Venkataraman, AGM\n\n                      Appellant not present.\nFACTS<\/pre>\n<p>:\n<\/p>\n<p>       The appellant has sought information under RTI Act by his letter dated 30.4.2007<br \/>\naddressed to PIO, Canara Bank, Bhopal requesting for certain copies of statement of<br \/>\naccounts pertaining to Nirmal State Vikas Samiti held in the said Bank and he is<br \/>\nrequesting this information as a co-occupant of Nirmal State Vikas Samiti. The CPIO<br \/>\nfurnished his reply dated 19.7.2007 by which he informed the appellant this information<br \/>\nis personal information pertaining to third party and the disclosure of this is exempted<br \/>\nunder section 8(1)(j) of the RTI Act. The appellant filed appeal vide letter dated 1.8.2007,<br \/>\nwhich was disposed of by the AA on 25.08.2007 and the AA has stated the PIO&#8217;s reply is<br \/>\nin order in denying the information and therefore the AA has also reiterated the stand<br \/>\ntaken by the PIO, Circle Office, Bhopal. This has resulted in filing of this appeal before<br \/>\nthe Commission on 10.12.2007. Comments were called for vide letter dated 2.5.2008,<br \/>\nwhich was received from CPIO\/AA on 23.5.2008.\n<\/p>\n<p>DECISION:\n<\/p>\n<p>2.     This case came up for hearing on 17.7.2008, which was attended by Asstt. General<br \/>\nManager-cum-PIO of Bhopal. I have gone through the RTI application and other replies<br \/>\nreceived in this connection. The appellant is requesting information pertaining to the<br \/>\ndetails pertaining to Nirmal State Vikas Samiti as the co-occupant of the Samiti. The<br \/>\nstand taken by the CPIO and AA is this information is third party information and this<br \/>\ninformation cannot be given by the Bank since this information is pertaining to one of its<br \/>\ncustomers and they have to maintain confidentiality of the accounts of its customers<br \/>\ntherefore the information was rejected under section 8(1)(e) and 8(1)(j) of the RTI Act.<br \/>\nIn the comments, they have also cited the decision given by the Commission in respect of<br \/>\nsuch matter on two occasions. In the comments it has also been stated the appellant has<br \/>\n<span class=\"hidden_text\">                                                    1<\/span><br \/>\n not submitted any proper authority issued by the management committee to obtain the<br \/>\nrequested information. I, therefore, advise the appellant in case if he is interested in<br \/>\ncollecting this information though he has stated he is co-occupant of the Samiti, it will<br \/>\nnot entitle him to collect the information on behalf of the Samiti since he is not one of the<br \/>\ndesignated officers of the Samiti to collect the information. Therefore, he is advised to<br \/>\nsubmit proper authority letter issued by the management committee to obtain this<br \/>\ninformation on their behalf. In case if he produces one such letter of authority he will be<br \/>\nprovided with that information by the CPIO within 15 days from the date of receipt of<br \/>\nthis decision.
