PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/02\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure, 1973 for regular bail in connection with FIR registered as<br \/>\nCR No.I 133 of 2009 with Limkheda Police Station, for the offence<br \/>\npunishable under Sections 143,365, 302 and 34 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>\tLearned<br \/>\nadvocate  Mr. M.A. Memon appearing for Mr A.A. Shaikh for the<br \/>\napplicants submitted that considering the role attributed to the<br \/>\napplicants which can be seen from the FIR at Annexure:A to the<br \/>\napplication, both the applicants were in Jeep Car and had not<br \/>\nparticipated in the commission of offence along with main accused.<br \/>\nConsidering the role played by the applicants, they deserve to be<br \/>\nenlarged on bail.\n<\/p>\n<p>\tLearned<br \/>\nAPP Mr. U.A. Trivedi, representing the opponent State, while opposing<br \/>\nthe bail application, submitted that the applicants are involved in<br \/>\nthe commission of offence punishable under sections 143, 365, 302 and<br \/>\n34 of IPC. Considering the role attributed to the applicants and the<br \/>\nmanner in which  they have aided and abetted the other accused in the<br \/>\ncommission of offence punishable under Sec.302 of IPC, no lenient<br \/>\nview be taken in the matter and the application does not call for<br \/>\ninterference and deserves to be dismissed.\n<\/p>\n<p>\tI have<br \/>\nheard  Mr. M.A.Memon for Mr. A.A. Shaikh, learned advocate for the<br \/>\napplicants and  Mr. U.A. Trivedi, learned Additional Public<br \/>\nProsecutor at length and in great detail.  I have also perused the<br \/>\naverments made in the application. Considering the role attributed to<br \/>\nthe applicants which is reflected in the FIR at Annexure:A to the<br \/>\napplication, provisions of Sections 143, 365, 302 and 34 of IPC as<br \/>\nwell as quantum of punishment etc.,   I am of the view that the<br \/>\napplicants are required to be enlarged on regular bail, without<br \/>\ndiscussing the evidence in detail.\n<\/p>\n<p>\tIn the<br \/>\nfacts and circumstances of the case, the application is allowed and<br \/>\nthe applicants are ordered to be enlarged on bail in connection with<br \/>\nCR No. I 133 of 2009 registered at Limkheda Police Station on<br \/>\nexecuting a bond of Rs.10,000\/- each [Rupees ten thousand only] with<br \/>\none surety each of the like amount to the satisfaction of the Trial<br \/>\nCourt and subject to the conditions that they shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\ntheir presence at the concerned police station on any day of first<br \/>\nweek of every English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicants on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t[H.B.\n<\/p>\n<p>Antani, J.]<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Parsubhai vs State on 1 December, 2010 Author: H.B.Antani,&amp;Nbsp;
