RESPONDENT(S)\n\n                             J U D G M E N T\n<\/pre>\n<p>DALVEER BHANDARI, J.\n<\/p>\n<p>          This appeal is directed against the judgment delivered by<\/p>\n<p>the High Court of Punjab and Haryana at Chandigarh in Civil Writ<\/p>\n<p>Petition No.662\/2004 dated July 12, 2004. The respondent herein-<\/p>\n<p>Suresh Kumar Sharma was appointed as Assistant Advocate General,<\/p>\n<p>Punjab by the order dated 28th April, 1986 of the Government of<\/p>\n<p>Punjab.   The order reads as under :\n<\/p>\n<blockquote><p>          &#8220;GOVERNMENT OF PUNJAB<br \/>\n          DEPARTMENT OF HOME AFFAIRS AND JUSTICE<br \/>\n          (JUDICIAL BRANCH)<\/p>\n<p>               The Governor of Punjab is pleased to appoint the<br \/>\n          following Advocate as Assistant Advocates General,<br \/>\n          Punjab in the scale of Rs.2000-2300 plus usual<br \/>\n          allowances attached to these posts, from the date<br \/>\n          they assume charge :-<\/p>\n<blockquote><p>          1.   Shri Suresh Kumar Sharma\n<\/p><\/blockquote>\n<blockquote><p>          2.   Shri Ranjit Singh Gill\n<\/p><\/blockquote>\n<blockquote><p>          3.   Ms.Sukhcharan Kaur Bhatia<\/p>\n<\/blockquote>\n<blockquote><p>          2.   The terms and conditions of their appointment<br \/>\n          will be as under :-\n<\/p><\/blockquote>\n<blockquote><p>                    &#8220;(i) They will be whole time Government<br \/>\n          employees and will do all criminal and miscellaneous<br \/>\n          work entrusted to them by the Advocate General,<br \/>\n          Punjab,\n<\/p><\/blockquote>\n<blockquote><p>                    (ii) Their appointment is purely temporary<br \/>\n          and services are terminable without assigning any<br \/>\n          reason and without notice,\n<\/p><\/blockquote>\n<blockquote><p>                    (iii)For conducting civil cases only, they<br \/>\n<span class=\"hidden_text\">                                              2<\/span><\/p>\n<p>            will be paid two third of the prescribed fee,\n<\/p><\/blockquote>\n<blockquote><p>                      (iv) If on any particular day they have no<br \/>\n            criminal case to conduct in the High Court, fees<br \/>\n            payable to them in civil cases will be reduced by the<br \/>\n            amount of their salary for that day,\n<\/p><\/blockquote>\n<blockquote><p>                      (v) In the matter of leave and traveling<br \/>\n            allowances, they will be governed by the Punjab Civil<br \/>\n            Services Rules,\n<\/p><\/blockquote>\n<blockquote><p>                      (vi)   House   Rent   Allowance   will   be<br \/>\n            admissible to them,\n<\/p><\/blockquote>\n<blockquote><p>                      (vii) Their services are contractual in<br \/>\n            nature and, as such, they will not be entitled to any<br \/>\n            other benefit viz. According   to    Mr.P.S.Patwala,<\/p>\n<p>learned senior counsel appearing for the respondent, this case is<\/p>\n<p>covered by the judgment of this Court in Civil Appeal No.5810\/2000,<\/p>\n<p>State of Punjab &amp; Anr. Vs.S.K.Bhatia &amp; Ors.<\/p><\/blockquote>\n<p>            The    brief       facts   of   this       case,   which     are    relevant    to<\/p>\n<p>dispose of the appeal are recapitulated as under :<\/p>\n<p>            The respondent was appointed as Assistant Advocate General<\/p>\n<p>and   thereafter        he   was   appointed      as    Deputy   Advocate       General    and<\/p>\n<p>Senior    Deputy        Advocate    General       in     the   State     of     Punjab.    The<\/p>\n<p>respondent superannuated on 31.03.2003. The pensionary benefits were<\/p>\n<p>denied to the respondent, then he approached the High Court and made<\/p>\n<p>grievance       that     the    respondent        was     wrongly      denied     pensionary<br \/>\n<span class=\"hidden_text\">                                              3<\/span><\/p>\n<p>benefits.     It may be pertinent to mention that some similarly placed<\/p>\n<p>persons      were     also        denied     pensionary     benefits      after        their<\/p>\n<p>superannuation and in the Writ Petitions of V.P.Parashar, D.N.Rampal<\/p>\n<p>and    S.K.Bhatia     the    High    Court    allowed     their    writ   petitions     and<\/p>\n<p>directed     the    State    of    Punjab    to   give    them    pensionary    benefits.<\/p>\n<p>Mr.Patwalia has particularly referred to the judgment of S.K.Bhatia<\/p>\n<p>who was appointed along with the respondent herein.<\/p>\n<p>The learned single Judge has also quoted the terms and conditions of<\/p>\n<p>the appointment of S.K.Bhatia, which would also be the same in the<\/p>\n<p>case    of   respondent       herein. Pension, gratuity and encashment<br \/>\n            of leave etc.