Radhakrishnan, J.\n        ==================================\n              W.P.(C)No.17053 of 2008\n        ==================================\n     Dated this the 20th day of November, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The second respondent now works as the General<\/p>\n<p>Manager of the third respondent, a Co-operative<\/p>\n<p>Bank.  Petitioner is a member of that bank.  He has<\/p>\n<p>filed this writ petition contending that the second<\/p>\n<p>respondent is incompetent and unqualified to be the<\/p>\n<p>General Manager and that he is continuing even<\/p>\n<p>after his resignation.   It is also contended that<\/p>\n<p>the second respondent tendered his application for<\/p>\n<p>voluntary retirement and is shown to be continuing<\/p>\n<p>in spite of that.\n<\/p>\n<\/p>\n<p>    2.  The   second  respondent   and   the  first<\/p>\n<p>respondent  Joint  Registrar  have  placed  counter<\/p>\n<p>affidavits and materials on record.     It appears<\/p>\n<p>that the second respondent was granted certain<\/p>\n<p>exemptions from qualification in 1988 with effect<\/p>\n<p>from sometime in 1984 on the basis of a resolution<\/p>\n<p> WPC17053\/08<\/p>\n<p><span class=\"hidden_text\">                        -:2:-<\/span><\/p>\n<p>drawn by the society in 1986.     Nearly twenty years<\/p>\n<p>have gone through thereafter.       In the realm of<\/p>\n<p>service law, the doctrine of &#8220;sit back&#8221; and other<\/p>\n<p>attendant   principles should    stare  at   a  rival<\/p>\n<p>employee who will challenge the grant of exemption,<\/p>\n<p>if it is challenged now.     Petitioner is not even a<\/p>\n<p>rival  employee.    It  is    not  the  case  of  the<\/p>\n<p>petitioner that the service of the third respondent<\/p>\n<p>does not include other persons who are literate and<\/p>\n<p>who can take care of their own affairs.         There<\/p>\n<p>cannot, therefore, be any public spirited exercise<\/p>\n<p>also.  The quality of rights of a member of a co-<\/p>\n<p>operative society to challenge the appointment or<\/p>\n<p>matters relating to the service of a particular<\/p>\n<p>employee of a co-operative society is extremely<\/p>\n<p>minimal and would be relevant only in exceptional<\/p>\n<p>circumstances of glaring injustice or abuse of<\/p>\n<p>authority   which  may  have     an  impact  on   the<\/p>\n<p>establishment as a whole.     Nothing of that sort is<\/p>\n<p>made out in this writ petition.     In so far as the<\/p>\n<p> WPC17053\/08<\/p>\n<p><span class=\"hidden_text\">                        -:3:-<\/span><\/p>\n<p>alleged resignation is concerned, there is nothing<\/p>\n<p>on record to show that the resignation, if any,<\/p>\n<p>tendered by the second respondent was accepted by<\/p>\n<p>the  committee  of   the     bank.    The voluntary<\/p>\n<p>retirement application is also not shown to have<\/p>\n<p>been accepted, though the petitioner contends that<\/p>\n<p>the minutes book, if called for, would disclose it.<\/p>\n<p>This is not so, particularly when the counter<\/p>\n<p>affidavit of the first respondent also shows that<\/p>\n<p>he is fairly appraised and is in control of the<\/p>\n<p>fact situation relating to the third respondent.<\/p>\n<p>Therefore, this writ petition is ordered directing<\/p>\n<p>that if the petitioner moves the third respondent<\/p>\n<p>for any information or copies of materials, that<\/p>\n<p>would be released to enable the petitioner to place<\/p>\n<p>any  grievance,  if   he    has,  before the  first<\/p>\n<p>respondent.
