Counsel for the appellant states that all arrears<br \/>\nof maintenance shall be cleared within four weeks from today. He<br \/>\nfurther states that the matter thereafter be referred to the<br \/>\nMediation Centre for amicable settlement. However, he submitted that<br \/>\nthe proceedings for enhancement of the  maintenance under section 127<br \/>\nof the Code of Criminal Procedure [Cr. P.C.] may be stayed by this<br \/>\nCourt until the report is received from the Mediation Centre.\n<\/p>\n<p>2.\t\tMr.\n<\/p>\n<p>Majmudar, Ld. Counsel for the respondents states that there is no<br \/>\nobjection for referring the matter to the Mediation Centre, but he<br \/>\nsubmitted that the arrears may be cleared and instead of staying<br \/>\nproceedings under sec. 127 of the Cr. P.C for enhancement of the<br \/>\nmaintenance, he shall instruct his clients to seek adjournment.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, the appellant shall clear the arrears of<br \/>\nmaintenance within four weeks as declared. The amount shall be<br \/>\ndeposited in the trial Court, which shall be permitted to be<br \/>\nwithdrawn by the respondents. Further the amount of Rs.5,000\/-, which<br \/>\nhas been deposited with this Court towards probable costs, if not<br \/>\nwithdrawn, shall be permitted to be withdrawn by the respondents.\n<\/p>\n<p>4.\t\tAfter<br \/>\nit is declared by the applicant that the arrears will be cleared as<br \/>\nper the declaration made before this Court, the reporting shall<br \/>\naccordingly be made by him in the present proceedings and thereafter,<br \/>\nthe matter shall be referred to the Mediation Centre for settlement.<br \/>\nAn attempt shall be made to settle the matter between husband and<br \/>\nwife, preferably within a period of three months. In case the<br \/>\nsettlement is not arrived at, the matter shall be placed on judicial<br \/>\nside.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe event the declaration for clearance of maintenance is not<br \/>\ncomplied with, it would be open to the respondents to move this<br \/>\nCourt.  Further, if the arrears is cleared as declared and the matter<br \/>\nis referred to the Mediation Centre as recorded hereinabove, the<br \/>\nrespondents shall seek adjournment in the proceedings under section<br \/>\n127 of the Cr.