\n<\/p><\/blockquote>\n<blockquote><p>                      (viii) Their appointment would be against a<br \/>\n            non-pensionable post.&#8221;\n<\/p><\/blockquote>\n<p>The    learned single Judge, after elaborately dealing with                              the<\/p>\n<p>arguments of learned counsel for the parties, clearly came to the<\/p>\n<p>conclusion that appointment of S.K.Bhatia was not in the nature of<br \/>\n<span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>contract of personal service but as a regular government employee.<\/p>\n<p>         The learned single Judge has held :\n<\/p>\n<p>         &#8220;&#8230;I hold that the appointment of the petitioner was<br \/>\n         not in the nature of contract of personal service,<br \/>\n         but as a regular Government employee.&#8221;\n<\/p>\n<p>         The judgment of the learned single Judge in the case of<\/p>\n<p>S.K.Bhatia was challenged before the Division Bench of the High<\/p>\n<p>Court of Punjab and Haryana. The judgment of the Single Judge was<\/p>\n<p>upheld by the Division Bench. The order of the Division Bench reads<\/p>\n<p>as under :\n<\/p>\n<blockquote><p>                   &#8220;Heard Learned Single Judge has held, inter<br \/>\n         alia, on the basis of the notification dated 3rd<br \/>\n         March, 1980, as also the view taken in D.N.Rampal<br \/>\n         Case and in V.P.Parashar&#8217;s case that the appointment<br \/>\n         of the petitioner was not in the nature of contract<br \/>\n         of personal service but as regular         government<br \/>\n         employee.   The learned Single Judge has also held<br \/>\n         that stipulation of the condition that the employment<br \/>\n         is contractual was wholly arbitrary, unjust and<br \/>\n         unconstitutional.\n<\/p><\/blockquote>\n<blockquote><p>                    Further, the learned Single Judge has<br \/>\n         applied the ratio of the decision of the Supreme<br \/>\n         Court   in   Shrilekha   Vidyarthi   Versus  State  of<br \/>\n         U.P.,J.T.1990 (4) S.C.211 and distinguished the<br \/>\n         decision in State of U.P. &amp; others Vs. U.P.State Law<br \/>\n         Officers Association &amp; Ors., J.T. 1994(1) S.C.225, on<br \/>\n         the basis of mode of initial appointment of the<br \/>\n         respondent    as   Assistant   Advocate   General  and<br \/>\n         therefore her appointment as Deputy Advocate General.\n<\/p><\/blockquote>\n<blockquote><p>         Dismissed.\n<\/p><\/blockquote>\n<pre>         6-2-1998                    Sd\/-Arun B.Saharya\n                                     Chief Justice\n\n                                     Sd\/-Swatanter Kumar\n                                     Judge\"\n\n\n\n<\/pre>\n<blockquote><p>         The   State   of   Punjab   challenged   the   judgment   of   the<\/p>\n<p>Division Bench before this Court. This Court, in appeal, passed the<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>following order :\n<\/p><\/blockquote>\n<blockquote><p>         &#8220;IN THE SUPREME COURT OF INDIA<br \/>\n         CIVIL APPELLATE JURISDICTION<br \/>\n         CIVIL APPEAL NO.5810 OF 2000<\/p>\n<p>         State of Punjab &amp; Anr.            &#8230;Appellants<br \/>\n         Vs.\n<\/p><\/blockquote>\n<blockquote><p>         S.K.Bhatia &amp; Ors.                 &#8230;Respondents<br \/>\n                             ORDER<\/p>\n<p>              The matter relates to termination of the first<br \/>\n         respondent as Dy.Advocate General by State of Punjab.<br \/>\n         The respondent challenged the termination order dated<br \/>\n         19.7.1993 as illegal on the ground her appointment<br \/>\n         was as a regular government servant and not a<br \/>\n         contractual engagement as counsel. The learned Single<br \/>\n         Judge, by judgment dated 30.5.1997. upheld her<br \/>\n         contention and allowed her writ petition, declared<br \/>\n         the termination order dated 19.7.1993 as illegal and<br \/>\n         quashed it.   He also held that the first respondent<br \/>\n         was entitled to all consequential benefits.       The<br \/>\n         intra-court appeal filed by the appellants was<br \/>\n         dismissed by the Division Bench on 6.2.1998. The said<br \/>\n         judgment is under challenge.\n<\/p><\/blockquote>\n<blockquote><p>         2.   The impugned judgment of the High Court dated<br \/>\n         6.2.1998 in the case of the first respondent was<br \/>\n         followed by the High Court in a subsequent siilar<br \/>\n         case relating to termination of a Sr.Dy.Advocate<br \/>\n         General -G.S.Cheema Vs. State of Punjab (Judgment<br \/>\n         dated 22.4.2004 in C.W.P.No.8273\/1999).    