With consent of the learned advocates appearing for the<br \/>\nrespective parties, the application is taken up for hearing and<br \/>\ndecision today.\n<\/p>\n<p>\tHeard<br \/>\nthe learned advocates appearing for the respective parties.\n<\/p>\n<p>\tBy<br \/>\nvirtue of order dated 09.09.2010, by which the petition was disposed<br \/>\nof with certain directions, the petitioner   present applicant was<br \/>\nrequired to file an undertaking before the Court.  It appears that<br \/>\nthe petitioner   applicant did not or could not file the<br \/>\nundertaking within the time limit prescribed by the Court. Therefore,<br \/>\npresent application has been moved with a request to extend the time<br \/>\nlimit for filing the undertaking, as per the Court&#8217;s direction. A<br \/>\ncopy of the original undertaking is annexed to present application.\n<\/p>\n<p>\tAs<br \/>\nsuch, considering the facts of the case, the first reaction of the<br \/>\nCourt was not to grant such extension, however, Mr. S.K.Patel,<br \/>\nlearned advocate for the petitioner   applicant, submitted that in<br \/>\nthe interregnum i.e. between the date of the order till today, a full<br \/>\nand final amicable settlement between the parties has been arrived at<br \/>\nby virtue of which the petitioner   applicant has made the payment<br \/>\nof entire agreed amount and nothing remains due and payable now. Mr.<br \/>\nSatta, learned advocate for Mr. Gandhi, learned advocate for the<br \/>\nopponent   respondent has confirmed the said factual aspect. He<br \/>\nalso admits that full and final amicable settlement between the<br \/>\nparties has been arrived at and amount as agreed between the parties<br \/>\ntowards full and final settlement, has been paid by the applicant<br \/>\nplaintiff to the opponent   respondent and that therefore, the<br \/>\ndispute does not survive.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>S.K.Patel, learned advocate for the applicant   petitioner, has<br \/>\nsubmitted that though the settlement has been arrived at and the<br \/>\ndispute is resolved, it is for compliance of the Court&#8217;s order dated<br \/>\n09.09.2010 that an undertaking is required to be filed and therefore,<br \/>\nthe same was sought to be submitted in the registry, however, since<br \/>\nit was submitted after the time limit prescribed by the Court, the<br \/>\nregistry did not accept the same which necessitated present<br \/>\napplication.\n<\/p>\n<p>\tA<br \/>\nxerox copy of the application regarding factum of settlement is<br \/>\nplaced on record.\n<\/p>\n<p>\tHaving<br \/>\nregard to the statement of the learned advocate for the applicant<br \/>\nabout full and final settlement, which is confirmed by the learned<br \/>\nadvocate for the opponent, the request made in para 5(A) of present<br \/>\napplication is granted.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
