The
\n\tchallenge in this appeal is to the order regarding disposal of
\n\tmuddamal articles made in the impugned judgment and order dated 13th
\n\tOctober, 2006 rendered by the learned Additional Sessions Judge,
\n\tFast Track Court, Deesa, in Sessions Case No. 48 of 2006, whereby,
\n\tthe learned Additional Sessions Judge directed the muddamal articles
\n\tto be destroyed.\n<\/p>\n
Mr.\n<\/p>\n
\t Pratik B. Barot, learned advocate appearing for the appellant
\n\tsubmitted that the trial court by the judgment and order dated 13th
\n\tOctober, 2006, recorded acquittal of all the accused persons,
\n\tincluding the appellant, of the offences punishable under Sections
\n\t306, 498A and 114 of Indian Penal Code. During the course of the
\n\tinvestigation, certain valuable muddamal articles like gold and
\n\tsilver ornaments came to be seized. The trial court appears to have
\n\tcommitted bonafide mistake while directing destruction of all the
\n\tmuddamal articles including valuable golden and silver ornaments.\n<\/p>\n
Mr.\n<\/p>\n
\tKartik Pandya, learned Additional Public Prosecutor, appearing on
\n\tbehalf of the respondent no.1 State submitted that there is no
\n\tdispute that in the instant matter, during the course of the
\n\tinvestigation, when the dead body of the deceased was sent to
\n\thospital for postmortem, certain valuable golden and silver
\n\tornaments which were on the body of the deceased came to be seized
\n\tas muddamal articles. Mr. Pandya submitted that  there appears to be
\n\ta bona fide mistake on the part of the trial court in issuing
\n\tdirection regarding destruction of  all the muddamal articles. Mr.
\n\tPandya, however, submitted that  the proper course open for the
\n\tappellant is to apply before the trial court itself for obtaining
\n\tappropriate order under Section 452 of the Code of Criminal
\n\tProcedure, 1973 [“the Code” for short] regarding
\n\tdisposal of  the valuable muddamal articles.\n<\/p>\n
There
\n\tis no dispute that during the course of the investigation, valuable
\n\tgolden and silver ornaments came to be seized as referred in the
\n\tlist annexed at Annexure:B with the memo of this appeal. The trial
\n\tcourt, therefore, at the time of disposal of the Sessions Case,
\n\tshould not have passed order regarding destruction of all muddamal
\n\tarticles, but should have conducted an inquiry as contemplated under
\n\tSection 452 of the Code for disposal of the muddamal articles for
\n\thanding over back the muddamal golden ornaments to their rightful
\n\tclaimant or claimants. Under such circumstances, this Court is of
\n\tthe opinion that instead of entertaining and allowing the appeal and
\n\tdeciding the issue regarding delivery of muddamal ornaments to the
\n\trightful claimant, it would be in the interest of justice if the
\n\tappellant is directed to move the concerned trial court under
\n\tSection 452 of the Code for obtaining appropriate order as
\n\tapparently the impugned order passed by the trial court in the
\n\tjudgment and order regarding destruction of muddamal articles
\n\tincluding valuable golden and silver ornaments appears to be an
\n\terror apparent on the record committed by  the trial court.\n<\/p>\n
In
\n\tthe above view of the matter, the appellant is directed to move the
\n\tconcerned  trial court under Section 452 of the Code of Criminal
\n\tProcedure, 1973 seeking relief of appropriate disposal of muddamal
\n\tarticles, more particularly, golden and silver ornaments. The trial
\n\tcourt shall hold appropriate inquiry and hear the appellant as well
\n\tas the original complainant and shall pass appropriate order as
\n\tcontemplated under Section 452 of the Code.\n<\/p>\n
The
\n\tappeal is accordingly disposed of with the above directions.\n<\/p>\n