The state<br \/>\n         challenged the decisions of the High Court in the<br \/>\n         case of the first respondent (in this appeal) and in<br \/>\n         the case of Shri G.S.Cheema (in C.A.No.6057\/2004).<br \/>\n         Both appeals were being listed together for final<br \/>\n         hearing.\n<\/p><\/blockquote>\n<blockquote><p>         3.   When the appeals came up on 29.1.2009, the<br \/>\n         learned counsel for the state submitted that the<br \/>\n         state government has taken a decision to implement<br \/>\n         the order of the High Court in the case of Shri<br \/>\n         G.S.Cheema and absorb him in service. Recording the<br \/>\n         said submission, C.A.No.6057\/2004 was dismissed.\n<\/p><\/blockquote>\n<blockquote><p>         4.   With reference to this appeal (relating to<br \/>\n         Ms.S.K.Bhatia), the learned counsel for the state<br \/>\n         sought   time  to   secure   specific  instructions.<br \/>\n         Thereafter, the matter was adjourned to 19.2.2009 at<br \/>\n         the request of the counsel for the state and again<br \/>\n<span class=\"hidden_text\">                                      6<\/span><\/p>\n<p>           adjourned at his request today. When the matter came<br \/>\n           up today, learned counsel for the state submitted<br \/>\n           that he has not received any instructions from the<br \/>\n           state.\n<\/p><\/blockquote>\n<blockquote><p>           5.   When the state government has accepted the<br \/>\n           decision rendered by the High Court in case of<br \/>\n           G.S.Cheema, which followed the impugned judgment, the<br \/>\n           state government has to adopt the same yardstick in<br \/>\n           this case also, unless there are any distinguishing<br \/>\n           factors or circumstances.    The learned counsel for<br \/>\n           the appellant has not been able to show any<br \/>\n           difference between the facts of this case, and the<br \/>\n           facts in the case of G.S.Cheema.\n<\/p><\/blockquote>\n<blockquote><p>           6.   We are also informed that during the pendency of<br \/>\n           the proceedings, the first respondent has attained<br \/>\n           the age of superannuation and all that therefore<br \/>\n           remains to be done is to process and disburse the<br \/>\n           terminal\/retiral benefits.\n<\/p><\/blockquote>\n<blockquote><p>           7.   In view of the above we dismiss this appeal.<br \/>\n           Needless to say that the retiral benefits due to the<br \/>\n           respondent in accordance with law, will have to be<br \/>\n           processed expeditiously that is within four months.\n<\/p><\/blockquote>\n<blockquote><p>                                            &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p><\/blockquote>\n<blockquote><p>                                            (R.V.Raveendran)<\/p>\n<p>                                            &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p><\/blockquote>\n<blockquote><p>                                            (Markandey Katju)<br \/>\n           New Delhi,<br \/>\n           March 17,2009.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>           Mr.Patwalia submits that the case of the respondent is<\/p>\n<p>squarely covered by the case of S.K.Bhatia because she was also<\/p>\n<p>appointed on the same day by the same order in the same position and<\/p>\n<p>the benefits which were extended      to S.K.Bhatia should also be given<\/p>\n<p>to the respondent herein.\n<\/p><\/blockquote>\n<blockquote><p>           We have heard learned counsel for the parties.<\/p><\/blockquote>\n<p>           Learned counsel appearing for the State of Punjab could<\/p>\n<p>not   distinguish   the   case   of   the   respondent   with   the   case   of<br \/>\n<span class=\"hidden_text\">                                      7<\/span><\/p>\n<p>S.K.Bhatia      and other cases.    Consequently, the respondent herein,<\/p>\n<p>who has already attained superannuation from service would also be<\/p>\n<p>entitled   to    get   pensionary   and   other   benefits   due   to   him   in<\/p>\n<p>accordance with law.       We direct that all the pensionary and other<\/p>\n<p>benefits, if any, be given to the respondent within four months from<\/p>\n<p>the date of communication of this order. In the special facts and<\/p>\n<p>circumstances of the case, we deem it appropriate to direct the<\/p>\n<p>State of Punjab to pay costs of Rs.25,000\/- to the respondent.                Let<\/p>\n<p>the costs be paid within four weeks from the date of communication<\/p>\n<p>of this order.
