Justice V.GIRI\n\n Dated :09\/06\/2008\n\n O R D E R\n                          V.GIRI, J.\n          -------------------------\n                 W.P.(C).No.16976 of 2008 U\n          -------------------------\n             Dated this the 9th day of June, 2008.\n\n\n                        JUDGMENT\n<\/pre>\n<p>         The petitioner is a Staff Nurse, presently working<\/p>\n<p>in the New Medical College Hospital, Kozhikode. She is<\/p>\n<p>the mother of two children (twins) aged 2 years. She has<\/p>\n<p>requested for a transfer to Kollam District, essentially to<\/p>\n<p>look after the children. Her claim was earlier directed to<\/p>\n<p>be considered under Ext.P2 judgment. Later, taking note<\/p>\n<p>of the fact that relaxation of the 5 year rule is necessary in<\/p>\n<p>the case of the petitioner, under Ext.P8 judgment, the<\/p>\n<p>Government was directed to take a decision. Government<\/p>\n<p>rejected it under Ext.P9.\n<\/p>\n<p>         2. The petitioner points out that, as on date, the<\/p>\n<p>relaxation of the 5 year rule is not necessary in the case of<\/p>\n<p>the petitioner as she has already completed 5 years of<\/p>\n<p>service in Kozhikode District on 7.5.2008. Therefore, her<\/p>\n<p>request for a posting in Kollam District can be considered<\/p>\n<p>by the Director, it is contended.         Ext.P11 request is<\/p>\n<p>pending before the Director. With reference to Ext.P12, it<\/p>\n<p>W.P.(C).NO.16976\/08<\/p>\n<p>                           :: 2 ::\n<\/p>\n<p>\nis pointed out that there are another four vacancies of<\/p>\n<p>Staff Nurse in Kollam District.\n<\/p>\n<p>         Having heard learned counsel for the petitioner<\/p>\n<p>and the learned Government Pleader, the writ petition is<\/p>\n<p>disposed of directing the 1st respondent to consider the<\/p>\n<p>petitioner&#8217;s request contained in Ext.P11 within a period<\/p>\n<p>of six weeks from the date of receipt of a copy of this<\/p>\n<p>judgment.
