The said suit came<br \/>\nto be dismissed for default vide order dated 30.03.2010.  The<br \/>\npetitioners thereafter preferred restoration application and the same<br \/>\nwas also rejected vide order dated 20.09.2010. Being aggrieved by the<br \/>\nsaid order, the present petition is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Gadhvi, learned advocate appearing for the petitioner submitted that<br \/>\nthe petitioners were not informed by their advocate at any point of<br \/>\ntime about the progress in the suit and that the petitioners came to<br \/>\nknow about the order of dismissal for default only on 08.04.2010.<br \/>\nMr. Gadhvi has submitted that the petitioners should not suffer for<br \/>\nthe fault of the advocate.\n<\/p>\n<p>4.\tAs<br \/>\na result of hearing and perusal of records, this court is of the<br \/>\nopinion that interest of justice shall be served if the matter is<br \/>\nrestored to its original file on condition that the petitioners pay<br \/>\nappropriate costs for the same.  Accordingly, with the consent of the<br \/>\nparties the following order is passed:\n<\/p>\n<p>\tThe<br \/>\n\torder dated 20.09.2010 passed below Ex. 1 in Misc. Civil Application<br \/>\n\tNo. 17\/2010 is hereby quashed and set aside.\n<\/p>\n<p>\tThe<br \/>\n\tcourt below shall restore the civil suit to its original file and<br \/>\n\thear and decide the same on merits.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioners shall pay additional amount of Rs. 7,500\/- as cost to<br \/>\n\tthe respondents no. 1, 2, 3 &amp; 5 within a period of four weeks<br \/>\n\tfrom today.\n<\/p>\n<p>\tOn<br \/>\n\tthe said amount being deposited, it shall be paid to the Collector,<br \/>\n\tMehsana by way of Account Payee Cheque.\n<\/p>\n<p>\tAs<br \/>\n\tfar as the amount of Rs. 7500\/- deposited earlier by the petitioners<br \/>\n\tpursuant to the order dated 11.01.2011 is concerned, the same shall<br \/>\n\tbe paid to the respondent no. 4.\n<\/p>\n<p>\tThe<br \/>\n\tRegistry of this Court is directed to issue an Account Payee Cheque<br \/>\n\tin the name of Chief Town Planning Officer, Mehsana Nagarpalika qua<br \/>\n\tRs. 7500\/-.\n<\/p>\n<p>\tOn<br \/>\n\tproduction of receipt qua payment of Rs. 7500\/- to the Collector,<br \/>\n\tthe Court below shall proceed with the matter.\n<\/p>\n<p>\tIt<br \/>\n\tis made clear that if the additional amount of costs is not<br \/>\n\tdeposited by the petitioners, the suit shall be deemed as not<br \/>\n\trestored.\n<\/p>\n<p>5.\tPetition<br \/>\nis allowed to the aforesaid extent.\n<\/p>\n<p>(K.S.\n<\/p>\n<p>JHAVERI, J.)<\/p>\n<p>Divya\/\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gunvantlal vs State on 27 September, 2011 Author: Ks Jhaveri, Gujarat High Court Case Information System Print SCA\/15785\/2010 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 15785 of 2010 ========================================================= GUNVANTLAL AMRUTLAL PATEL &amp;
