Justice K.T.SANKARAN\n\n Dated :28\/01\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n                 ---------------------------------------------\n                     W.P.(C).No.2924 of 2009\n                 ---------------------------------------------\n             Dated this the 28th day of January, 2009\n\n\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioner was appointed as Upper Primary School<\/p>\n<p>Assistant with effect from 1.6.2007 in Andalur Senior Basic<\/p>\n<p>School, Palayad, in Kannur District as per Exts.P1 and P2<\/p>\n<p>appointment orders.        The Manager submitted proposal for<\/p>\n<p>approval.     The Assistant Educational Officer rejected the<\/p>\n<p>approval. On appeal, the District Educational Officer confirmed<\/p>\n<p>the order passed by the Assistant Educational Officer and<\/p>\n<p>dismissed the appeal as per Ext.P3 order. Though the Manager<\/p>\n<p>moved the Director of Public Instruction, as per Ext.P4 order, the<\/p>\n<p>DPI confirmed the orders passed by the District Educational<\/p>\n<p>Officer.   Aggrieved by Ext.P4, the Manager has filed Ext.P6<\/p>\n<p>Revision and the petitioner has filed Ext.P6(a) Revision before<\/p>\n<p>the first respondent. Exts.P6 and P6(a) Revisions are pending.<\/p>\n<p>      2.    The petitioner relies on Ext.P5 circular whereby the<\/p>\n<p>Director of Public Instruction accorded sanction exempting the<\/p>\n<p>uneconomic schools from maintaining the minimum strength of<\/p>\n<p><span class=\"hidden_text\">WPC No.2924 \/2009                  2<\/span><\/p>\n<p>pupils. The petitioner has relied on the said circular in Ext.P6(a)<\/p>\n<p>Revision.\n<\/p>\n<p>      3.   The reliefs prayed for by the petitioner are the<\/p>\n<p>following:\n<\/p>\n<blockquote><p>       &#8220;(i) Call for the records relating to Exts.P3 and P4 and<br \/>\n            quash the originals of the same by the issue of a writ<br \/>\n            of certiorari or other appropriate writ or order.<\/p>\n<\/blockquote>\n<blockquote><p>      (ii)  issue a writ of mandamus or other appropriate writ<br \/>\n            order or direction commanding the respondents to<br \/>\n            approve the appointment of the petitioner covered by<br \/>\n            Exts.P1 and P2.\n<\/p><\/blockquote>\n<blockquote><p>      (iii) issue a writ of mandamus or other appropriate writ<br \/>\n            order or direction commanding the first respondent to<br \/>\n            effectively consider and pass appropriate orders upon<br \/>\n            Exts.P6 and P6(a) after affording an opportunity of<br \/>\n            being heard to the petitioner within a time limit.<\/p>\n<\/blockquote>\n<blockquote><p>      (iv) pass such other order or direction which this Hon&#8217;ble<br \/>\n            Court may deem fit and proper to grant in the<br \/>\n            circumstances of the case.&#8221;<\/p><\/blockquote>\n<p>      4.   For the time being, the petitioner confines the relief<\/p>\n<p>to relief No.(iii).\n<\/p>\n<p>      In the facts and circumstances of the case, the Writ Petition<\/p>\n<p>is disposed of as follows:\n<\/p>\n<blockquote><p>      (i)  The first respondent shall consider and pass orders on<\/p>\n<p>           Ext.P6 and P6(a) Revisions, as expeditiously as<\/p>\n<p><span class=\"hidden_text\">WPC No.2924 \/2009                3<\/span><\/p>\n<p>           possible and at any rate within a period of three<\/p>\n<p>           months from the date of receipt of a copy of this<\/p>\n<p>           judgment, after affording an opportunity of being<\/p>\n<p>           heard to the petitioner and the Manager.<\/p>\n<\/blockquote>\n<blockquote><p>    (ii)   The petitioner shall produce a copy of the Writ<\/p>\n<p>           Petition and certified copy of the judgment before the<\/p>\n<p>           first respondent.\n<\/p><\/blockquote>\n<blockquote><p>    (iii) The petitioner shall send a copy of the Writ Petition<\/p>\n<p>           and copy of the judgment to the 5th respondent<\/p>\n<p>           (Manager) by registered post and shall produce the<\/p>\n<p>           postal receipt before the first respondent.<\/p><\/blockquote>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                 JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Reshma .K. vs The State Of Kerala on 28 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 2924 of 2009(W) 1.
