No.4379 of 2011\n                            SATYENDRA DUSADH\n                                     Versus\n                            THE STATE OF BIHAR\n                                   -----------\n<\/pre>\n<p>02     11.02.2011                  The petitioner is in custody in relation to Sone Nagar<\/p>\n<p>                    Rail P.S. Case No.12\/1989 instituted under Section-395 of IPC for<\/p>\n<p>                    abuse of privilege of bail.\n<\/p>\n<p>                                   As is apparent, the case was instituted in 1989. The<\/p>\n<p>                    petitioner was released on bail in 1990 by orders of this Court but<\/p>\n<p>                    thereafter absconded as such in 1993 his bail and bail bond was<\/p>\n<p>                    cancelled. Ultimately, in 2008 when distress warrants and attachment<\/p>\n<p>                    warrants were executed he surrendered and is in custody since then.<\/p>\n<p>                                   On behalf of the petitioner, it is submitted that the<\/p>\n<p>                    petitioner is a truck driver and had no information with regard to<\/p>\n<p>                    commitment of the case. This is not acceptable. The order clearly<\/p>\n<p>                    shows that his Lawyer was duly informed but still he did not choose<\/p>\n<p>                    not to appear. In T.I. parade he was identified by the informant.<\/p>\n<p>                                   Be that as it may, as the petitioner is in custody since<\/p>\n<p>                    2008, let a report be called from the trial Court as to the time that<\/p>\n<p>                    would take to conclude the trial.
