Shri Mehta for the appellant has<br \/>\ncontended that the First Information Report exhibit-26 and the<br \/>\ntestimony of the insured claimant at exhibit-32, especially the<br \/>\ncross-examination go to clearly show that the claimant was not<br \/>\nentitled to receive any amount from the insurance company, as the<br \/>\ninsured vehicle was in the name of one Shri Rajendrabhai, whereas<br \/>\nsaid Rajendrabhai had sold the vehicle to someone else, who happened<br \/>\nto be the first informant before the police. The insured himself has<br \/>\ndeposed that he had travelled in the jeep on payment of Rs.15\/- per<br \/>\npassenger along with some other 15 passengers who were travelling in<br \/>\nthe jeep. The policy exhibited indicate that it was a private car<br \/>\npolicy wherein car was not supposed to be used for hire &amp; reward.<br \/>\nAll these factors conclusively go to show that there is strong prima<br \/>\nfacie case against the claimant, so far as the insurance company is<br \/>\nconcerned. Hence the appeal is required to be admitted. Accordingly<br \/>\nit is ADMITTED.  Shri Modi, learned advocate for the respondent no.1<br \/>\nwaives service of notice admission.\n<\/p>\n<p> C.A.\n<\/p>\n<p>NO. 10093 OF 2010 <\/p>\n<p>\tIn<br \/>\nview of the order made in the First Appeal, RULE in application,<br \/>\nreturnable on 2\/12\/2010. Shri Modi for opponent no.1 waives service<br \/>\nof notice of rule.\n<\/p>\n<p>\tLooking<br \/>\nto the facts &amp; circumstances attending the case, ad-interim<br \/>\nrelief in terms of para no. 4(A) of the application is granted, on a<br \/>\ncondition of applicant insurance company depositing the entire<br \/>\nawarded amount before the Claims Tribunal on or before the returnable<br \/>\ndate. Order with regard to disbursement or deposit thereof, if any,<br \/>\nshall be made on the returnable date.\n<\/p>\n<p>\tAt<br \/>\nthis stage Shri Modi has volunteered that the entire appeal could be<br \/>\ndisposed of, if some time is granted to him. In view of this<br \/>\nstatement, though the appeal is  admitted, it is ordered that record<br \/>\n&amp; proceedings be called for so as to reach this Court on or<br \/>\nbefore 1\/12\/2010 and there shall be all the endeavours made by both<br \/>\nthe sides to have the matter disposed of finally by the returnable<br \/>\ndate.\n<\/p>\n<p>Adjourned<br \/>\nto 2\/12\/2010.\n<\/p>\n<p>                                                           [<br \/>\nS.R.
