ORAL JUDGEMENT

     1.The appellant – writ petitioner has challenged
\n     the order dated 23rd March, 1994 made by the learned
\n     Single Judge in Special Civil Application No.     458 of
\n     1993.\n<\/p>\n
     2.The appellant was selected for training as Multi
\n     Purpose Health Worker (Male). The appellant successfully
\n     underwent the training and passed examination thereof.
\n     On his undergoing the said training, by order dated 1st
\n     December, 1989 made by the District Health Officer, the
\n     appellant was appointed as Multi Purpose Health Worker at
\n     Primary Health Centre, Chakalia, district Panchmahal.
\n     The said appointment was purely temporary and subject to
\n     the conditions,inter alia, that the appointment was for a
\n     period of one year and the petitioner shall be relieved
\n     from service without any notice or without relieving
\n     order at the end of one year; that the appointment was
\n     subject to the approval by the Gujarat Panchayat Service
\n     Selection Board and that he shall go through the process
\n     of selection within one year. If he were not selected he
\n     would be treated as having been relieved from service
\n     without any notice etc. On completion of the period of
\n     one year the petitioner was appointed for a further
\n     period of six months on the same terms & conditions by
\n     orders dated 17th December, 1990 and 27th June, 1991 and
\n     for another period of 3 months by order dated 17th June,
\n     1992. On completion of said period of 3 months the
\n     appellant had approached the Civil Court by instituting
\n     Regular Civil Suit No. 550 of 1992.      On vacation of
\n     ad-interim stay granted in the said civil suit No. 550
\n     of 1992, by order dated 8th January, 1993 the appellant
\n     was relieved   from   service.    Feeling aggrieved the
\n     appellant preferred the above Special Civil Application
\n     No. 458 of 1993.\n<\/p>\n
     3.The learned Single Judge was of the opinion that
\n     as the appellant’s appointment was temporary for a
\n     specific period on condition that the appellant had to be
\n     selected through proper selection procedure, on expiry of
\n     the said period, as the appellant was not selected by
\n     statutory   selection procedure, he had no right to
\n     continue as Multi Purpose Health Worker.     The learned
\n     Single Judge was, therefore, pleased to dismiss the
\n     petition.\n<\/p>\n
 4.Appointment to the post of Multi Purpose Health
\nWorker is governed by the statutory rules made in that
\nbehalf in exercise of powers conferred by sub section (3)
\nof section 203 read with section 323 of the Gujarat
\nPanchayats Act, 1961.     The said rules provide that
\nappointment to the post of Multi Purpose Health Worker
\nshall be made by direct selection. For direct selection
\nto the post the candidate should not be more than 25
\nyears of age; he should have passed Secondary School
\nCertificate   Examination   or   any   other   equivalent
\nexamination of any Board or institution recognised by
\nGujarat Government; he should have taken training for six
\nmonths in Family Planning Assistance and should have
\npassed the examination for such training and should have
\nsatisfactorily performed primary vaccination or he should
\nhave 1 1\/2 years’ training of Multi Purpose Health Worker
\nand should have passed the examination for such training.\n<\/p>\n
5.Selection for appointment to various posts under
\nthe District Panchayats is governed by the Gujarat
\nPanchayat Service Selection Committee (Functions) Rules,
\n1964.   The said rules provide for constitution        of
\nSelection Committee for selection for appointments to the
\nposts mentioned in the schedule thereto to be made by
\ndirect recruitment. The schedule thereto includes posts
\nunder the District Panchayats which are not included in
\nthe schedule appended to the Gujarat Panchayat Service
\nSelection Board   (Functions)   Rules,   1964.    It is,
\ntherefore, incumbent that for appointment to the post of
\nMulti Purpose Health Worker selection shall be made by
\nthe Selection Committee     constituted   under   Gujarat
\nPanchayat Service Selection Committee (Functions) Rules,
\n1964 in accordance with the procedure laid down under the
\nsaid Rules. Admittedly the appellant was not selected by
\nsuch Selection Committee through the procedure specified
\nin the aforesaid Gujarat Panchayat Service Selection
\nCommittee (Functions) Rules, 1964. The appellant having
\nnot   been   selected through the statutory selection
\nprocedure the appellant could not have a right to
\ncontinue in the post of Multi Purpose Health Worker. As
\nhis discontinuance from service was in consonance with
\nthe terms & conditions of his appointment, the appellant
\ncould not have a legitimate grievance against         the
\ntermination of his service.\n<\/p>\n
6.For the aforesaid reasons, we agree with the
\ndecision of the learned Single Judge.      The Appeal is
\ndismissed. The parties shall bear their own cost.\n<\/p>\n
