No.38676 of 2010\n           DEEPAK RAM, son of Majetar Ram, resident of\n           village Rajapur, P.S. Piro, District Bhojpur\n                                  Versus\n                              STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>3.   17.3.2011           Heard Mr. Baxi S.R.P.Sinha, learned<\/p>\n<p>               Senior counsel for the petitioner and the<\/p>\n<p>               learned counsel for the State.<\/p>\n<p>                            The    prayer        for     bail     of        the<\/p>\n<p>               petitioner was earlier rejected by an order<\/p>\n<p>               dated      5.10.2009   in    Cr.Misc.No.         32841\/2009<\/p>\n<p>               for the time being with a direction to the<\/p>\n<p>               trial court to ensure that the trial of the<\/p>\n<p>               petitioner is expedited and completed within<\/p>\n<p>               a period of one year.\n<\/p>\n<p>                            Mr. Sinha, learned counsel for the<\/p>\n<p>               petitioner,        would    submit      that     though       a<\/p>\n<p>               period of one year has already expired but<\/p>\n<p>               the trial of the petitioner has not yet come<\/p>\n<p>               to an end.\n<\/p>\n<p>                            This Court had called for a report<\/p>\n<p>               from the trial court as to the present stage<\/p>\n<p>               of   the    trial    and    the    time    likely       to   be<\/p>\n<p>               consumed in concluding the trial. The report<\/p>\n<p>               dated 20th December, 2010 received from the<\/p>\n<p>               court below at Flag &#8216;A&#8217; would reveal that<\/p>\n<p>               the prosecution had already examined seven<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>witnesses      and     the     case       was    awaiting    for<\/p>\n<p>examination       of     the      Investigating       Officer<\/p>\n<p>Bhagirath Thakur, who had since retired from<\/p>\n<p>service. The court below has also indicated<\/p>\n<p>in the report that the trial was likely to<\/p>\n<p>be concluded within a period of four months,<\/p>\n<p>i.e. 20th April, 2011.\n<\/p>\n<p>              Considering           the         aforementioned<\/p>\n<p>aspects and particularly that the end of the<\/p>\n<p>trial of the petitioner is well in sight,<\/p>\n<p>this Court is not inclined to reconsider the<\/p>\n<p>prayer    for     bail       of     the    petitioner.       The<\/p>\n<p>prayer    for     bail       of      the    petitioner       is,<\/p>\n<p>accordingly, rejected.\n<\/p>\n<p>              The trial court is hereby directed<\/p>\n<p>to ensure that the trial of the petitioner<\/p>\n<p>must be completed within the time frame as<\/p>\n<p>indicated in its report dated 20.12.2010. At<\/p>\n<p>the same time this Court would also direct<\/p>\n<p>the    Superintendent          of    Police,       Bhojpur    at<\/p>\n<p>Arrah    to    ensure    that       the    presence    of    the<\/p>\n<p>said     Sub    Inspector           Bhagirath      Thakur     is<\/p>\n<p>obtained and his deposition in the pending<\/p>\n<p>trial, S.Tr.No. 176\/2009 arising out of Piro<\/p>\n<p>P.S.Case No. 250\/2008 is completed within a<\/p>\n<p>period of one month from the date of receipt<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>            of the order by him and the Superintendent<\/p>\n<p>            of Police if necessary will stop payment of<\/p>\n<p>            pension      of          Bhagirath         Thakur,    till     his<\/p>\n<p>            deposition               is         completed         in       the<\/p>\n<p>            aforementioned trial.
