Mr.G.Prabhu Rajadurai\n\n\n:JUDGMENT\n<\/pre>\n<p>\tThis appeal is focussed as against the judgment and decree dated<br \/>\n19.01.2007, passed in M.C.O.P.No.229 of 2003, on the file of the Motor Accidents<br \/>\nClaims Tribunal (III Additional Sub Court), Tiruchirapalli.\n<\/p>\n<p>\t2.Heard both sides.\n<\/p>\n<p>\t3. The challenge in this Civil Miscellaneous Appeal is relating to the<br \/>\nquantum of compensation awarded by the Tribunal, vide judgment dated 19.01.2007,<br \/>\nto a tune of Rs.71,000\/-(Rupees Seventy One Thousand only) on the following sub-<br \/>\nheads:<\/p>\n<pre>\n\t(i)For Permanent disability\t   - Rs.  51,000.00\t\t\n\t(ii)For Pain and Suffering and\n\t\tMental Agony\t\t   - Rs.  10,000.00\t\n<\/pre>\n<p>\t(iii)For Transportation Expenses   &#8211; Rs.   3,000.00\n<\/p>\n<p>\t(iv) For Loss of income<br \/>\n    \t\tduring the treatment period<br \/>\n\t\t&amp; convalescent period\t   &#8211; Rs.   5,000.00\n<\/p>\n<p>\t(v) For Nutritious Food \t   &#8211; Rs.   2,000.00\n<\/p>\n<p>\t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<pre>\t\t \t         Total     - Rs.  71,000.00\t\t\t\t\n\t\t\t\t\t\t--------------\n\n<\/pre>\n<p>\t4. Animadverting upon the quantum of compensation awarded by the Tribunal,<br \/>\nthe Transport Corporation preferred this appeal on various grounds, the gist and<br \/>\nkernel of them would run thus:\n<\/p>\n<p>\tThe Tribunal awarded a huge compensation of Rs.71,000\/- without adhering<br \/>\nto any norms. For the fracture of the left hand, the permanent disability was<br \/>\nassessed at 38%.  Accordingly, the appellant prays for modification of<br \/>\ncompensation awarded by the Tribunal.\n<\/p>\n<p>\t5.The point for consideration is as to whether the Tribunal awarded &#8216;just<br \/>\ncompensation&#8217;?\n<\/p>\n<p>\t6. During enquiry in this case along with the other connected cases, on<br \/>\nthe side of the claimants P.W.1 to P.W.8 were examined and Exs.P.1 to P.17  were<br \/>\nmarked and R.W.1 was examined on the side of the respondent. No documentary<br \/>\nevidence was adduced on the side of the respondent.\n<\/p>\n<p>\t7. Point: The learned counsel for the appellant\/Transport Corporation<br \/>\nwould submit that the Tribunal simply awarded a sum of Rs.51,000\/- for  34%<br \/>\npermanent disability at the rate of Rs.1,500\/- for each percentage of permanent<br \/>\ndisability sustained by the petitioner.  Whereas the learned counsel for the<br \/>\nclaimant would echo the cri de coeur of the claimant to the effect that because<br \/>\nof the injury sustained by him he could not continue his work as a labourer and<br \/>\nhence the compensation awarded by the Tribunal warrants no interference.\n<\/p>\n<p>\t8. No doubt assessment of 34% permanent disability for the fracture of the<br \/>\nleft hand is on the higher side.  At this juncture, I would like to refer to<br \/>\nSchedule I, Part II, Serial No.6 of the Workmen Compensation Act, which is<br \/>\nreproduced hereunder for ready reference:\n<\/p>\n<p>&#8220;6.Loss of thumb and its metacarbal bone &#8211; 40%&#8221;\n<\/p>\n<p>As such even for loss of the thumb and its metacarbal bone the permanent<br \/>\ndisability is assessed at 40%.  But here for the fracture of left hand the<br \/>\npermanent disability was assessed at 34%, which is obviously on the higher side.<br \/>\nHowever, it could taken that he sustained permanent disability to a tune of 25%.<br \/>\nTaking into consideration the fact that the claimant sustained injury  at the<br \/>\nage of 47, awarding compensation at the rate of Rs.2,000\/- for each percent of<br \/>\npermanent disability would meet the ends of justice. If accordingly worked out<br \/>\nfor  25%  permanent disability the compensation comes to Rs.50,000\/- (Rupees<br \/>\nFifty Thousand only), which is almost the same as the Tribunal awarded, even<br \/>\nthough the criterion is different.\n<\/p>\n<p>\t9. The compensation amounts awarded under other sub-heads also are found<br \/>\nto be reasonable, in such a case, I am of the considered opinion that this is<br \/>\nnot a fit case for interference.\n<\/p>\n<p>\t10. In the result, this appeal is dismissed. Consequently, connected<br \/>\nM.P.(MD) No.1 of 2007 is closed.
