Bateshwar Jha\n                                       ---------------------- Opposite Parties\n                                            ----------\n<\/pre>\n<p>6   21-9-2011                Heard learned counsel for the parties.<\/p>\n<p>                             Petitioner        has     challenged        the     order<\/p>\n<p>                dated 6.8.2007 passed by Additional Sessions<\/p>\n<p>                Judge, F.T.C. V, Begusarai in S.Tr.No. 311-A of<\/p>\n<p>                1993      whereby       petitioner&#8217;s          prayer     for     cross<\/p>\n<p>                examination of P.W.2 has been rejected.<\/p>\n<p>                             Time for production of P.W.1 for cross<\/p>\n<p>                examination is refused. Submission is that he<\/p>\n<p>                was      out      of      village       in     connection         with<\/p>\n<p>                livelihood, so he could not be produced. Same<\/p>\n<p>                prayer was made before the trial court and it<\/p>\n<p>                appears that the trial court is thorough on the<\/p>\n<p>                point that charges were framed in the case on<\/p>\n<p>                19.1.2000. P.W.1 Sadanand Rai was examined on<\/p>\n<p>                7.9.2000 which concluded on 5.6.2000 after a<\/p>\n<p>                long      gap.    P.W.2     Naresh      Rai    was     produced    in<\/p>\n<p>                Court. His cross-examination was deferred as it<\/p>\n<p>                was told by him that he was not feeling well.<\/p>\n<p>                32      dates      were      given      for     examination         of<\/p>\n<p>                aforesaid        witness       but     he     never    turned      up.<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>     During    that    period         a    petition     was    filed   on<\/p>\n<p>     behalf of defence also to expunge the evidence<\/p>\n<p>     of P.W.2 Naresh Rai as he was not turning for<\/p>\n<p>     cross-examination            as       it   appears        from    the<\/p>\n<p>     impugned order.\n<\/p>\n<p>               It is not denied by any of the parties<\/p>\n<p>     that specific direction was given to proceed<\/p>\n<p>     with     the     case       day       to   day     with     further<\/p>\n<p>     specification          to    produce         the     witness       on<\/p>\n<p>     27.7.2007,       again      to       30.7.2007     and    again   to<\/p>\n<p>     6.8.2007 and in that circumstance, further time<\/p>\n<p>     any more to produce the said witness, in my<\/p>\n<p>     opinion also, has rightly been refused by the<\/p>\n<p>     trial court.\n<\/p>\n<p>                Finding no illegality in the impugned<\/p>\n<p>     order     dated        6.8.2007,           this    petition        is<\/p>\n<p>     dismissed.\n<\/p>\n<\/p>\n<pre>AI                                                ( Mandhata Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dhirendra Kumar Jha vs State Of Bihar &amp; Ors on 21 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.14266 of 2008 Dhirendra Kumar Jha Versus 1.
