1.\tThis
\nis an application for anticipatory bail under Section 438 of the Code
\nof Criminal Procedure in connection with the FIR bearing CR No. I-116
\nof 2011 registered with Bardoli Police Station, for the offences
\npunishable under Sections 406, 419, 465, 468 and 471 of the Indian
\nPenal Code.\n<\/p>\n
2.\tLearned
\nadvocate Mr. B.D. Jain for the applicant submitted that the applicant
\nis an innocent person and he has been wrongly arraigned in the case
\nof the prosecution. He also submitted that the complaint is lodged
\nafter 18 days from the date of offence. The applicant is an employee
\nof BSNL and the sim card was purchased on the basis of identity of
\nthe complainant’s documents. Even there was consent of the
\ncomplainant and the complainant belongs the mobile number of the
\napplicant since last five years. He also submitted that the presence
\nof the applicant can be secured during the trial. Therefore,
\nanticipatory bail may kindly be granted in favour of the applicant by
\nimposing suitable conditions.\n<\/p>\n
3.\tMr.\n<\/p>\n
Pandya, learned Additional Public Prosecutor representing the State
\nsubmitted that from the bare reading of the complaint, prima facie,
\nit appears that the role is attributed on the part of the applicant.
\nHe read the provisions of Sections 406, 419, 465, 468 and 471 of the
\nIndian Penal Code and he submitted that considering the nature of
\noffences in which the applicant is involved as well as the manner in
\nwhich the offences are committed by the applicant, the application
\ndeserves to be rejected.\n<\/p>\n
4.\tPerused
\nthe application along with papers and considered the submissions
\nadvanced by the learned advocate of respective parties. Prima facie
\nit appears that the recovery of muddamal – sim card is
\nrecovered from the complainant and statement of the officers of the
\nBSNL are recorded by the Investigating Agency.\n<\/p>\n
5.\tIn
\nview of the above facts and circumstances of the case and without
\nentering into detailed discussion of evidence of the case at this
\nstage of anticipatory bail, I am inclined to exercise discretion in
\nfavour of the applicant.\n<\/p>\n
6.\tThe
\napplication is stands allowed. The applicant is granted anticipatory
\nbail in the event of his arrest in connection with CR No. I –
\n116 of 2011 registered with Bardoli Police Station, for the offences
\nas alleged in FIR on his executing  bond of Rs.10,000\/- [Rupees Ten
\nthousand only] with one surety of the like amount on the following
\nconditions that he shall:\n<\/p>\n
[a]\tco-operate
\nwith the investigation and make himself available for interrogation
\nwhenever and wherever he required.\n<\/p>\n
[b]\tshall
\nremain present at the concerned Police Station on 13.10.2011
\nat 11.00 AM<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade him from
\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n
[d]\tat
\nthe time of execution of bond, furnish him residential address to the
\ninvestigating officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]\tnot
\nleave India without the permission of the Court and, if holding a
\npassport, he shall surrender the same before the Trial Court within a
\nweek;\n<\/p>\n
[f]\tnot
\nobstruct or hamper the police investigation and not play mischief
\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n
7.\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand if he considers it proper and just; and the competent Court
\nwould decide it on merits.\n<\/p>\n
8.\tIt
\nwould be open for the Investigating Agency to apply to the competent
\nMagistrate for police remand of the applicant. The applicant shall
\nremain present before the learned Magistrate on the first date of
\nhearing on such application and on all subsequent occasion, as may be
\ndirected by the learned Magistrate. This would be sufficient to treat
\nthe accused in the judicial custody for the purpose of entertaining
\napplication of the prosecution for police remand. This is, however,
\nwithout prejudice to the rights of the accused to seek stay against
\nan order of remand, if ultimately granted, and the power of the
\nlearned Magistrate to
\nconsider such a request in accordance with law. It is clarified that
\nthe applicant, even if remanded to the police custody upon completion
\nof such period of police remand, shall be set free immediately,
\nsubject to other conditions of this anticipatory bail order.\n<\/p>\n
9.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
10.\tThe
\napplicant is permitted to obtain regular bail as per the established
\nprovision of law, within suitable time.\n<\/p>\n
\tRule
\nmade absolute. Direct service is permitted.\n<\/p>\n
