examined in detail with<br \/>\nregard\tto  this aspect but nothing could be found out\tfrom<br \/>\nthe  cross-  examination.   On the basis  of  the  aforesaid<br \/>\ninformation  P.W.   2 lodged the FIR at 5.00  p.m.   Accused<br \/>\nno.2   (appellant)   was  arrested   and  from\this   person<br \/>\nextensively  blood  stained  bush-shirt,  banian  and  other<br \/>\nclothes\t were seized.  Bush-shirt and banian contained human<br \/>\nblood A group, which was blood group of the deceased.  The<br \/>\nInvestigating  Officer had prepared the seizure panchnama of<br \/>\nthe clothes and of the arrest of accused.  Further, the High<br \/>\nCourt  has  rightly  relied upon the discovery\tof  Muddamal<br \/>\nknife  at  the instance of the appellant, which\t was  hidden<br \/>\nbeneath\t ashes\tof  the\t fire place in the  kitchen  of\t the<br \/>\nappellant.   The said knife also contained blood having\t A<br \/>\ngroup.\t For that purpose the High Court has relied upon the<br \/>\npanch  witness\tPW20,  Bhika  Lakhman, who  was\t working  as<br \/>\nElectric Supervisor in Una sugar factory.\n<\/p>\n<p>      From the aforesaid evidence on record, in our view, it<br \/>\ncannot\tbe  said that the High Court erred in  relying\tupon<br \/>\nsome   portion\t of  the  evidence  of\tP.W.   7   who\t was<br \/>\ncross-examined\tby the prosecution.  It is settled law\tthat<br \/>\nevidence  of hostile witness also can be relied upon to\t the<br \/>\nextent\tto  which  it\tsupports  the  prosecution  version.<br \/>\nEvidence of such witness cannot be treated as washed off the<br \/>\nrecord.\t  It remains admissible in the trial and there is no<br \/>\nlegal  bar  to\tbase his conviction upon  his  testimony  if<br \/>\ncorroborated  by other reliable evidence [Re:  Bhagwan Singh<br \/>\nv.  State of Haryana (1976) 1 SCC 389 and <a href=\"\/doc\/996233\/\">Sat Paul v.  Delhi<br \/>\nAdministration<\/a>\t(1976)\t1  SCC 727].  In the  present  case,<br \/>\napart  from  the evidence of P.W.7, the prosecution  version<br \/>\nthat  he saw that appellant was having knife in his hand and<br \/>\nwas quarreling with the deceased gets corroboration from the<br \/>\nevidence of P.Ws 11 and 12 to whom he disclosed the incident<br \/>\nimmediately.   On the basis of the said information,  within<br \/>\none  hour,  FIR\t was  lodged  disclosing  the  name  of\t the<br \/>\nappellant  as  the person who has inflicted the knife  blow.<br \/>\nNumber\tof  incised wounds are found as per  the  Postmortem<br \/>\nreport.\t  The prosecution version gets further corroboration<br \/>\nfrom  discovery\t of  Muddamal knife containing\thuman  blood<br \/>\nGroup  A.   Further the bush-shirt and baniyan which  were<br \/>\nput  on\t by the accused at the time of incident were  having<br \/>\nextensive  blood  stains  which were also  found  containing<br \/>\nhuman  blood group A.  Learned counsel for the\tappellant,<br \/>\nhowever,  contended that accused is also having blood  Group<br \/>\nA  and\tthat he was having injury on the thigh as per  the<br \/>\nevidence  of the Doctor.  In our view, there is no substance<br \/>\nin  his contention because as per the medical evidence,\t the<br \/>\ninjuries  caused to the accused were minor and that  because<br \/>\nof  such injuries, there would not be extensive\t bloodstains<br \/>\non the bush-shirt and baniyan put on by the accused.  In his<br \/>\n313  statement\talso, accused has not explained how  he\t got<br \/>\nbloodstains  on his bush-shirt and baniyan.  He has also not<br \/>\ndenied\tthe recovery of the said bush-shirt and baniyan from<br \/>\nhis person at the time of his arrest.\n<\/p>\n<p>      Hence,  considering  the\tabove\tstated\tevidence  on<br \/>\nrecord,\t it  cannot  be said that High Court  committed\t any<br \/>\nerror in convicting the appellant for the offence punishable<br \/>\nunder Section 302 IPC.\n<\/p>\n<p>      In the result, the appeal is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Koli Lakhmanbhai Chanabhai vs State Of Gujarat on 16 November, 1999 Author: Shah Bench: M.B.Shah, G.B.Pattanaik PETITIONER: KOLI LAKHMANBHAI CHANABHAI Vs.
