Mr.D.Sivaraman\n^For respondents\n         1 and 2...  Mr.R.Appavu Rethinam\n\n\t\n:JUDGMENT\n<\/pre>\n<p>\tThe owner of the van  is on appeal challenging the award, dated<br \/>\n04.01.2008, passed in M.C.O.P.No.396 of 2007,  on the file of the Motor<br \/>\nAccidents Claims Tribunal (Additional District Court, Fast Track Court No.II),<br \/>\nTirunelveli.\n<\/p>\n<p>\t2.  The only contention raised by the learned counsel for the<br \/>\nappellant\/owner of the vehicle is on the quantum of compensation awarded by the<br \/>\nTribunal.\n<\/p>\n<p>\t3.  It is a case of fatal accident.   The brief facts of the case are as<br \/>\nfollows:- The accident in this case happened on 17.11.2006.  The deceased is a<br \/>\nstudent, aged about 17 years. His father is aged about 47 years and his mother<br \/>\nis aged about 45 years and they are the claimants. The Tribunal in this case<br \/>\nfixed the income of the deceased notionally at Rs.2,500\/- and by adopting<br \/>\nmultiplier of &#8217;15&#8217;, fixed the pecuniary loss to the parents at Rs.3 lakhs. The<br \/>\nTribunal in all granted a sum of Rs.3,45,000\/- as compensation with interest<br \/>\n7.5% per annum as follows:-\n<\/p>\n<p>Sl.No.\tHead \t\t\t\tAmount granted by the Tribunal<br \/>\n1\tLoss of pecuniary benefits \tRs.  3,00,000\/-<br \/>\n\tto the parents<br \/>\n2\tLoss of love and affection to \tRs.    30,000\/-<\/p>\n<pre>\n\tthe parents on the death of\n\ttheir son\n3\tFuneral expenses\t\tRs.     3,000\/-\n4 \ttransport expenses \t\tRs.     2,000\/-\n5 \tloss of estate\t\t\tRs.    10,000\/-\n      \ttotal\t\t\t\tRs.  3,45,000\/-\n\n<\/pre>\n<p>\t4. The only plea taken by the appellant is that  the quantum of<br \/>\ncompensation  awarded by the Tribunal is excessive, inasmuch as, the multiplier<br \/>\nadopted by the Tribunal is high and the notional income taken at Rs.2,500\/-p.m.<br \/>\nis not correct.\n<\/p>\n<p>\t5.  Heard Mr.S.Saji Bino, learned counsel for the respondents 1 and 2 who<br \/>\nsubmitted that the compensation awarded by the Tribunal is just and reasonable<br \/>\nand should not be reduced.\n<\/p>\n<p>\t6.  In the case of a death of a student, the income if at all should be<br \/>\nfixed notionally in accordance with the  schedule appended to the Motor Vehicles<br \/>\nAct.  But, in this case, the annual income is taken as Rs.2500&#215;12=Rs.30,000\/-<br \/>\nwhich is on the higher side and therefore, the same has to be modified.  In view<br \/>\nof the decision of the Apex Court reported in 2004 TNMAC 262(SC) = 2005 ACJ<br \/>\n19(Manju Devi&#8217;s case), the annual income at Rs.30,000\/-p.a. and the  multiplier<br \/>\nof &#8217;15&#8217; adopted is not correct. The loss of pecuniary benefits to the parents is<br \/>\nreduced to Rs.2,25,000\/-. A sum of Rs.15,000\/- each awarded towards loss of love<br \/>\nand affection to the two claimants\/parents stands confirmed. The compensation<br \/>\nawarded towards funeral expenses, in a sum of Rs.3,000\/- and transport expenses,<br \/>\nin a sum of Rs.2,000\/- and loss of estate in a sum of Rs.10,000\/-, are<br \/>\nappropriate in the facts of the present case and hence, they are  confirmed.<br \/>\nAccordingly, the award of the Tribunal is modified as follows:-<br \/>\nSl.No.\tHead \t\t\t\tAmount granted \t\tAmount granted<br \/>\n\t\t\t\t\tby the Tribunal\t\tby this Court<br \/>\n1\tLoss of pecuniary \t\tRs.3,00,000\/-\t\tRs.2,25,000\/-<br \/>\n\tbenefits to the parents<br \/>\n2\tLoss of love and \t\tRs.  30,000\/-\t\tRs.  30,000\/-<br \/>\n\taffection to the parents<br \/>\n\ton the death of their son<br \/>\n3\tTransport expenses\t\tRs.   2,000\/-\t\tRs.   2,000<br \/>\n\tFuneral expenses\t\tRs.   3,000\/-  \t\tRs.   3,000\/-\n<\/p>\n<p>\tloss of estate\t\t\tRs.  10,000\/-\t\tRs.  10,000\/-\n<\/p>\n<p>        Total\t\t\t\tRs.3,45,000\/\t\tRs.2,70,000\/-\n<\/p>\n<p>\t7.  The interest granted by the Tribunal at 7.5%  stands confirmed, since,<br \/>\nthe accident in this case happened in the year 2006 and the award was passed in<br \/>\n2008.\n<\/p>\n<p>\t8.  Counsel for the appellant prays for eight weeks&#8217; time to deposit the<br \/>\nbalance award amount, and on such deposit, the counsel for the respondents 1 and<br \/>\n2\/claimants prays for withdrawal and are allowed.\n<\/p>\n<p>\t9. In the result, the Civil Miscellaneous Appeal is allowed in part as<br \/>\nfollows:-\n<\/p>\n<p>\t(i) The Award of the Tribunal is reduced to  Rs.2,70,000\/- from<br \/>\nRs.3,45,000\/-.\n<\/p>\n<p>\t        (ii)  The interest granted by the Tribunal at 7.5%         is<br \/>\nconfirmed.\n<\/p>\n<p>\t(iii) Appellant is granted eight weeks&#8217; time to deposit the balance  award<br \/>\namount.\n<\/p>\n<p>\t(iv) On such deposit, the parents of the deceased are permitted to<br \/>\nwithdraw the same with interest and  cost as apportioned by the Tribunal.\n<\/p>\n<p>\t(v) There will be no order as to costs in this appeal.\n<\/p>\n<p>\t(vi) Consequently, connected miscellaneous petitions are closed.\n<\/p>\n<p>vsn<\/p>\n<p>To<\/p>\n<p>The Motor Accidents Claims Tribunal<br \/>\n(Additional District Court,<br \/>\nFast Track Court No.II),<br \/>\nTirunelveli.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madras High Court M\/S.
