KRISHNAN,J.\n                  ...........................................\n                    C.R.P.NO.1789 OF 2003\n                  .............................................\n           Dated this the 28th day of January, 2011.\n\n                               O R D E R\n<\/pre>\n<p>     This     revision is preferred against the order in<\/p>\n<p>I.A.No.95\/1999 in A.A.No.39\/1999 of the Appellate authority,<\/p>\n<p>Kannur.   The revision petitioner is not a party to the SM<\/p>\n<p>Proceedings 475\/95.         It is alleged that the first respondent<\/p>\n<p>obtained a certificate of purchase showing the second<\/p>\n<p>respondent as the landlord.             The revision petitioner was not<\/p>\n<p>made a party. The revision petitioner came to know about<\/p>\n<p>the proceedings only when             the said certificate of purchase<\/p>\n<p>was produced in       a suit        for injunction             filed by the  1st<\/p>\n<p>respondent. Since the revision petitioner was not a party to<\/p>\n<p>the proceedings and as he came to know about the<\/p>\n<p>proceedings only belatedly, he had moved                       an application to<\/p>\n<p>condone the delay in filing the appeal. The appellate authority<\/p>\n<p>had stated that there is no explanation for the delay from<\/p>\n<p>22.2.1999 to 8.3.1999 and from 18.3.1999 to 13.4.1999 and<\/p>\n<p>therefore dismissed the delay petition and also the appeal.<\/p>\n<p>     2. It is clear that the revision petitioner is not a party<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nC.R.P.NO.1789 OF 2003<\/p>\n<p>before the Land Tribunal. A certificate of purchase is<\/p>\n<p>obtained by the       first respondent against the second<\/p>\n<p>respondent in the appeal. It is also a settled principle of law<\/p>\n<p>that unless there is a personal notice as contemplated<\/p>\n<p>under Section 72F(3) of the Kerala Land Reforms Act, that<\/p>\n<p>will not be binding    on the person who is not served with<\/p>\n<p>notice.\n<\/p>\n<p>     3. Here the revision petitioner is not even a party to<\/p>\n<p>the proceedings. So far as condonation of delay is concerned,<\/p>\n<p>the Hon&#8217;ble Supreme Court had laid down the principles to<\/p>\n<p>be followed in the celebrated decision reported in <a href=\"\/doc\/1117226\/\">Collector,<\/p>\n<p>Land Acquisition, Anantnag v. Mst. Katiji (AIR<\/a> 1987 SC<\/p>\n<p>1353). The Hon&#8217;ble Supreme Court held that &#8220;when<\/p>\n<p>substantial justice and technical considerations are pitted<\/p>\n<p>against each other, cause of substantial justice deserves to<\/p>\n<p>be preferred for the other side cannot claim to have vested<\/p>\n<p>right in injustice being done because of a non-deliberate<\/p>\n<p>delay&#8221;.   It was also cautioned that &#8220;it must be grasped that<\/p>\n<p>judiciary is respected not on account of its power to legalize<\/p>\n<p>injustice on technical grounds, but because it is capable of<\/p>\n<p><span class=\"hidden_text\">                             : 3 :<\/span><br \/>\nC.R.P.NO.1789 OF 2003<\/p>\n<p>removing injustice and is expected to do so&#8221;.<\/p>\n<p>     4. Here is a case where a certificate that    produced<\/p>\n<p>had been obtained behind the back of the revision petitioner<\/p>\n<p>and from the date of knowledge, the appeal is seen preferred<\/p>\n<p>within 40 or 50 days.     Therefore the appellate authority<\/p>\n<p>was incorrect in dismissing the application to condone the<\/p>\n<p>delay. There are grounds to condone the delay. Therefore<\/p>\n<p>the appeal is allowed and the delay in filing the appeal is<\/p>\n<p>condoned and the Appellate Authority is directed to restore<\/p>\n<p>the appeal to file, send notice to the parties and dispose of<\/p>\n<p>the matter in accordance with law.\n<\/p>\n<p>     The revision is disposed of accordingly.<\/p>\n<p>                                  M.N.
