Justice M.SASIDHARAN NAMBIAR\n\n Dated :19\/03\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.443 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners   1   and   2   are   the    defacto<\/p>\n<p>complainants in Crime No.49\/2007 of Thumba Police<\/p>\n<p>Station, Thiruvananthapuram. Annexure-A1 complaint<\/p>\n<p>filed by the petitioners, along with two others,<\/p>\n<p>before Director General of Police, Thiruvananthapuram<\/p>\n<p>was sent to the Station House Officer, Thumba<\/p>\n<p>Police  Station,  based  on   which,  the   FIR  was<\/p>\n<p>registered. This petition is filed under Section<\/p>\n<p>482 of Code of Criminal Procedure for a direction<\/p>\n<p>to conduct further investigation in the case under<\/p>\n<p>Section 173(8) of Code of Criminal Procedure by a<\/p>\n<p>superior officer not below the rank of Deputy<\/p>\n<p>Superintendent of Police under the direct control<\/p>\n<p>of  Commissioner   of   Police,   Thiruvananthapuram<\/p>\n<p>contending that crores of rupees are involved and<\/p>\n<p>the accused are very influential and due to their<\/p>\n<p>influence, proper investigation was not conducted.<\/p>\n<p><span class=\"hidden_text\">CRMC 443\/10              2<\/span><\/p>\n<p>    2.Learned counsel appearing for the petitioners<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Learned counsel, relying on the decision of<\/p>\n<p>the Apex Court in <a href=\"\/doc\/214415\/\">Babubhai Jamnadas Patel v. State<\/p>\n<p>of Gujarat<\/a> ((2009) 9 SCC 610), argued that when the<\/p>\n<p>investigation is tardy and slow, as is clear from<\/p>\n<p>the very fact that in spite of registration of the<\/p>\n<p>case in 2007, the culprits were not brought before<\/p>\n<p>the   court,   this Court  has   to  exercise  the<\/p>\n<p>jurisdiction under Section 482 of Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>    4. Learned Public Prosecutor submitted that a<\/p>\n<p>report was submitted by the Investigating Officer<\/p>\n<p>before     the Magistrate  stating   that   defacto<\/p>\n<p>complainants and others are in foreign countries<\/p>\n<p>and several documents are to be seized and as and<\/p>\n<p>when the defacto complainants will be available,<\/p>\n<p>further investigation will be conducted.<\/p>\n<p>    5. As held by the Apex Court in <a href=\"\/doc\/1836621\/\">Sakiri Vasu v.<\/p>\n<p>State of U.P.<\/a> (2008 (1) KLT 724), the remedy of the<\/p>\n<p><span class=\"hidden_text\">CRMC 443\/10               3<\/span><\/p>\n<p>petitioners is to approach the learned Magistrate<\/p>\n<p>first     and then   only   approach   this   Court.<\/p>\n<p>Petitioners are at liberty to approach the learned<\/p>\n<p>Magistrate under Section 156(3) of Code of Criminal<\/p>\n<p>Procedure.
