Raj Kumar Kanodia, Son of Late Baijnath Kanodia\n               Both resident of Jhawganj, Pua Gali, Patna City, District- Patna.\n                                             Versus\n                                          The State Of Bihar\n                                               -----------\n<\/pre>\n<p>4   17.08.2011                The accused petitioners have preferred this revision<\/p>\n<p>                    application against the conviction order dated 19th May, 2010<\/p>\n<p>                    passed by the learned Additional District and Sessions Judge,<\/p>\n<p>                    Patna City in Cr. Appeal No. 89 of 1999\/ 11 0f 2010 by which<\/p>\n<p>                    the judgment and order dated 22nd March, 1999 passed by the<\/p>\n<p>                    Sub-Divisional Judicial Magistrate, Patna city in C.B. Case No.<\/p>\n<p>                    177 of 1993, Trial No. 327 of 1999 by which the petitioners<\/p>\n<p>                    have been convicted and sentenced to simple imprisonment for<\/p>\n<p>                    three months and a fine of Rs. 500\/- (five hundred) under<\/p>\n<p>                    Section 16(i) a, (i) (ii) of the Prevention of Food Adulteration<\/p>\n<p>                    Act, 1954 has been confirmed and the appeal has been<\/p>\n<p>                    dismissed.\n<\/p>\n<p>                              Heard Mr. Nawal Kishore Agrawal, learned Sr.<\/p>\n<p>                    counsel for the petitioners and Mr. Dinesh Singh, learned<\/p>\n<p>                    counsel for the State.\n<\/p>\n<p>                              Learned counsel for the petitioners submits that the<\/p>\n<p>                    petition can be disposed of at the time of admission itself.<\/p>\n<p>                              The facts necessary for the disposal of this case is that<\/p>\n<p>                    on 18.08.1992 at about 12.15 p.m., the informant Food<\/p>\n<p>                    Inspector, alongwith one another Food Inspector reached the<\/p>\n<p>                    shop of the petitioners and in course of conducting raid for the<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>purpose of collecting samples of food materials. He purchased<\/p>\n<p>Chana Dal for the purpose of analyst examination and samples<\/p>\n<p>were sent to the Public Analyst for examination. Chana Dal was<\/p>\n<p>found adulterated and the case under Section 16 (i) a (i) (ii) of<\/p>\n<p>the Prevention of Food Adulteration Act read with Section 272,<\/p>\n<p>273 of the Indian Penal Code against both the accused<\/p>\n<p>petitioners was instituted. After the trial, both the petitioners<\/p>\n<p>have been found guilty in C.B. Case No. 177 of 1993, Trial No.<\/p>\n<p>327 of 1999 and have been sentenced simple imprisonment for<\/p>\n<p>three months and fine of Rs. 500\/- each and in default of<\/p>\n<p>payment of fine to undergone further simple imprisonment 15<\/p>\n<p>days further. Thereafter, the petitioners filed Cr. Appeal No. 89<\/p>\n<p>of 1999. After hearing the parties, the appeal has been dismissed<\/p>\n<p>vide order dated 19th May, 2010 confirming the conviction and<\/p>\n<p>sentenced of the petitioners.\n<\/p>\n<p>          It is submitted by the learned counsel for the<\/p>\n<p>petitioners that the petitioners have been suffering from mental<\/p>\n<p>agony for more than 18 years. They have also remained in<\/p>\n<p>custody for some time and in course of the trial and after the<\/p>\n<p>conviction and in this view of the matter it is a fit case in which<\/p>\n<p>the sentence should be modified.\n<\/p>\n<p>          The learned counsel for the State could not controvert<\/p>\n<p>the contention of the learned counsel for the petitioners.<\/p>\n<p>          After hearing the learned counsels on behalf of both<\/p>\n<p>the parties and on perusal of the material on record, it appears<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>              that the case has been instituted on 18.08.1992 and the<\/p>\n<p>              petitioners have been suffering from mental agony for more than<\/p>\n<p>              18 years and they have also remained in custody for some time.<\/p>\n<p>              In my opinion, it is a fit case in which the sentence should be<\/p>\n<p>              modified. The sentence of the petitioners is reduced to the period<\/p>\n<p>              already gone in custody. The petitioners are directed to be<\/p>\n<p>              released forthwith.\n<\/p>\n<p>                        In the result, this petition is disposed of with<\/p>\n<p>              modification in the sentence.\n<\/p>\n<p>                        Let this order be sent to the learned Sub-Divisional<\/p>\n<p>              Judicial Magistrate, Patna City in C.B.
