No. 3723 OF 2008\n                -----------------------------------------------\n              Dated this the 13th day of October, 2008\n\n                                O R D E R\n<\/pre>\n<p>       The petitioner&#8217;s vehicle, lorry No.KL 2-M 5016 was allegedly<\/p>\n<p>involved in the commission of an offence under the Kerala<\/p>\n<p>Protection of River Banks &amp; Regulation of Removal of Sand Act,<\/p>\n<p>2001. A crime was registered. The vehicle was seized. Seizure<\/p>\n<p>was reported to the learned Magistrate.                Investigation is now<\/p>\n<p>complete.    Final report has already been filed.               Seizure was<\/p>\n<p>effected on 15.08.08. The vehicle is now continuing in the custody<\/p>\n<p>of the court.    Petitioner applied to the learned Magistrate for<\/p>\n<p>release of the vehicle in his favour. That application was rejected<\/p>\n<p>by the learned Magistrate on the ground that the vehicle is<\/p>\n<p>involved in one earlier similar incident. Accordingly, the learned<\/p>\n<p>Magistrate proceeded to pass the impugned order, rejecting the<\/p>\n<p>claim for release.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. Allegations raised are false. At<\/p>\n<p>any rate the petitioner is willing to abide by any appropriate<\/p>\n<p>conditions.       Imbibing the spirit of the decision in Sundarbai<\/p>\n<p>Ambalal Desai v. State of Gujarat [SC 2003(2) KLT 1089],<\/p>\n<p>Crl.M.C. No. 3723 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>the vehicle may not be compelled to remain in the custody of the<\/p>\n<p>authorities, exposing the same to unnecessary damage and<\/p>\n<p>deterioration. Petitioner shall undertake not to use the vehicle for<\/p>\n<p>commission of any offence under the Act. Appropriate conditions<\/p>\n<p>may be imposed and vehicle may be released to the petitioner, it<\/p>\n<p>is submitted.\n<\/p>\n<p>      3. Learned Prosecutor only submits that appropriate<\/p>\n<p>conditions may be imposed. The interest of the State is only to<\/p>\n<p>ensure that the vehicle is not used for repetition of commission of<\/p>\n<p>any such offences.\n<\/p>\n<p>      Having considered all the relevant inputs, I am persuaded to<\/p>\n<p>agree that direction can be issued to release the vehicle to the<\/p>\n<p>petitioner. In coming to the conclusion, I take note of the decision<\/p>\n<p>in Sundarbai Ambalal Desai(supra), and the need for anxiety<\/p>\n<p>to avoid unnecessary damage and deterioration caused to the<\/p>\n<p>vehicle while under custody of courts and authorities. Appropriate<\/p>\n<p>conditions can of course be imposed.\n<\/p>\n<p>      In the result:\n<\/p>\n<p>         a) This Crl.M.C. is allowed.\n<\/p>\n<p>Crl.M.C. No. 3723 OF 2008<br \/>\n<span class=\"hidden_text\">                                   -:3:-<\/span><\/p>\n<p>         b) The impugned order is set aside.          Vehicle shall be<\/p>\n<p>         released to the petitioner on the following terms:<\/p>\n<blockquote><p>             i) Petitioner shall produce before the learned<\/p>\n<p>             Magistrate all the documents to show that he<\/p>\n<p>             is the owner of the vehicle entitled to<\/p>\n<p>             possession of the vehicle.\n<\/p><\/blockquote>\n<blockquote><p>             ii) He shall execute a bond for an amount<\/p>\n<p>             equal to the value of the vehicle to be fixed by<\/p>\n<p>             the learned Magistrate in his discretion with<\/p>\n<p>             two solvent sureties for the like sum to the<\/p>\n<p>             satisfaction of the learned Magistrate. In such<\/p>\n<p>             bond, he shall specifically undertake not to<\/p>\n<p>             use the vehicle for commission of any offence<\/p>\n<p>             under the Kerala Protection of River Banks &amp;<\/p>\n<p>             Regulation of Removal of Sand Act while the<\/p>\n<p>             same is in his possession.<\/p><\/blockquote>\n<p>             iii) The petitioner shall make a cash deposit of<\/p>\n<p>             Rs.35,000\/- before the learned Magistrate<\/p>\n<p>             which amount shall be released to the<\/p>\n<p>             petitioner on production of satisfactory proof<\/p>\n<p>             before     the     learned     Magistrate    that<\/p>\n<p>             proceedings     for   confiscation   before  the<\/p>\n<p>             revenue authorities     in respect of both cases,<\/p>\n<p>             i.e., Crime No.328\/08 of Cheruthuruthy Police<\/p>\n<p>Crl.M.C. No. 3723 OF 2008<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>             Station and Crime No.79\/08 also before the<\/p>\n<p>             Cheruthuruthy Police Station, are over and<\/p>\n<p>             amounts as directed have been deposited.<\/p>\n<p>                                        R.
