Application No. 13907\/2008<\/p>\n<p>\tRule.\n<\/p>\n<p>Learned A.P.P. Mr. U.R.Bhatt, waives services of notice of rule on<br \/>\nbehalf of the respondent-State.\n<\/p>\n<p>2.\tWe<br \/>\nhave heard learned advocate Mr. Buch for the applicants and learned<br \/>\nA.P.P. Mr. Bhatt for the opponent-State on the question of suspension<br \/>\nof sentence and grant of bail, pending appeal.\n<\/p>\n<p>3.\tThe<br \/>\nfollowing aspects are considered :-\n<\/p>\n<p>(1)\tThe<br \/>\napplicant was on bail during the trial and nothing adverse is<br \/>\nreported against him.\n<\/p>\n<p>(2)\tThe<br \/>\ndescription of the injuries would indicate that injury No.1, on the<br \/>\nback, was only muscle deep.\n<\/p>\n<p>4.\tIn<br \/>\nlight of the above aspects, we are inclined to entertain this<br \/>\napplication.\n<\/p>\n<p>\tThe<br \/>\napplication is allowed. The sentence imposed on the applicant by the<br \/>\nlearned  Additional Sessions Judge, Fast Tract Court No.2, Anjar,<br \/>\nKutch, in Sessions Case No.26\/2004, by judgment and order dated<br \/>\n19.9.2008, is suspended till final disposal of the appeal. The<br \/>\napplicant is ordered to be released on bail on his executing a<br \/>\npersonal bond of Rs. 10,000\/- (Rupees Ten Thousand), and furnishing a<br \/>\nsurety of the like amount to the satisfaction of the trial Court, on<br \/>\nconditions that he shall confine himself to State of Gujarat and<br \/>\nshall surrender the passport, if any, before the trial Court.\n<\/p>\n<p>\tThe<br \/>\nabove order shall come into operation only if and when the applicant<br \/>\npays the fine imposed by the trial Court.\n<\/p>\n<p>\tRule<br \/>\nis made absolute accordingly.
