The petition was taken up for<br \/>\nfinal disposal by consent of learned counsel.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner has received Letter of Intent dated 16th<br \/>\nNovember 2010 from Hindustan Petroleum Corporation Limited for<br \/>\nproposed retail outlet dealership on Gondal-Moviya Road, within<br \/>\nGondal Municipality limits (District-Rajkot), under open category<br \/>\nadvertised on 30th June 2010.  Pursuant to that the<br \/>\npetitioner is stated to have made an application dated 16.11.2010 in<br \/>\nForm-IX for the grant of licence in terms of Rule 143 of the<br \/>\nPetroleum Rules 2002 (for short &#8220;the Rules&#8221;);  and the<br \/>\nHPCL had, in turn, sought No Objection Certificate of the district<br \/>\nauthority in terms of Rule 144 of the Rules.  That application for No<br \/>\nObjection Certificate has been rejected by Additional District<br \/>\nMagistrate, Rajkot, on 4.1.2011 and that rejection is challenged<br \/>\nbefore this Court under Article 226 of the Constitution.\n<\/p>\n<p>3.\tThe<br \/>\nimpugned communication dated 4.1.2011 of the Additional District<br \/>\nMagistrate to the Manager, HPCL, is expressly based upon three<br \/>\nconsiderations, namely, (i) the site proposed to be used for<br \/>\npetroleum storage is granted non-agricultural use permission only for<br \/>\nresidential purpose and its purpose is not changed, (ii) the title of<br \/>\nthe land in question is not clear and (iii) the owner of the land has<br \/>\nencroached upon government land.  Each of the grounds mentioned in<br \/>\nthe impugned communication are assailed by the petitioner on the<br \/>\nbasis that by Circular dated 11.6.2004 of the State Government,<br \/>\nprescribing revised guidelines for grant of No Objection Certificate<br \/>\nunder Rule 144 of the Rules, it is clarified that there is no need to<br \/>\nseek N.A. status of the land for giving NOC as the two are not<br \/>\nrelated.  The petitioner has relied upon several other instances<br \/>\nwherein NOC is granted by the same authority subject to the<br \/>\nconditions, inter alia, that the applicant shall have to get<br \/>\npermission from the competent authority to change use of the land<br \/>\nfrom residential purpose to commercial purpose.  It was on that basis<br \/>\nsubmitted that the respondent ought to have issued No Objection<br \/>\nCertificate on the same lines but the petitioner was subjected to<br \/>\nhostile discrimination on extraneous consideration which amounted to<br \/>\nviolation of fundamental right of the petitioner under Article 14 of<br \/>\nthe Constitution.  It was further submitted that, in any case, the<br \/>\npetitioner has already applied for change of user and those<br \/>\nproceedings are pending.  As for the clearance of title, the<br \/>\nobjection itself is not clear insofar as it does not specify how the<br \/>\ntitle of the land was not clear.  The petitioner has relied upon<br \/>\nTitle Clearance Certificate obtained by him on 29th<br \/>\nNovember 2010, to substantiate that the title to the land in question<br \/>\nwas absolutely clear.  As for the third ground, it is stated on oath<br \/>\nby the petitioner that the alleged encroachment on the land is<br \/>\nrelated to totally different land bearing Revenue Survey No.213 and<br \/>\njudicial proceedings in that regard are pending in another forum.<br \/>\nRelying upon the affidavit-in-reply of Collector and District<br \/>\nMagistrate, Rajkot, it is submitted that, admittedly the matter and<br \/>\ndispute related to encroachment were distinct and different.\n<\/p>\n<p>4.\tThe<br \/>\nrespondent has relied upon aforesaid affidavit of the Collector to<br \/>\nsubmit that the petitioner has made sub-plotting in the land in<br \/>\nquestion without any permission and has put part of the land for the<br \/>\npurpose of manufacturing cement equipment, rather than putting it to<br \/>\nresidential use.  It is stated on oath that out of total area of<br \/>\n3324.07 sq.mtrs. of plot no.2 only 1200 sq.mtrs. of land is given to<br \/>\nthe petitioner for the purpose of retail outlet and commercial<br \/>\npurpose, before and without any application for change of purpose<br \/>\nbeing made at the relevant time.  It is further stated that revised<br \/>\nlay out plan of the area in question is not sanctioned by the<br \/>\ncompetent officer.  It is further stated that the title of the land<br \/>\nis not clear and the Mamlatdar has given negative opinion on account<br \/>\nof the fact that prior permission for change of purpose was not<br \/>\nobtained by the petitioner.  It is also submitted that an appropriate<br \/>\nalternative remedy is provided in the provisions of Rule 154 (2) of<br \/>\nthe Rules, which the petitioner has not pursued and the petition was<br \/>\nliable to be rejected on all these grounds.\n<\/p>\n<p>5.\tAs<br \/>\nrepeatedly held, and recently observed by the Apex Court in  <a href=\"\/doc\/223655\/\">M.P.State<br \/>\nAgro Industries Development Corporation and Another v. Jahan Khan<\/a><br \/>\n[AIR 2007 SC 3153],<br \/>\nthe High Court may not entertain a writ petition under Article 226 of<br \/>\nthe Constitution on the ground of availability of an alternative<br \/>\nremedy but that rule is not of universal application.  It is a rule<br \/>\nof discretion and not one of compulsion.  In an appropriate case,<br \/>\ninspite of availability of an alternative remedy, a writ Court may<br \/>\nstill exercise its discretionary jurisdiction of judicial review in<br \/>\nat least three contingencies where enforcement of fundamental right<br \/>\nis involved or there is failure of principles of natural justice or<br \/>\nthe impugned order or proceedings are wholly without jurisdiction.<br \/>\nIn the facts of the present case, while the petition was entertained<br \/>\nby issuance of Notice at the initial stage, by now the period of<br \/>\nlimitation for preferring an appeal has passed, and hence, rejection<br \/>\nof the petition on the ground of alternative remedy would render the<br \/>\npetitioner totally helpless and without any remedy inspite of<br \/>\nviolation of Article 14 in the impugned communication.  It was seen<br \/>\nthat the guidelines of the Government itself practically directed the<br \/>\nauthorities to ignore the N.A. status of the land in question in the<br \/>\nmatter of issuing No Objection Certificates under Rule 144, as also<br \/>\nthe practice of issuing No Objection Certificate on condition of<br \/>\ngetting permission from the competent authority to use the land for<br \/>\ncommercial purpose, were not followed by the authority and extraneous<br \/>\nconsideration of disputes and litigations about other parcel of land<br \/>\nwere pressed into service for denying NOC to the petitioner.  The<br \/>\nother ground of title of the land being not clear was not only<br \/>\nex-facie<br \/>\nvague but it could not be substantiated by any material on record.\n<\/p>\n<p>6.\tTherefore,<br \/>\nthe impugned communication and denial of NOC to the petitioner is<br \/>\nfound and held to be arbitrary and illegal and accordingly set aside.<br \/>\n Consequently, the petition is allowed with the direction that the<br \/>\nrespondent shall expeditiously, and preferably within a fortnight,<br \/>\nreconsider granting of NOC for the purpose of proposed retail outlet<br \/>\nof HPCL to petitioner no.1,  for which he has received Letter of<br \/>\nIntent dated 16th<br \/>\nNovember 2010.  Rule is made absolute accordingly with no order as to<br \/>\ncosts.
