JUSTICE SURYA KANT\n\n\nPresent : Mr. Sanjay Vij, Advocate,\n          for the petitioner.\n\n\nSURYA KANT, J. (ORAL)\n<\/pre>\n<p>           Notice of motion.\n<\/p>\n<p>           Mr. R. D. Sharma, Senior DAG, Haryana, accepts<\/p>\n<p>notice on behalf of all the respondents.\n<\/p>\n<p>           Keeping in view the nature of order which I propose to<\/p>\n<p>pass, there is no necessity to call upon the respondents to file<\/p>\n<p>any counter-affidavit.\n<\/p>\n<p>           The   petitioner    is   aggrieved   at   the   order   dated<\/p>\n<p>27.06.2007 (Annexure P-1) passed by the Collector, Gurgaon,<\/p>\n<p>whereby it has been asked to affix the additional stamp duty of<\/p>\n<p>Rs.6,08,710\/- in respect of Plot No. 452 measuring 540 sq. mtrs<\/p>\n<p>situated in Udyog Vihar, Phase-IV, Gurgaon, re-allotted in the<\/p>\n<p>petitioner&#8217;s favour by HSIDC. The petitioner is also aggrieved at<\/p>\n<p>the order dated 06.12.2007 passed by the Commissioner,<\/p>\n<p>Gurgaon Division, Gurgaon-cum-Appellate Authority, upholding<\/p>\n<p>the aforementioned order of the Collector.<br \/>\n<span class=\"hidden_text\"> C.W.P NO. 2465 OF 2009                              -2-<\/span><\/p>\n<p>           The impugned order passed by the Collector reveals<\/p>\n<p>that the Stamp Auditor, Gurgaon has sent a report dated<\/p>\n<p>27.04.2007 pointing out some alleged deficiency towards the<\/p>\n<p>stamp duty at the time of registration of the conveyance deed.<\/p>\n<p>Accepting the said report, the Collector has passed the impugned<\/p>\n<p>order, the relevant part of which reads as follows :<\/p>\n<blockquote><p>           &#8221;     I have seen the report of Stamp Auditor Gurgaon<\/p>\n<p>           and have also heard the counsel for the seller. After<\/p>\n<p>           hearing and perusing the Wasika, I have reached the<\/p>\n<p>           conclusion that the seller was re-allotted the aforesaid<\/p>\n<p>           plot No. 452 measuring 540 sq. mtrs. Phase-IV,<\/p>\n<p>           Industrial   Estate,   Udyog   Vihar,   Gurgaon   by   the<\/p>\n<p>           department of HSIDC, Gurgaon. The aforesaid Wasika<\/p>\n<p>           has been got registered on a lesser value on which as<\/p>\n<p>           per Stamp Auditor Rs.5,94,710\/- is deficient towards<\/p>\n<p>           stamp      and   Rs.14,000\/-    are     payable   towards<\/p>\n<p>           registration fee which is assessed correctly. Hence, I<\/p>\n<p>           ordered that on the aforesaid Wasika Rs.5,94,710\/-<\/p>\n<p>           towards deficient stamp duty and Rs.14,000\/- towards<\/p>\n<p>           registration fee, totaling Rs.6,08,710\/- both towards<\/p>\n<p>           stamp and registration fee be recovered from the<\/p>\n<p>           seller&#8221;.<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> C.W.P NO. 2465 OF 2009                              -3-<\/span><\/p>\n<p>           As may be seen, the Collector has mechanically<\/p>\n<p>accepted the report of the Stamp Auditor overlooking the<\/p>\n<p>statutory obligation cast upon him under Section 47-A(2) of the<\/p>\n<p>Indian Stamp Act, 1899 in terms whereof the Collector is<\/p>\n<p>required to determine the market value on consideration of the<\/p>\n<p>relevant material. The Stamp Auditor&#8217;s report could at the best<\/p>\n<p>be a piece of evidence for determining the market value of the<\/p>\n<p>property. It could not have been the sole basis to fasten the<\/p>\n<p>liability upon the petitioner to pay any additional stamp duty.<\/p>\n<p>Learned counsel for the petitioner has also placed reliance upon<\/p>\n<p>the judgment of Hon&#8217;ble Apex Court in &#8220;<a href=\"\/doc\/1697871\/\">State of Punjab and<\/p>\n<p>others vs. Mohabir Singh and others<\/a>&#8221; (1996) 1 Supreme<\/p>\n<p>Court Cases 609.\n<\/p>\n<p>           For the reasons aforementioned, the writ petition is<\/p>\n<p>allowed. The impugned order dated 27.06.2007 (Annexure P-1)<\/p>\n<p>passed by the Collector, Gurgaon, is set aside and in sequel<\/p>\n<p>thereto, the appellate order dated 06.12.2007 (Annexure P-3)<\/p>\n<p>cannot sustain and the same is also quashed.
