NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     These appeals  by special leave arise from the judgment<br \/>\ndated September\t 9,  1993  of  the  Division  Bench  of\t the<br \/>\nRajasthan High Court made in C.W.P. No. 1124\/84 and batch.\n<\/p>\n<p>     Notification under\t Section 52  of the  Rajasthan Urban<br \/>\nImprovement Act,  1959 was  published on  October  8,  1979.<br \/>\nThereafter, the Jaipur Development Authority took a decision<br \/>\nafter the  Jaipur Development  authority Act  had come\tinto<br \/>\nforce to  continue   the acquisition under the repealed Act.<br \/>\nConsequently, fresh  notification was  issued on  April\t 20,<br \/>\n1984. The  same came to be challenged in the Writ Petitions.<br \/>\nThe Division  Bench of\tthe High  Court has held that unless<br \/>\nthe scheme  under the  Jaipur Development  Authority Act has<br \/>\nbeen properly  framed, notification  issued is\tnot valid in<br \/>\nlaw. This question was considered by this Court in Pratap v.<br \/>\nState of  Rajasthan [(1996)  3 SCC  1]. In fact the decision<br \/>\nunder appeal  was expressly  held not a good law. This Court<br \/>\nhad held thus:\n<\/p>\n<blockquote><p>     &#8220;14. There\t is also no merit in the<br \/>\n     contention of  the learned\t counsel<br \/>\n     for   the\t appellants   that   the<br \/>\n     decision of  the Division\tBench of<br \/>\n     the Rajasthan  High Court\trendered<br \/>\n     in 1993  in Narain\t case can in any<br \/>\n     way affect the present proceedings.<br \/>\n     Firstly, the  said decision  of the<br \/>\n     Division  Bench  of  the  Rajasthan<br \/>\n     High Court is not final because the<br \/>\n     Special  Leave  Petition  (C)  Nos.<br \/>\n     3100-3127\tof   1994  (the\t present<br \/>\n     appeal) have  been\t filed\tand  the<br \/>\n     same are  pending\tin  this  Court;<br \/>\n     secondly this decision has not been<br \/>\n     approved by  a Full  Bench\t of  the<br \/>\n     Rajasthan\t High\tCourt\tin   its<br \/>\n     judgment dated  1.11.1995 in  Urban<br \/>\n     Improvement  Trust\t  v.  State   of<br \/>\n     Rajasthan and  the other  connected<br \/>\n     cases. In\tthis  judgment,\t dealing<br \/>\n     with Narain  case\tthe  Full  Bench<br \/>\n     observed as follows:\n<\/p><\/blockquote>\n<blockquote><p>     The Division Bench of this Court in<br \/>\n     the  case\t Narain\t v.   State   of<br \/>\n     Rajasthan,\t has   held   that   the<br \/>\n     acquisition proceedings  cannot  be<br \/>\n     taken in  the absence of sanctioned<br \/>\n     notified scheme. This view has been<br \/>\n     taken by  interpreting only  para 9<br \/>\n     of the  Supreme Court  decision  of<br \/>\n     Gandhi Grah  Nirman Sahkari  Samiti<br \/>\n     Ltd.  case\t  to   the   facts   and<br \/>\n     circumstances of  the  case  before<br \/>\n     the Division  Bench.  Consideration<br \/>\n     of para  8 and  11 of  the\t Supreme<br \/>\n     Court decision  does not find place<br \/>\n     in the  decision  of  the\tDivision<br \/>\n     Bench.   As   stated   above,   the<br \/>\n     combined effect  of paras\t8, 9 and<br \/>\n     11 of  the Supreme\t court\tdecision<br \/>\n     seems to  be otherwise. With utmost<br \/>\n     respect, it  is difficult\tto agree<br \/>\n     with the observations made and view<br \/>\n     expressed by  the Division Bench in<br \/>\n     the case  of Narain  as regards the<br \/>\n     decision of  the Supreme  Court  in<br \/>\n     the  case\tof  Gandhi  Grah  Nirman<br \/>\n     Sahkari Samiti Ltd.\n<\/p><\/blockquote>\n<blockquote><p>     It is  indeed unfortunate\tthat the<br \/>\n     judgment of  the Division\tBench in<br \/>\n     Narain case was relied on, when the<br \/>\n     same had been overruled by the Full<br \/>\n     Bench   of\t  that\t Court\t without<br \/>\n     referring\t to   the   Full   Bench<br \/>\n     decision.\t Furthermore   even   on<br \/>\n     merits  we\t  find\tthat   the  said<br \/>\n     decision of  the Division\tBench of<br \/>\n     the Rajasthan  High Court in Narain<br \/>\n     case does\tnot lay down the correct<br \/>\n     law and  the later\t decision of the<br \/>\n     Full Bench\t is  correctly\tdecided.<br \/>\n     The  contention  which  was  raised<br \/>\n     before  the   High\t Court,\t and  it<br \/>\n     succeeded, in  Narain case was that<br \/>\n     there could  be no\t proceedings for<br \/>\n     acquisition which\tdo  not\t conform<br \/>\n     with the  provisions of  the master<br \/>\n     plan inasmuch  as the  master  plan<br \/>\n     shows one\tparticular use\tfor  the<br \/>\n     land in  question,\t the  said  land<br \/>\n     could  not\t  be  acquired\t for   a<br \/>\n     different purpose.\t It was\t further<br \/>\n     contended that without framing of a<br \/>\n     scheme land  could not  be acquired<br \/>\n     under Section  52 of  the said Act.<br \/>\n     In upholding  this\t contention  the<br \/>\n     High Court\t placed reliance  on the<br \/>\n     two-Judge Bench  decision\tof  this<br \/>\n     Court in  <a href=\"\/doc\/648753\/\">State of Tamil Nadu v. A.<br \/>\n     Mohd. Yousef<\/a> [(1991) 4 SCC 224].&#8221;<br \/>\n     Even the  decision in  State of  Tamil  Nadu  v.  Mohd.\n<\/p><\/blockquote>\n<p>Yousef [(1991)\t4 SCC  224] has\t been over-ruled  by a later<br \/>\ndecision of  three-Judge Bench\tof this\t Court in  <a href=\"\/doc\/488907\/\">State  of<br \/>\nTamil Nadu  &amp; Ors. v. L. Krishnan &amp; Ors.<\/a> [(1996) 1 SCC 250].<br \/>\nTherefore, the\tview of\t the High  Court that  framing of  a<br \/>\nscheme is  a pre-condition  for acquisition of land is not a<br \/>\ncorrect proposition of law. The notification for acquisition<br \/>\ncannot be  quashed on that account.\n<\/p>\n<p>     The appeals  are accordingly  allowed. The\t judgment of<br \/>\nthe High  Court stands\t set  aside. Consequently,  the writ<br \/>\npetitions stand dismissed.
