DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nthe learned Advocate for the petitioner.\n<\/p>\n<p>\t\tIt<br \/>\nis submitted that the alleged dispute  has basis in the contract<br \/>\nnamely, the agreement dated 3.12.2006 made between the  Magestic<br \/>\nHolidays Ltd.,  employer of the applicant herein and the complainant.<br \/>\n The applicant, at the most, has acted as an employee and the<br \/>\nallegations levelled in the complaint are baseless, since the<br \/>\ncomplainant has not paid the total amount as per the agreement of<br \/>\n&#8216;time share&#8217;  arrangement.  Besides,  reliance is placed on the<br \/>\njudgment dated 24.2.2010 passed in Criminal Misc. Application No.8876<br \/>\nof 2009   and it is submitted that the case of the applicant herein<br \/>\nis similar to that of the above case.  In view of the above, the<br \/>\ncomplaint be quashed and set aside.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe over all  aspects and the submissions of the learned Advocate for<br \/>\nthe petitioner, the matter deserves consideration.  Hence, <\/p>\n<p>\t\tRULE<br \/>\n returnable on 22nd<br \/>\nMarch, 2011.
