After following due procedure,<br \/>\n\tthe disciplinary authority of the petitioner-Corporation imposed<br \/>\n\tpunishment of putting him to his original pay-scale. The respondent<br \/>\n\tpreferred First Appeal as well as Second Appeal, however, both of<br \/>\n\tthem were rejected. Against the said action, the respondent raised a<br \/>\n\tdispute by way of Reference (IT) No.83 of 2005, which was partly<br \/>\n\tallowed, by way of impugned judgment and award. Hence, present<br \/>\n\tpetition.\n<\/p>\n<p>\tHeard<br \/>\n\tlearned counsel appearing for the respective parties and perused the<br \/>\n\tdocuments on record. The respondent was found guilty of serious<br \/>\n\tirregularities\/ misconducts on 28 different occasions in the past.<br \/>\n\tBeing an employee, attached with a public utility sector, it was the<br \/>\n\tduty of the respondent to take necessary care and caution while<br \/>\n\tdischarging his duties. Inspite of having committed such defaults in<br \/>\n\tthe past, the respondent had not exercised reasonable  care and was<br \/>\n\tfound negligent, which is highly unbecoming of a Government<br \/>\n\temployee.\n<\/p>\n<p>\tLooking<br \/>\n\tto the facts of the case, the Labour Court ought not to have<br \/>\n\trejected the Reference of the petitioner since the negligence of the<br \/>\n\trespondent is clearly established. In my opinion, if the penalty of<br \/>\n\tputting the respondent to the original pay-scale  imposed by the<br \/>\n\tdisciplinary authority is substituted by stoppage of five increments<br \/>\n\twith permanent effect, it would meet the ends of justice. Orders<br \/>\n\taccordingly. The impugned judgment and award stands modified<br \/>\n\taccordingly.\n<\/p>\n<p>\tThe<br \/>\n\tensuing monetary benefits will be released by the petitioner within<br \/>\n\ta period of three months from today. The petition stands disposed of<br \/>\n\taccordingly.
