Kinariwala, learned<br \/>\nadvocate waives service of notice of Rule on behalf of respondent<br \/>\nNo.1 and Shri L.B. Dabhi, learned Additional Public Prosecutor waives<br \/>\nservice of notice of Rule on behalf of respondent No.2. In the fact<br \/>\nand circumstances of the case and with the consent of learned<br \/>\nadvocates appearing for respective<br \/>\nparties, petition is taken up for final hearing today.\n<\/p>\n<p>[1.0]\t\tPresent<br \/>\npetition under Article 227 of the Constitution of India has been<br \/>\npreferred by the petitioners &#8211; original opponents to quash and<br \/>\nset aside the impugned order dated 17.02.2011 passed by the learned<br \/>\nSessions Judge, Ahmedabad (Rural) in Criminal Miscellaneous<br \/>\nApplication No.2\/2011, by which the learned Sessions Judge has<br \/>\ndirected to transfer the proceedings of Criminal Miscellaneous<br \/>\nApplication No.826\/2010 to the Court of learned 3rd<br \/>\nAdditional Civil Judge and Additional Chief Judicial Magistrate,<br \/>\nAhmedabad (Rural) to be heard with Special\/Regular Civil Suit<br \/>\nNo.570\/2009.\n<\/p>\n<p>[2.0]\t\tShri Modi,<br \/>\nlearned advocate appearing on behalf of the petitioners has<br \/>\nvehemently submitted that as such there was no reason whatsoever for<br \/>\nthe learned Judge to transfer the proceedings under the Domestic<br \/>\nViolence Act to be heard alongwith civil suit filed by the landlord<br \/>\nwhich is to get the possession of the property in which the<br \/>\npetitioner No.1 and wife were residing.  It is submitted that as such<br \/>\nan application was submitted at the time when the learned Judge was<br \/>\nhearing the Application No.826\/2010 for dropping the proceedings and<br \/>\nexemption and the same was only at the stage of arguments on behalf<br \/>\nof respondent No.1 and at that stage respondent No.1 submitted the<br \/>\napplication to transfer the case.  It is further submitted that as<br \/>\nsuch the dispute\/controversy in Domestic Application No.826\/2010 has<br \/>\nnothing to do with the controversy in the Regular Civil Suit<br \/>\nNo.570\/2009 which was filed by the landlord to get the possession of<br \/>\nthe property in question.  Therefore, it is requested to allow the<br \/>\npresent petition and to quash and set aside the impugned order.\n<\/p>\n<p>[3.0]\t\tShri<br \/>\nKinariwala, learned advocate appearing on behalf of respondent No.1<br \/>\nhas opposed the present petition by submitting that as it was<br \/>\napprehended by respondent No.1 that the petitioner may surrender the<br \/>\npossession and\/or may agree for consent decree affecting the rights<br \/>\nof respondent No.1, application was submitted to protect the right of<br \/>\nrespondent No.1.  It is submitted that if suitable observations are<br \/>\nmade protecting the rights of respondent No.1, respondent No.1 may<br \/>\nnot insist for transfer of proceedings to be heard with Regular Civil<br \/>\nSuit No.570\/2009.\n<\/p>\n<p>[4.0]\t\tHaving<br \/>\nheard the learned advocates appearing for respective parties and<br \/>\nconsidering the facts narrated herein above, as such on apprehension<br \/>\non the part of respondent No.1 that the petitioner may surrender the<br \/>\npossession to the landlord and agree for consent decree and<br \/>\ntherefore, the proceedings under the Domestic Violence Act were<br \/>\nsought to be heard alongwith civil suit. On the aforesaid ground the<br \/>\nproceedings under the Domestic Violence Act are not required to be<br \/>\nheard with Civil Suit No.570\/2009 filed by the landlord. It is to be<br \/>\nnoted that as such respondent No.1 herself is a party to Regular<br \/>\nCivil Suit No.570\/2009 and even if the petitioner tries to surrender<br \/>\nthe possession and\/or agree for consent decree, it will always be<br \/>\nopen for respondent No.1 to oppose the same and\/or contend that the<br \/>\nconcession by the petitioner is not binding to her and the learned<br \/>\ntrial Court is required to pass appropriate order in accordance with<br \/>\nlaw and on merits in Regular Civil Suit No.570\/2009.  Whatever the<br \/>\nconcession is given by the petitioner will never bind respondent No.1<br \/>\nand it will be open for her to defend the suit independently as a<br \/>\ntenant\/co-tenant which is required to be considered by the Court in<br \/>\nRegular Civil Suit No.570\/2009 in accordance with law and on merits.\n<\/p>\n<p>[4.1]\t\tIn view of<br \/>\nthe above observation and clarification, Shri Kinariwala, learned<br \/>\nadvocate appearing on behalf of respondent No.1 does not invite any<br \/>\nfurther reasoned order while quashing and setting aside the impugned<br \/>\norder passed by the learned Sessions Judge transferring the<br \/>\nproceedings under the Domestic Violence Act.  Hence, this Court is<br \/>\nnot assigning any further reasoned order.\n<\/p>\n<p>[5.0]\t\tIn view of<br \/>\nthe above and for the reasons stated above and with above<br \/>\nobservations and clarifications with respect to rights of respondent<br \/>\nNo.1, impugned order dated 17.02.2011 passed by the learned Sessions<br \/>\nJudge, Ahmedabad (Rural) in Criminal Miscellaneous Application<br \/>\nNo.2\/2011 is hereby quashed and set aside and now the learned Chief<br \/>\nJudicial Magistrate, Ahmedabad (Rural) to proceed further with the<br \/>\nproceedings of Application No.826\/2010 in accordance with law and on<br \/>\nmerits, and without in anyway being influenced by the present order<br \/>\nand\/or earlier order.
