Prem Shankar Rai, son of Anant Prasad Rai, resident of village Harpur, P.S.\n               Kathaiya, District Muzaffarpur.\n                                                 -----------\n<\/pre>\n<p>2   1.10.2010                   Having heard counsel for the parties as with regard to<\/p>\n<p>                    the following relief:-\n<\/p>\n<blockquote><p>                                             &#8220;(i)For issuance of an appropriate writ,<br \/>\n                                 order or direction in the nature of writ of certiorari,<br \/>\n                                 for quashing the selection list dated 31.5.2005 (as<br \/>\n                                 contained in Annexure 3 to this writ application)<br \/>\n                                 issued by Respondent no.7 Mukhiya, Gram<br \/>\n                                 Panchayat Raj, Harpur and the appointment of<br \/>\n                                 Respondent Nos. 8 to 10 as \u201eShiksha Mitra\u201f in Gram<br \/>\n                                 Panchayat Raj, Harpur may be quashed.\n<\/p><\/blockquote>\n<blockquote><p>                                             (ii)For issuance of an appropriate writ,<br \/>\n                                 order or direction, in the nature of writ of<br \/>\n                                 Mandamus, commanding the respondents to appoint<br \/>\n                                 the petitioners as Shiksha Mitra in the aforesaid<br \/>\n                                 Gram Panchayat Raj, Harpur in view of the facts<br \/>\n                                 that the petitioners\u201f names appear higher in the<br \/>\n                                 merit list (Annexure 2) in terms of the guidelines<br \/>\n                                 issued by respondent no.2 which are mandatory and<br \/>\n                                 binding for the selection.&#8221;<\/p><\/blockquote>\n<p>                                this Court is of the considered opinion that while no<\/p>\n<p>                    order can be now passed for appointment of the petitioners on the<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>              post of Shiksha Mitra, the post which has already been abolished<\/p>\n<p>              by the State Government w.e.f. 1.7.2006, the remaining grievance<\/p>\n<p>              as with regard to illegality in the selection and appointment of<\/p>\n<p>              respondent nos. 8, 9 and 10 can still be looked into by the District<\/p>\n<p>              Teachers Appellate Authority in the event the petitioners would<\/p>\n<p>              file their complaint before the said authority.<\/p>\n<p>                          With the aforementioned observation this application<\/p>\n<p>              is disposed of.\n<\/p>\n<\/p>\n<pre>Abhay Kumar                                         ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Subodh Prasad Rai &amp;Amp; Ors vs The State Of Bihar &amp;Amp; Ors on 1 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.3375 of 2007 1.
