LTD. - Opponent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nGAURANG H BHATT for\nAppellant(s) : 1, \nMR PARESH M DAVE for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS JUSTICE SONIA GOKANI\n\t\t\n\t\n\n \n\nDate\n: 16\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE AKIL KURESHI)<\/p>\n<p>1.\t\tThe<br \/>\nRevenue is in appeal against the judgment of the Tribunal dated<br \/>\n12.10.2007, by which the Tribunal was pleased to delete penalty of<br \/>\nRs.3,00,000\/- imposed on the assessee by the Commissioner, under<br \/>\nRule-96ZQ of the Central Excise Rules.\n<\/p>\n<p>2.\t\tInitially,<br \/>\nthe Deputy Commissioner imposed penalty of Rs.6,00,000\/- under<br \/>\nRule-96ZQ on the ground that the assessee had not paid the duty<br \/>\nwithin the time, as required under Sub-rule(1) of Rule-96ZQ. In the<br \/>\nappeal of the assessee, the Commissioner reduced the penalty from<br \/>\nRs.6,00,000\/- to Rs.3,00,000\/-. This order was challenged by the<br \/>\nDepartment as well as by the assessee in separate appeals.  The<br \/>\nRevenue&#8217;s appeal came to be dismissed by the CESTAT at Mumbai, by an<br \/>\norder dated 04.10.2005. The assesse&#8217;s appeal came to be allowed by<br \/>\nthe impugned order. The Revenue filed an Application for<br \/>\nRectification of the Mistake, which also came to be dismissed by a<br \/>\nfurther order dated 12.10.2007.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned Counsel for the parties and having perused the<br \/>\norders on record, we find that the Tribunal was prompted to delete<br \/>\nthe penalty under Sub-rule(5) of Rule-96ZQ, on the ground that the<br \/>\nentire duty along with interest was paid by 31.07.1999, by the<br \/>\nassessee.  The Commissioner also, in his appellate order, recorded<br \/>\nthat the appellant did not deposit the amount of Rs.6,00,000\/- by due<br \/>\ndate i.e. 06.09.1999, but, instead deposited such amount on<br \/>\n31.07.2009.
