He, therefore, alleged that the<br \/>\nrespondent no.2 had committed offence punishable under Sections 504,<br \/>\n506(2) IPC read with Section 3(1)(x) of the Scheduled Castes and<br \/>\nScheduled Tribes (Prevention of Atrocities) Act.\n<\/p>\n<p>\tIn<br \/>\nthe said complaint, upon being called, the police carried an inquiry<br \/>\nand submitted a report suggesting that no offence is made out. The<br \/>\npetitioner questioned the finding thereof. However, during the<br \/>\npendency of the proceedings his case came to be dismissed due to his<br \/>\nabsence.\n<\/p>\n<p>\tIn<br \/>\nthe order itself, it is also recorded that previously he was absent<br \/>\non several occasions. Counsel for the petitioner, however, submitted<br \/>\nthat the petitioner was present on previous occasions and the learned<br \/>\nJudge erred that he was remaining continuously absent.\n<\/p>\n<p>\tHaving<br \/>\nperused the documents on record and having heard the learned counsel<br \/>\nfor the petitioner and the learned APP for the State, I find that<br \/>\neven if the observations of the learned Magistrate in the impugned<br \/>\norder is considered that the petitioner was absent on three different<br \/>\noccasions in the past, he is not accurate.\n<\/p>\n<p>\tIn<br \/>\nfact, no interference is called for. Admittedly, on the date when the<br \/>\ncase was fixed for further hearing, the petitioner had not remained<br \/>\npresent. I have perused the police report as well as the complaint<br \/>\nfiled by the petitioner. No case for interfering with the finding in<br \/>\nthe police inquiry is  made out.
