Justice V.GIRI\n\n Dated :04\/09\/2008\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                      Crl.R.P.564\/2001\n                        --------------------\n        Dated this the 4th day of September, 2008\n\n                           ORDER\n<\/pre>\n<p>      The accused in C.C.No.245\/1998 on the files of the<\/p>\n<p>Judicial First Class Magistrate Court, Ramankary, is the<\/p>\n<p>petitioner herein.    She was prosecuted for an offence<\/p>\n<p>punishable    under    Section       138    of the  Negotiable<\/p>\n<p>Instruments Act. The trial Court found the accused guilty<\/p>\n<p>and sentenced her to undergo simple imprisonment for a<\/p>\n<p>period of one year. The accused was also directed to pay<\/p>\n<p>an amount of Rs.1,25,000\/- as compensation to the<\/p>\n<p>complainant under Section 357(3) of Cr.P.C.               The<\/p>\n<p>conviction and sentence were affirmed by the appellate<\/p>\n<p>Court and hence this revision.\n<\/p>\n<\/p>\n<p>2.    The complainant alleged that the accused had<\/p>\n<p>borrowed    an    amount       of     Rs.1,25,000\/- from  the<\/p>\n<p>complainant on 11.6.1996 and on 10.12.1996,                in<\/p>\n<p>discharge of the liability, issued Ext.P1 cheque.         The<\/p>\n<p>cheque when presented for collection, was dishonoured<\/p>\n<p>for want of sufficient funds. Ext.P4 notice was sent to the<\/p>\n<p>Crl.R.P.564\/2001<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>address of the accused, but it was returned with the<\/p>\n<p>endorsement &#8220;addressee left&#8221;. Ext.P5 is a copy of the<\/p>\n<p>said notice. Apparently to re-affirm his position, the<\/p>\n<p>complainant had send Ext.P7 telegram intimating<\/p>\n<p>despatch of the notice and had also send another copy of<\/p>\n<p>the notice to the address of the husband of the accused<\/p>\n<p>under Ext.P8 certificate of posting.<\/p>\n<p>3.    The only defence taken up by the accused as could<\/p>\n<p>be seen from the judgment of the Courts below is that<\/p>\n<p>there was no proper service of notice as such.        The<\/p>\n<p>Courts below referred to the fact that the complainant,<\/p>\n<p>apart from testifying to the despatch of the notice to the<\/p>\n<p>address of the accused,     had also examined PW3 the<\/p>\n<p>postman, functioning in the area where the accused was<\/p>\n<p>actually residing and within whose jurisdiction the<\/p>\n<p>address mentioned in Ext.P4 was situated. Postman was<\/p>\n<p>acquainted with the accused and had also affirmed that<\/p>\n<p>the address was correct. These aspects were taken note<\/p>\n<p>of by the Court     below to find that there is proper<\/p>\n<p>service of notice. Same view has been affirmed by the<\/p>\n<p>appellate Court also.\n<\/p>\n<p>Crl.R.P.564\/2001<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>4.    I heard learned counsel for the petitioner and<\/p>\n<p>learned counsel for the complainant. I am satisfied with<\/p>\n<p>the findings of the Courts below that there has been<\/p>\n<p>adequate service of notice, in terms of Section 138(b) of<\/p>\n<p>the Act. The accused did not have a case that the address<\/p>\n<p>noted in Ext.P4 was not her correct address. PW3, the<\/p>\n<p>postman who was acquainted with the accused has<\/p>\n<p>correctly identified the same. Despatch of     notice was<\/p>\n<p>again affirmed by Ext.P7 telegram and to re-affirm his<\/p>\n<p>position, the complainant had send a copy of the notice<\/p>\n<p>to the address of the husband of the accused under<\/p>\n<p>Ext.P8. Receipt of telegram was proved by Ext.P9. The<\/p>\n<p>contention that there was inadequate service of notice<\/p>\n<p>on the accused as such, was clearly untenable.<\/p>\n<p>5.    Learned counsel for the petitioner then submitted<\/p>\n<p>that the accused is a lady and sentence of imprisonment,<\/p>\n<p>in the circumstances, coupled with a direction to pay<\/p>\n<p>compensation for the cheque amount, is excessive.<\/p>\n<p>6.    In the facts and circumstances of the case, I am of<\/p>\n<p>the view that the sentence of imprisonment can be<\/p>\n<p>reduced to one till the rising of the Court. But as rightly<\/p>\n<p>Crl.R.P.564\/2001<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>pointed out by the learned counsel for the complainant,<\/p>\n<p>it has been more than ten years       since the criminal<\/p>\n<p>prosecution has been pending and the quantum of<\/p>\n<p>compensation should reflect the continued detriment<\/p>\n<p>caused to the complainant.\n<\/p>\n<\/p>\n<p>7.    In the result,     Crl.R.P is allowed in part by<\/p>\n<p>modifying the sentence imposed. The conviction of the<\/p>\n<p>accused under Section 138 of the Act is upheld.        In<\/p>\n<p>modifying the sentence imposed by the Courts below,<\/p>\n<p>the accused is sentenced for imprisonment till the rising<\/p>\n<p>of the Court.
