J.\n<\/p>\n<p>This appeal is directed against an order made by the<br \/>\nCentral Administrative\tTribunal.    The respondent filed an<br \/>\napplication for re-fixation of his pay with effect from\t 1st<br \/>\nJuanuary, 1986\tin  the cadre of Divisional Accountant.\t The<br \/>\nTribunal directed that the respondent be given the pay scale<br \/>\nof Rs.\t2000-3200 with effect from 1st Junary.\t1986 in\t the<br \/>\ncadre of  Divisional accountant.  The Tribunal directed that<br \/>\nthe respondent be given the pay scale of Rs.  2000-3200 with<br \/>\neffect from 1st January, 1986 till he  was  declared  to  be<br \/>\nsurplus\t in  the organisation on the Project being wound up.<br \/>\nThe Tribunal noticed:\t(i)  that  the\tpost  of  Divisional<br \/>\nAccountant  is\thigher in every respect other than that of a<br \/>\nSenior Accountant; (ii) The Senior Accountants\twere  always<br \/>\nregarded  as assistants to the Divisional Accountants; (iii)<br \/>\nThat  Senior  Accountants  constitute  a  feeder  cadre\t  to<br \/>\npromotion  to  Divisional  Accountant and some of the Senior<br \/>\nAccountants appeared for examinations for promotion  to\t the<br \/>\nDivisional  Accountants\t cadre\tand  a candidate had to pass<br \/>\nexamination to become Divisional  Accountant  than  the\t one<br \/>\nprecribed for becoming a Senior Accountant and the Third and<br \/>\nFourth Pay Commissionions had recommended higher  pay-scales<br \/>\nfor  Divisional\t Accountants  compared to Senior Accountants<br \/>\nand the Senior Accountants are junior to him. The Divisional<br \/>\nAccountants  took  the\tview  that  it\t would\t be   wholly<br \/>\nincqui0able  alone  a Divisional Accountant who is higher in<br \/>\nstatus than a Senior Accountant, to grant him salary  lesser<br \/>\nthan of Senior Accountant, on that basis given the direction<br \/>\nreferred to by us earlier.\n<\/p>\n<p>The  learned  Additional Solicitor General submitted<br \/>\nthat even  proceeding  on  the\tbasis  that  the  Divisional<br \/>\nAccountant  is\thigher\tin  status  to\tSenior Accountant, a<br \/>\ndirection issued by the Tribunal fixing the pay scale of the<br \/>\nrespondent is improbable.  He also contended that two  posts<br \/>\nare  not comparable as Divisional Accountants are in line of<br \/>\npromotion to Junior Accounts Officer of a lower cadre  alone<br \/>\nwhereas\t Senior\t Accountants  are  in  line for promotion to<br \/>\nEstablishment Officers with the higher pay scales.<br \/>\n\tHowever, it is not possible for\t us  to\t decide\t the<br \/>\nsecond\tquestion  raised by the learned Additional Solicitor<br \/>\nGeneral. The Tribunal  has  on\tconsideration  of  different<br \/>\naspects of the matter to which we have adverted to has taken<br \/>\nthe view that Divisional Accountant is nigher in status than<br \/>\na  Senior  Accountant  which  is  a finding on a question of<br \/>\nfact. On examination of the  duties  assigned  to  different<br \/>\npersons\t and  other  relevant circumstances the Tribunal has<br \/>\ncome to this conclusion.  Hence\t we  do\t not  think  we\t can<br \/>\ndisturb that finding.\n<\/p>\n<p>However, the Tribunal could not\t have  directed\t fixing\t the<br \/>\npay-scales of\tthe  respondent.    On\tthe  other  hand,  a<br \/>\ndirection should have been issued to the concerned authority<br \/>\nto fix a proper\t pay  scale  bearing  in  mind\tthe  finding<br \/>\nrecorded by the Tribunal that Divisional Accountants enjoy a<br \/>\nhigher status  to  that\t of a Senior Accountant.  The appeal<br \/>\nfiled by the Government is,  therefore.\t   allowed  in\tpart<br \/>\nmodifying  the\tdirection  issued  by the Tribunal to give a<br \/>\nparticular pay scale of Rs.  2000-3200 with effect from\t 1st<br \/>\nJanuary,  1986,\t on the other hand, the appellants shall fix<br \/>\nappropriate pay scale bearing in mind the  finding  recorded<br \/>\nby the\tTribunal  the Divisional Accountant.
