Ramamoorthy, GM\n                       Mr. Umesh Sharma, DGM\n\n                       Appellant not present.\n\nFACTS<\/pre>\n<p>:\n<\/p>\n<p>        The appellant has sought information under RTI Act by his letter dated 27.8.2007<br \/>\naddressed to the APIO\/the Branch Manager, Secunderabad Main Branch, State Bank of<br \/>\nIndia, Secunderabad requesting for various information regarding sanction of credit<br \/>\nfacilities to M\/s Chakilam Trade House Ltd., Hyderabad and other details. The PIO has<br \/>\nregretted to furnish any information vide letter dated 17.9.2007 by which he has informed<br \/>\nthe appellant that the subject matter falls under exempt category in terms of section<br \/>\n8(1)(d), (e) and (j) of RTI Act. Dissatisfied with the reply, the appellant preferred an<br \/>\nappeal on 01.10.2007 and the first AA has given his decision on 3.12.2007 by which he<br \/>\nhas partially upheld the decision of CPIO. He has allowed furnishing limited information<br \/>\nrelating to the sale deed executed in favour of Shri C.Raghu Ram with regard to Flat<br \/>\nNo.401. Again aggrieved with the said decision the appellant filed this present appeal<br \/>\nbefore the Commission on 28.1.2008. Comments were called for from public authority<br \/>\nvide letter dated 2.5.2008, which was received from CGM &amp; AA on 24.5.2008.\n<\/p>\n<p>DECISION:\n<\/p>\n<p>2.     This case was taken up for hearing on 4.7.2008, which was attended by the AGM<br \/>\n(Law) along with the GM &amp; DGM. The appellant did not attend the hearing.I have gone<br \/>\nthrough the RTI application as well as replies received in this connection. During the<br \/>\nhearing the representatives of the public authority have stated that some information<br \/>\nsought by the appellant is already available in the public domain like the information<br \/>\navailable with Sub-Registrar&#8217;s office. It is true that whatever the appellant can obtain<\/p>\n<p><span class=\"hidden_text\">                                                   1<\/span><br \/>\n from public domain, like Sub-Registrar&#8217;s office he can obtain the same. But as far as the<br \/>\ninformation concerning his own property, since he is the affected party as the property<br \/>\nthat has been mortgaged by the borrower has been sold to him whatever the information<br \/>\nthat is available in the public domain can be provided by the Bank to the appellant.<br \/>\nAccordingly, after the detailed deliberations, it is decided that the CPIO should carry out<br \/>\nthe directions as under within 15 days from the date of receipt of this decision:<br \/>\nQuery No.1 &amp; 2: Third party information the appellant is not entitled.<br \/>\nQuery No.3 to 6: This is a public document available with the Sub-Registrar office.<br \/>\nHowever, the CPIO has been directed to furnish the copy of the said public document<br \/>\nwith reference to Flat No. 401 of the appellant.\n<\/p>\n<p>Query No.7: Regarding Mortgage Deed, the CPIO has been directed to segregate under<br \/>\nsection 10(1) and give the particulars concerning with the appellant.<br \/>\nQuery No.8: Available in the public domain.\n<\/p>\n<p>Query No.9: Information in respect of Flat No.401 can be provided to him.<br \/>\nQuery No.10: The CPIO has been directed to tell the date of inspections.<br \/>\nQuery No.11: Only dates can be given.\n<\/p>\n<p>      In respect of other queries, I agree with the stand of the Bank in denying the<br \/>\ninformation.
