GOVERNMENT PLEADER for\nRespondent(s) : 1, 3, \nRULE SERVED BY DS for Respondent(s) : 1 -\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 09\/07\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tthis petition under Article 226 of the Constitution of India, the<br \/>\n\tpetitioner has challenged the order of detention dated 16th<br \/>\n\tMarch 2010 passed by the respondent no.2-District Magistrate, Surat,<br \/>\n\tin exercise of powers under sub-section (2) of Section 3 of the<br \/>\n\tPrevention of Anti-Social Activities Act, 1985 (hereinafter referred<br \/>\n\tto as &#8216;the Act&#8217;), whereby the petitioner has been detained as a<br \/>\n\t bootlegger .\n<\/p>\n<p>Heard<br \/>\n\tMs.Krishna Mishra, learned counsel for the petitioner, and Mr.Amit<br \/>\n\tPatel, learned Assistant Government Pleader, for the respondents. No<br \/>\n\taffidavit-in-reply is filed by the respondents controverting the<br \/>\n\taverments made by the petitioner.\n<\/p>\n<p>Ms.Krishna<br \/>\n\thas drawn the attention of the Court to the impugned order of<br \/>\n\tdetention to submit that the same is based on a solitary offence<br \/>\n\tbeing Prohibition III-C.R. No.307 of 2009 dated 27th<br \/>\n\tDecember 2009, registered with Mangrol Police Station for the<br \/>\n\toffences under Sections 66(1)(b), 65(A)(E), 116(2) and 81 of the<br \/>\n\tBombay Prohibition Act.\n<\/p>\n<p>It<br \/>\n\thas been submitted by the learned counsel for the petitioner that it<br \/>\n\tis a settled legal position that on registration of solitary<br \/>\n\toffence, no order of detention could have been passed as<br \/>\n\tpetitioner-detenu cannot be branded as  bootlegger . It has been<br \/>\n\tfurther submitted that the activities of the petitioner cannot be<br \/>\n\tsaid to be injurious to the public health or public order. It has<br \/>\n\tbeen further submitted by the learned counsel for the petitioner<br \/>\n\tthat there is gross delay in passing the order of detention.\n<\/p>\n<p>The<br \/>\n\tCourt is of the opinion that there is much substance in the<br \/>\n\targuments advanced by learned Counsel for the petitioner. A perusal<br \/>\n\tof the entire grounds of detention clearly shows that the only<br \/>\n\tground for arriving at the subjective satisfaction that the<br \/>\n\tactivities of the petitioner are prejudicial to the maintenance of<br \/>\n\tpublic order is that the petitioner is a bootlegger. There is<br \/>\n\tnothing to show as to how the activities of the petitioner are<br \/>\n\tprejudicial to the maintenance of public order nor is there any<br \/>\n\tmaterial on record to support such a finding. Merely on the basis of<br \/>\n\tthe fact that an offence under the Bombay Prohibition Act has been<br \/>\n\tregistered against the petitioner, the detaining authority has<br \/>\n\tarrived at the subjective satisfaction that the activities of the<br \/>\n\tpetitioner are prejudicial to the maintenance of public order and<br \/>\n\tpublic health. Insofar as the activities being prejudicial to public<br \/>\n\thealth, there is nothing on record to show as to how the activities<br \/>\n\tof the petitioner are prejudicial to public health, or that the<br \/>\n\tactivities of the petitioner are causing or likely to cause<br \/>\n\twidespread danger to life or public health. According to the<br \/>\n\tdetaining authority the activity of selling liquor, per se, amounts<br \/>\n\tto an activity that is prejudicial to the maintenance of public<br \/>\n\torder and public health.\n<\/p>\n<p>Except<br \/>\n\tthe general statement, there is no material on record which shows<br \/>\n\tthat the petitioner-detenu is carrying out illegal activities of<br \/>\n\tselling liquor which is harmful to the health of public. In the case<br \/>\n\tof Ashokbhai Jivraj @ Jivabhai Solanki Vs Police Commissioner,<br \/>\n\tSurat, reported in 2001(1)<br \/>\n\tGLH 393, having considered the<br \/>\n\tdecision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\n\tManohar Lohia Vs State of Bihar, reported<br \/>\n\tin AIR 1966 SC 740, this<br \/>\n\tCourt held that the cases wherein the detention order are passed on<br \/>\n\tthe basis of the statements of such witness fall under the<br \/>\n\tmaintenance of  law and order  and not  public order .\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the petition succeeds and is, accordingly,<br \/>\n\tallowed. The<br \/>\n\timpugned<br \/>\n\torder of detention dated 16th<br \/>\n\tMarch, 2010 passed by the District Magistrate, Surat is quashed and<br \/>\n\tset aside, and the detenu is hereby ordered to be set at liberty<br \/>\n\tforthwith, if not required to be detained in any other case.
